However, as directed, a draft Zonal Transfer/Placement Guidelines, 2019


for IRS-C&CE (Group-A) Officers of this Zone is put up opposite for approval /
orders, please.

PUC at pages C/538-542 is letter dated 12.04.2019 of All India


Association of Central Excise Gazetted Executive Officers (AIACEGEO) Odisha
Unit, requesting for some amendments to the Transfer / Placement Gidelines,
2018 of Bhubaneswar Zone.

The proposals for amendments to the abovementioned Policy in brief as


requested by AIACEGEO are as follows:

(a) Maximum tenure in Customs (Preventive) Commissionerate: 4 years


(including tenure at Paradeep Customs Division or Dhamra Customs
Division of 2 years and at BPI Airport or Headquarters of Customs-
Prev.Commissionerate of 1 year)
(b) Max.tenure in GST&CX Commissionerate, Bhubaneswar: 12 years;
(c) Max.tenure in GST&CX Commissionerate, Rourkela: 12 years;
(d) Max.tenure in Audit Commissionerate, Bhubaneswar: 4 years;
(e) Tenure in Appeals Commissionerate, Bhubaneswar: 2 years, which may
be extendable further on request of the incumbent;
(f) Tenure in CCO, Bhubaneswar: 2 years, which may be extendable
further on request of the incumbent;
(g) Persons posted in sensitive places may be allowed to complete their full
tenure and if needed to shift them from there mid-term, then they may
be given another sensitive posting possibly in another Commissionerate
(h) Priority may be given to those officers who opt for the first time for
posting at CPU, Paradeep Customs and Dhamra Customs.
(i) Tenure in difficult places of posting may be extended further on
request of the incumbent;
(j) All GST Ranges as “Non-sensitive”;
(k) Tenure of service rendered in a place in the grade of Inspector may not
be counted for the purpose of transfer in that place of posting for the
grade of Superintendent;
(l) Maximum overall career cap limit of 18 years at Bhubaneswar-Cuttack
and Sambalpur-Rourkela may be removed;
(m) Keeping in view parents/children care-taker status of Superintendents
who have rendered more than 25 years of overall service career, they
should be given posting of their choice;
(n) Number of affected persons during transfer may be kept to the
minimum to preempt extra expenditure on TTA and to give more
stability and expertise to the incumbents, in compliance with MoF OM
F.No.7(2)E-Coord/2005 dated 23.11.2005;

Besides the above, the Association has put forth the issue of non-
reimbursement of TTA to some officers even after lapse of 2 years.

With reference to the above notes on the PUC as at pages C/470-474


i.e, DGHRD letter dated 16.11.2018 circulating DoPT OM dated 08.10.2018 on
exemption from routine exercise of transfer/rotational transfer, this is to submit
that:
(i) Vide Para 14.1(ii) (C/458) of the “Transfer/Placement Guidelines, 2018” of
Bhubaneswar Zone, it is mentioned that “ii) Officers having Autistic or
special/differently-abled children” can represent for exemption from
transfer during AGT.
(ii)In the above-referred DoPT OM dated 08.10.2018, it has been elaborately
defined about the eligibility for seeking exemption from transfer/rotation as
a care-giver of dependent daughter/son /parents/spouse/brother/sister,
etc., consequent enactment of the Rights of Persons with Disabilities Act,
2016 on 17.04.2017.

In view of the above, if approved, we may issue a corrigendum to the


“Transfer/Placement Guidelines, 2018” of Bhubaneswar Zone as under:
OLD Para 14.1(ii) May be replaced with the NEW Para 14.1(ii)
“Officers having “Officers who serve as the main care-giver of persons with
Autistic or disability as detailed in Para 3 of Office Memorandum
special/differently issued vide F.No.42011/3/2014-Estt.(Res) dated
-abled children.”. 08.10.2018 circulated vide DGHRD

As per kind directions of CC as at NSP-XIX, a Committee was formed to


submit a draft Transfer/Placement Guidelines, 2018 for Group B Executive
Officers, Group B Ministerial Officers and Group C staff in the Zone. As per the
said direction, a letter of even no. dated 15.03.2018 was issued (C/314-316), in
response to which, the said Committee has submitted its draft policy as placed
at pages C/344-378.

