- Assume that you are working as an associate of the Rillera and Associates Law Office. A Junior
Partner (John/Jane Doe) asks you to prepare an Inter-Office Memorandum for him/her to prepare an opinion
letter to a client. The Junior Partner requires you to prepare an objective memorandum based on the facts and
the applicable laws and jurisprudence.
- The Junior Partner narrates that the family of Ex-Mayor Antonio Sanchez, who was convicted in the
controversial Sarmenta-Gomez double murder case in the 1990's, asked the law office to render an
advice/opinion on whether or not Sanchez may be entitled for an early release based on the GCTA Law and its
IRR (disregard the new and amended IRR of 2019; instead, use the contentious IRR approved during the
Aquino administration).
- You may use the discussions in your book (P. 123 onwards) as guide.
- Observe simplicity, clarity and persuasion in preparing your memorandum.
- Avoid fallacies (i.e. Appeal to Emotion etc) in making your arguments/ statements/recommendation.
- Minimize block quotations.
- Always cite your sources. Plagiarism has no place in legal writing. Plagiarized works will automatically
be marked as failed.
- Apply Sections 3 and 4 of the Efficient Use of Paper Rule (A.M. No. 11-9-4-SC) for format and style.
Deadline will be on 5:30PM of October 25, 2019.
Also consider the discovery of illegal drugs in the Bilibid jail cell of Sanchez in 2006 and 2010. In 2015,
the BuCor seized an air conditioner, flat screen TV and refrigerator (which are all prohibited items) in his cell in
Bilibid's Maximum Security Compound. Please note of the definition of good conduct, if there is any.
