AFFIDAVIT OF WITNESS (BUYER)

I, ELWIN T. CAPARIÑO, of legal age, married, Filipino and a

resident of Brgy. Zone V, Sogod, Southern Leyte, after having
been duly sworn to an oath in accordance with law, hereby
depose and say:

1. That I am an employee of Southern Leyte Electric

Cooperative, as Lineman;

2. That sometime on May 2016, Gaspar Naputol Jr. asked me

whether I am interested to buy Flat Screen TV. I answered,
No, as I have my TV set. However he insisted me as the price
is co cheaper. I asked him, where did it came from, why it is
cheap? He answered, it is slightly damaged and came from a
traveler;

3. On the night of same day, around 6:30 in the evening Mr.

Gaspar arrived at our house and he brought already 1 box,
containing SONY 49”TV set. I refused, but he insisted and
offered for installment in the amount of Ten Thousand Pesos
(P10,000.00). I accepted as it is installment for two gives. I
paid the full amount after two weeks;

4. Week after Gaspar had brought the TV set in my residence, I

had told my co-worker Jonathan OLaco that I had bought a
cheaper TV set. He was interested, so I told Gaspar regarding
the interest of Jonathan.

5. On November 21, 2019, around 6:00 in the evening,

Jonathan Olaco called me and asked to voluntary surrender
or turn over the TV set that we had bought form Gaspar as
there are reports that TV sets from the warehouse of Des
Marketing were stolen. So I agreed. Together with Jonathan
Olaco, we voluntarily surrender the TV sets that we had
bought. Attached is the receipt made by the police
when we surrender the items.

6. At the police station, the police officers verified the serial

numbers and it was confirmed that the TV set, with serial
numbers: 6808128, 6808247 and 4702155 are all included in
the list of the missing TV sets of DES marketing;

 7. With this circumstance I realized that the source of the TV
sets offered to us is tainted with irregularity.

8. That I voluntarily executed this affidavit to attest that it was

Gaspar Naputol Jr. who offered and sold to me the SONY
TV with serial number 6808247, and for whatever legal
intents and purposes this may serve.

IN WITNESS WHEREOF, I have hereunto set my hand this 6 th

day of December 2019 in the Municipality of Sogod, Southern
Leyte, Philippines.