The said draft Transfer/Placement Guidelines, 2018 is put up for favour


of kind perusal, approval / orders.

Ref.: Notes at NSP-IV to NSP-XIII and Transfer Policies as placed at pages


C/120-184 of other Zones.

In the above-referred notes, as per CC’s kind direction, the AIACEGEO’s


suggestions vide letter dated 05.12.2017 (C/90-94) were examined and put
up. However, as per instructions, vide CCO letter dated 02/04.01.2018
(C/118), other Zones were requested to forward copy of their Transfer
Policies. In response, transfer policies have been received from a few Zones
and transfer policies of some other Zones have been downloaded from the
related websites and put up for perusal at pages C/120-184.

From the available Transfer Policies of other Zones, important policy


issues relevant/applicable to Bhubaneswar Zone (starting from Shillong Zone,
since the said Zone’s situation resembles with this Zone) are produced below:

Shillong Zone:
(i) Transfer Policy for executive and ministerial Officers, issued on
05.03.2015, is applicable for the North Eastern Region.
(ii) Inter-Commissionerate placement of Executive Officers is done by
the Chief Commissioner and posting within the Commissionerate is
done by the respective Commissioners.
(iii) Timelines for AGT:
(a) Option for posting – by 31st of October every year
(b) Posting order – by 15th of December every year
(c) Relieve/release of officers – by 31st of January or on completion
of children’s academic session if ward is in class 12 th – whichever
is later.
(iv) Postings have been categorized as sensitive, non-sensitive and hard
posting.
(v) Posting at sensitive posting is done for 2 years except in sensitive
LCS, where the tenure is kept at 1 year. No officer is posted from
sensitive to sensitive places.
(vi) Repetition of posting in hard/sensitive postings is not done of a
person if posted earlier, except in cases where there is no applicant
for the said places.
(vii) Normal continuous tenure in each Commissionerate (Customs or
Central Excise) is 6 years, which can be extended reduced as per
administrative requirement.
(viii) For places for which no applicants are easily available, then the
following category of officers are posted in that order:
(a) Newly recruited officers
(b) Newly promoted officers

(d) Officers have home town in or around the non-opted place.

(f) Officers going out of non-opted places are given choice posting.
(ix) An officer is allowed to continue at a place where willing to continue,
if no option is exercised by other officers for the same place of
posting.

(x) Representations are routed through proper channel and the same
are exercised for choice of station or place and not for specific
posting.
(xi) Applicants for posting on compassionate ground, if considered, are
given non-sensitive posting.
(xii) In all sensitive LCS and hard postings in Customs field formations
excluding postings in HQ Preventive, Divisional Preventive, CPF &
PPs, the tenure is one year for all executive cadres and any deviation
to this is recorded with reasons.
(xiii) All postings earmarked for various Directorates in the Zonal
jurisdiction are done on the basis of option cum selection process by
the Chief Commissioner.
(xiv) For Audit Commissionerate, officers are selected as per Para 3.2 of
Audit Manual.
(xv) Tenure in Audit Commissionerate is for minimum four years and
officers are not continued in a Section in Audit Commissionerate
headquarters and Audit Circles/Groups for more than two years.
(xvi) Since the Audit Commissionerate is headquartered in Guwahati (as in
Bhubaneswar Zone the HQ is at Bhubaneswar) the overall ceiling of
six years in a station is applied for posting in the Hqrs.Office of the
Commissionerate including the Circle offices stationed at Guwahati.
(xvii) Commensurate with the above guideline, tenure in all the circle
offices stationed in the Hqrs. Offices/Divisions of all Central Excise
Commissionerates are clubbed with the respective station tenure for
determination of the station tenure.
(xviii) All the posts in Touring Groups in Audit Commissionerate are
classified as sensitive whereas all the non-touring postings in
Monitoring and Technical sections are non-sensitive.
(xix) Posting of newly recruited Inspectors in Audit Commissioner is
avoided.
(xx) In case of Ministerial officers, routine transfer of from one station to
another is avoided. However, on administrative ground/vacancy and
representation, Group “B” & “C” Ministerial officers are transferred
from one station to another station.
(xxi) Group ‘B’ and ‘C’ Ministerial officers are rotated from Customs to
Central Excise and Vice Versa after every 5 to 6 years.
(xxii) All Ministerial officers are rotated from one charge to another within
the same station after every 3 years.
(xxiii) Generally, the Group ‘C’ Non-Gazetted staff are also liable to be
transferred anywhere within the Zone. However, frequent transfer of
this categoryXVI

