DEED OF HEIRSHIP AND SALE

KNOW ALL MEN BY THESE PRESENTS:

This DEED is entered into and executed by, REMEGIO A. SANICO, of legal age,
Filipino, Single, and a resident of barangay Looc, Sibulan, Negros Oriental, hereinafter called the
VENDOR, in favor of,

MITCHELL SAYONG ESPRAGUERA, also of legal age, Filipino, married to Enrique


Espraguera, and a resident of barangay Cangmating, Sibulan, Negros Oriental, hereinafter
referred to as the VENDEE;

WITNESSETH:

That there is a certain parcel of land, known as Lot No. 3395 of the Cadastral survey of
Sibulan, Cadastral Case No. 15, L.R.C., Cad. Rec. No. 358, located in barangay Looc, Sibulan,
Negros Oriental, covered by Original Certificate of Title No. O-V-5512, containing an area of
THIRTEEN THOUSAND SEVEN HUNDRED and SEVENTY TWO (13,772) square meters,
more or less, registered in the name of FRANCISCO ABO and which parcel of land is more
particularly described as follows:

“ A parcel of land, Lot No. 3395, Sibulan Cadastre, situated at barangay Looc, Sibulan,
Negros Oriental. Bounded on the North East by Lot No. 3402; on the South East by Lots Nos.
3399 and 3396; on the South West by Lot No. 3394; and on the North West by Lots Nos. 3439
and 3435”;

That FRANCISCO ABO died intestate sometime ago, leaving without any testamentary
will nor debts not settled until the present and upon her death she was survived by his children
and only compulsory heirs, and one of them is the herein Heir-Vendor, REMEGIO A. SANICO;

That all the Heirs of the late Francisco Abo have agreed to subdivide and partitioned all
the lands of the deceased Francisco Abo and the aforementioned parcel was awarded to his eldest
daughter, EUFROCINA ABO;

That Eufrocina Abo, also died intestate sometime ago, leaving without any known
Testamentary Will nor debts not settled until the present and upon her death she was survived by
her three children and only compulsory heirs and one of them is the Heir-Vendor herein,
REMEGIO SANICO;

That the heirs of Eufrocina Abo have verbally partitioned Lot No 3395 into several
sublots and Lot No. 3395-E, consisting of 1,409 square meters was awarded to Remegio Sanico
and took possession of the said land until the present;

NOW THEREFORE, invoking the provisions of Section 1, of Rule 74 of the Rules of


Court and other related laws on intestate succession, the herein heir-vendor have extrajudicially
settled and adjudicated unto himself Lot No. 3395-E, consisting of One Thousand Four Hundred
Nine (1,409) square meters, more or less, free all liens and encumbrances;

WITNESSETH:

That for and in consideration of the sum SIXTY THOUSAND PESOS (Php60,000.00),
Philippine currency, in hand paid by the vendee herein, Mitchell Espraguera and receipt in full is
hereby acknowledged by the vendor, Remegio Sanico, to his entire satisfactions and that by
virtue of these presents the herein vendor does hereby SELL, TRANSFER, and CONVEY unto
the vendee, her heirs and assigns, a portion of Lot No. 3395-E, consisting of FOUR HUNDRED
NINE (409) Square Meters, more or less; free from all lines and encumbrances.

That the vendor herein declare that this land is not tenanted nor worked upon by an
agricultural lessee and that due notice has been given to all persons affected by this transaction
in compliance with the provisions of the New Civil Code of the Philippines, pertaining to the
rights of the redemptioner and preemptioner, but nobody opted to exercise the said rights and the
sale of these parcel of land is in consonance with the provisions of the Comprehensive Agrarian
Reform Law because this parcel of land is within the retention limits of the vendor, further, the
vendor warrants his ownership over the said parcel of land and will defend the rights of the
herein vendee against any adverse claim whatsoever.

IN WITNESS WHEREOF, we have hereunto affixed our signatures this _____ day of
August 2014, at Dumaguete City, Negros Oriental.

BEFORE ME, a Notary Public in and for the City of Dumaguete and the Province
of Negros Oriental, this _____ day of August 2014, personally appeared the vendor, Remegio
Sanico and the vendee, Mitchell S. Espraguera, who are both personally known to me and
exhibited to me their Community Tax Certificate Nos. 21338448, issued on April 11, 2014 and
21433193 issued on July 4, 2014, respectively, both issued at Sibulan Negros Oriental; and that
they are the same persons who executed and voluntarily signed the foregoing (DEED OF
HEIRSHIP AND SALE) which they acknowledged before me as their free and voluntary act and
deed, consisting of only two (2) pages including this page on which this Acknowledgment is
written, duly signed by them and the instrumental witnesses on each and every page hereof.
