COMPLAINT
I, Jesus Angelo Diosana, of legal age, residing at 143 San diego St. Sampaloc, Manila, under
oath, declare that:

1. Respondent Joshua A. Busto is a Filipino, of Legal age, resident of Bahay Caridad E

Rodriquez, Quezon City.
2. Sometimes in December 2019. Joshua purchased several Adidas Kanye West Yeezy
shoes from me for a total amount of Pesos, Three Hundred Thousand Eight hundred (P
300,800);
3. In payment for the goods, Joshua drew and delivered to me in my residence, a check
particularly described as follows: Banco De Oro-Sampaloc, Sampaloc branch, Check
54321 dated 15 January 2020 for P300,800.00
4. Upon deposit of the check when it fell due and demandable, his respective bank
dishonoured the check for having been drawn against insufficient fund, A copy of the
check, stamped with the proper reason for dishonour, is attached as Annex A.
5. Despite repeated demands, Joshua ignored and failed to replace the check and fulfil the
obligation stated in it plus interest of 6% per annum. As a result, I seek the service of my
counsel who demanded in writing the payment of his obligation. A copy of this last
demand is attached as Annex B.
6. Constrained to institute this criminal complaint against Joshua, I suffered actual
damages in the amount stated above. I also undertook to pay my counsel for his services
the sum of P40,000.00 on top of the litigation expenses u uncured in connection with
this case, the amount of which I shall prove during trial proper.
7. I execute this affidavit to confirm the truth of the foregoing and to support my complaint
against Joshua for violation of Section 1 of Batas Pambansa bilang 22.