(xxiv) Transfer and Posting of Group ‘C’ Non-Gazetted staff within the

from the respective Divisions of the

(xxv) In case of no options for a particular area, administration takes its
own decision as is convenient to post Group ‘C’ Non-Gazetted staff.
(xxvi) Group ‘C’ Non-Gazetted Officers posting in AudittoCommissionerate

including Audit Circles is classified as Non-Sensitive posting and the
Audit tenure is same as in other Central Excise Commissionerates.
(xxvii) Group ‘C’ Drivers are rotated from Custom to Central Excise and Vice
Versa after every 4 to 6 years depending on administrative
convenience.
(xxviii)Any aberration or deviation from the transfer policy needs Chief
Commissioner’s consent.

Bengaluru Zone (Other than the above points relevant for Bhubaneswar
Zone):
(i) As a welfare measure, lady officers are given opportunity of opting to
come back after completion of one year at stations out of Bengaluru
on their own cost. Such 1 year are allowed to be completed without
taking any leaves more than what is due during such 2 years or 1
year of posting. Non-compliance leads to continuance of the
outstation posting beyond the said periods.
(ii) In case of rotation of between sensitive and non-sensitive postings, if
non-availability of sufficient officers, officers from sensitive postings
are also rotated to another sensitive charge.
(iii) First posting of officers joining on Inter-Commissionerate transfer are
posted in non-sensitive charge.
(iv) If spouse of an officer is employed in Central/State Government,
then he/she is posted in the station where his/her spouse is working
or in a nearby station.
(v) Cooling off period of 2 years is maintained in respect of officers for
postings in DGRI, DGCEI and DGoV. However, the said cooling off
period is not applicable in respect of postings to other Directorates
from a Commissionerate or Directorate.
(vi) The willing officers who are clear from vigilance angle are posted to
SEZs in Karnataka on transfer basis for a minimum period of 2 years
extendable by maximum period of 1 year. Posting to SEZs in
Bangalore are based on seniority. Generally, officers opting after
Customs tenure are not considered eligible for SEZ posting in
Bangalore and vice versa.
(vii) On posting to Customs formations, officers are given adequate
training in Customs work.
(viii) Requests for retention at a place are taken for consideration on
grounds of medical problem, posting of spouse in same station,
active sportsmanship and on administrative exigencies.

Chennai Zone (Additional points, besides the above):
(i) Directly recruit/newly promote Inspectors are posted in field

formations.
Continued from NSP-XVIHowever, this policy is not applicable to Inspectors
appointed on Sports quota.
(ii) Tenure in LTU/LTU(Audit), CCO and Appeal Commissionerates are
treated as exempted tenure. Continued to NSP-XVII
(iii) Tenure in DGRI, DGCEI and DGoV are also considered as exempted
tenure.
(iv) Officers having undergone CAAP Audit training or having finance &
accounting background are preferred for posting in Audit
Commissionerate.
(v) First preference is given to tenure in CCO, LTU or Appeal
Commissionerate for posting to Audit Commissionerate.
(vi) To fulfill the requirement of correct & complete database for
operationalizing the transfer policy, CCA had approved procurement
and installation of computerized Employees Management Software
(EMS) and CCA and Establishment Sections are made responsible for
updating the correct database.
(vii) Officers having less than 2 years of service are posted in or nearer to
hometown on their choice.
(viii) Post-AGT representations are taken for consideration only after the
applicant’s joining in the new place of posting by a Committee of
Cadre Controlling Commissioner and another Commissioner and
Additional Commissioner nominated by the Chief Commissioner.

This is also to submit that all the above Transfer Policies are relevant for
pre-GST implementation period. Also submitted that vide letter dated
17.01.2018 (C/184), Nagpur Zone has intimated that since their revised
Transfer Policy is yet to be finalized, the same could not be forwarded to this
office.

Pages C/90-94 is letter dated 05.12.2017 of All India Association of


Central Excise Gazetted Executive Officers (AICEGEO), Odisha Unit,
Bhubaneswar, giving suggestions for amendment of existing Transfer Policy of
the Zone
The said suggestions along with necessary examination of the same, as
directed, are submitted below:
Points (1) & (2):
AICEGEO suggested that all postings may be graded as (i) Sensitive, (ii)
non-sensitive (iii) difficult / hard place of posting, which may be relooked once
in a year before AGT. It also suggested that in the GST regime, all the Ranges
may be declared as non-sensitive as there is hardly any scope for direct
interaction with the assessee and the officer has to perform system-based
work.
 Earlier sensitive/ non-sensitive / difficult / hard places of postings were
declared vide the Transfer Policy, 2005 dated 22.03.2005 (C/2-6) and
subsequent amendments on 07.04.2005 (C/8), 23.03.2006 (C/10-18)
and 05.01.2015 (C/20-30), keeping in view the then available
formations of this Zone and related status of those formations. In GST
regime, new formations have come up and some old formations have
been weeded out.

 In view of the above, the present formations need to be declared


according to the present workload / public interaction / connectivity of
the place with major cities / living amenities available thereat, etc. A list
containing names of formations along with Ranges of this Zone and their
locations (as on 01.12.2017) is placed at pages C/98-102.

 Regarding amending the category of places of posting by relooking once


in a year before AGT, the same seems to be an acceptable suggestion in
view of frequently changing scenario under GST regime.
Point (3):
Individual continuous tenure in Bhubaneswar, Cuttack and Rourkela has
been suggested to be kept at a maximum of 10 years. This has also been
suggested that if someone is posted at these three places individually having
breaks, then the continuous tenure in the said places may be counted from the
fresh date of posting therein without counting the earlier periods of posting
thereat.

 The above suggestion appears to be acceptable in view of the fact that


more numbers of Superintendents and Inspectors are to be placed in
these three places compared to other stations. In case lesser ceiling on
tenure period in these places are fixed and initial posting in one place is
counted in case of repeated postings in the same place, then the
Administration may find it difficult to fill up these three places in view of
the amended policy, having lesser number of eligible officers at hand.

Point (4):
The Association has suggested that tenure of posting in all Ranges
except difficult place of posting may be of maximum 2 years.

 2 years of posting in difficult place of posting was there in earlier


Transfer Policy also and may be continued, if approved.

Point (5):
As requested by the Association, Ranges at Titilagarh, Sundargarh,
Belpahar, Rairangpur and Talcher of Rourkela Commissionerate and Ranges at
Nayagarh, all Ranges of Rayagada Division and Dhamra Range of Bhubaneswar
Commissionerate may be declared as difficult places of posting due to non-
availability of better medical / education facilities and all other amenities.

 Barring a few cities and big towns of Odisha, other places of the State
deserve to be uplifted as far as health, education, transportation and
living amenities are concerned. Hence, generally the places located
away from the cities and big towns are not considered to be places for
comfortable living. However, the related states of affair in the
abovementioned places, as gathered from various websites of
Government of Odisha and Wikipedia, are as under:

 Titilagarh Range: Located at Titilagarh, a small town in Balangir


District of West Odisha. Next to Thar Desert, Titilagarh is considered to
be the hottest place of India during summer. Titilagarh is around 390
km away from Bhubaneswar and though connected by road and rail,
connectivity frequency is not good. No good educational institutes and
hospitals are available there. The said Range has been considered a
difficult place of posting earlier also, which may be continued, if
approved.
 Sundargarh Range: Located at Sundargarh District Headquarters, in
North-West part of Odisha, is around 360 km away from Bhubaneswar,
having extreme climate, being too hot in summer and chilly in winter.
Because of hilly and sloping nature of landscape, the area is facing the
problem of scarcity of drinking water. Declaring Sudargarh Range as a
difficult place of posting may be taken into consideration due to the
above facts.
 Belpahar Range: Located at Belpahar, a small town of Jharsuguda
District, also in North-Western part of Odisha, is around 350 km away
from Bhubaneswar. No Kendriya Vidyalaya is functioning there. Being a
small town, good health caring institutes are not available there. May
be considered as a difficult place of posting, if approved.
 Rairangpur Range: Located at Rairangpur, a small town of
MayurBhanj District in North Odisha, is around 280 km away from
Bhubaneswar. Though connected by road with Bhubaneswar,
Rairangpur has no railway connectivity to any place. Barring a small
Govt.hospital, there is no other good hospital at Rairangpur. May be
considered as a difficult place of posting, if approved.
 Talcher Range: Located at Talcher, a small town of Angul District, is
around 140 km away from Bhubaneswar. Famous for coal mines, the
place is hot and dusty due to the mines. Drinking water is scarce. Good
schools are not available and Kendriya Vidyalaya is not established
there. Besides one or two under-rated hospital, there is no facility of
good health caring institutes. May be considered as a difficult place of
posting, if approved.

 Nayagarh Range: Located in a notified area council (NAC) area of


Nayagarh town of the same named District, is around 85 km away from
Bhubaneswar. It is a congregation of many small villages. It is a hilly
Naxal-affected area, having no Kendriya Vidyalaya. Besides a small
Govt.hospital, there is no good hospital to cater to the health problem.
May be considered as a difficult place of posting.
 Rayagada-I & II Ranges under Rayagada Division: Located at
Rayagada District Headquarters in the southern part of Odisha, is
around 410 km away from Bhubaneswar. It is a hilly naxal-affected
area. Barring District and Railway hospitals, there is no good health
care institute at Rayagada. Patients usually cover around 150 km to
Vishakhapatnam for any health complication. From the very beginning
this place has been declared as difficult place of posting, which may be
considered for continuance, if approved.
 Jeypore-I & II Range under Rayagada Division: Located at
Jeypore, a small town of Koraput District is around 530 km away from
Bhubaneswar. The place is not having good health caring institute.
People prefer to visit Vishakhapatnam for health problems. There is no
Kendriya Vidyalaya also. Naxal presence is also felt in Jeypore.
Communication to Jeypore goes through Rayagada. May be considered
as a difficult place of posting, if approved.
 Koraput Range under Rayagada Division: Located at Koraput
District Headquarters, is around 505 km away from Bhubaneswar. The
place does not have good hospital and patients run to Vishakhapatnam
for any health problem. This is also a naxal-affected area.
Communication to this place runs through Rayagada. May be
considered as a difficult place of posting, if approved.
 Bhawnipatna Range under Rayagada Division: Being located in a
small town of Bhawanipatna in the south-western District named
Kalahandi of Odisha, is around 405 km away from Bhubaneswar. It is
also a naxal-affected area, not having good health institutes, schools
and colleges in the vicinity. May be considered as a difficult place of
posting, if approved.

 Dhamra Range: Being located at Dhamra in the District of Bhadrak on


the eastern part of Odisha, is around 210 km away from Bhubaneswar.
The place does not have any hospital barring one or two small
dispensaries meant for primary health care. It does not have good
schools and no colleges at Dhamra.

Point (6):
Posting in difficult places of posting may be for one year only.

 Posting to finally decided “difficult places of posting” need to be given


relief by reducing the tenure for posting there, which may be accepted,
if approved.

Point (7):
The tenure in posting at Customs House Paradeep, Dhamra and
Customs Commissionerate may be fixed at 3 years, 2 years and 2 years,
respectively, keeping in view the locality, facility and amenities available.

 Earlier also Paradeep Customs posting was for 3 years, which may be
continued, if approved.
 Regarding Dhamra Customs Division, if the GST & CX Dhamra Range is
considered by the Administration to be a difficult place of posting, then,
considering Dhamra Customs as a “place having good amenities” would
be contradictory. Hence, if the abovementioned GST Range is
considered as difficult place of posting, then Dhamra Customs should be
considered accordingly, and the tenures in both the formations should
be at par with each other, if approved.
 Customs Commissionerate needs more staff due to the possible increase
in operation of international flights and the concerned administrative
wing also should be self-sufficient having more staff. Hence, limiting the
period of posting to two years of Superintendents and Inspectors in the

Point (8):
(i) Posting in Static Section of Audit Commissionerate may be given
only after completing four years in different Audit circles & vice versa and (ii)
tenure of posting of Superintendent exclusively for DDO work may not be
counted for total tenure of posting in the Audit Commissionerate.

 Regarding proposal (i) above by the Association for posting to be done


in Static Section of Audit Commissionerate after completion of four years
by the incumbent in different Audit Circles appears to be acceptable in
view of the fact that though the postings in Audit Circles are sensitive,
the Static Section posting is held as non-sensitive. However, approval of
this proposal will necessitate to include a clause in the Transfer Policy
about maximum tenure of 8 (eight) years in Audit Commissionerate.
 As regards the proposal (ii) i.e non-inclusion of the tenure of
Superintendents looking after exclusive DDO work in Audit
Commissionerate while counting the whole tenure in the
Commissionerate, the said work being of non-sensitive nature and is
being looked after due to scarcity of AO/ACAO, the same appears to
have justification. However, while deciding the proposal at (i) above,
the proposal at (ii) can be taken care of as both are having equal base
of justification.
Point (9):
Officers having ward studying in class 10 th & 12th & appearing Board
examination in that particular session may not be transferred from the station.

 This proposal seems to be having genuine ground. This was also


included in earlier Transfer Policy. However, the decision of taking such
grounds may depend on the situation at hand of the transferring
authority, since such cases will be ample. May be continued, if
approved.

 This proposal, though was not appearing in the earlier Transfer Policy,
2005, as amended of this Zone, yet an unwritten policy was followed
with regard to posting of lady officers at their choice of station
irrespective of number of years of stay in a particular station. The same
may be incorporated in the proposed Transfer Policy to be followed
barring in Administrative exigency periods, if approved.

Point (11):
Representation on medical ground may be considered irrespective of
number of years of stay in a particular station.
 The above proposal may be considered for approval, please.

Point (12):
Posting from sensitive to sensitive must be avoided in terms of guideline
issued by the CVC/DG(Vigilance) and mandatory 02(two) years of continuous
posting in non-sensitive formation/section for officers completing 02(two) years
of posting in a sensitive formation/section.
 Circular No.03/09/13 dated 11.09.2013, downloaded from CVC website
is placed at page C/96 relating to the above proposal of the
Association, for perusal, please, wherein it has been instructed to
periodically rotate officials holding sensitive posts. In earlier Transfer
Policy of this Zone also this found place, which may be continued, if
approved.

Point (13):
For selecting officers for sensitive posting, priority may be given to the
officer having the longest period of non-sensitive posting.

 Though the earlier Transfer Policy of this Zone did not contain this policy
of selecting officers having longest period of non-sensitive posting for
new posting at sensitive places, yet it appears that the authority was
taking care to do so while issuing AGT orders. This may incorporated in
the proposed Policy, if approved.

Point (14):
Repetition of posting particularly in CPU of Commissionerates and to
DGGSTI on loan basis may not be repeated.
 This proposal may be considered. However, while posting in CPU,
efficiency of the officer and his/her preventive knack may be taken into
consideration. Accordingly, the proposal may be incorporated in the
upcoming Transfer Policy, if approved.

Point (15):
Anti-evasion Sections of GST Commissionerates may be for 2 years and
there may be a cooling off period may be 2 years after the said posting which
should not be waived.

 This proposal is similar to the proposal as at Point No.12 above and


seems it will be taken care of at the time of finalizing Point No.12.
Point (16):
Posting in difficult/hard place may be given once in one’s service career
barring a situation where one opts for the said place.
 This proposal may be incorporated in the Policy, if approved.

Point (17):
Tenure of posting on deputation in the Directorates in Bhubaneswar,
Cuttack and Rourkela may be included while taking into consideration the
tenure in Bhubaneswar, Cuttack and Rourkela.
 This proposal for including the period of posting in Directorates at
Bhubaneswar, Cuttack and Rourkela in the tenure at those places does
not seem to be appropriate, since deputation to other Directorates are
beyond the jurisdiction of this Zone. Also as per Para 5.5 (Extract at
page C/112) of Group ‘A’ Transfer Policy issued by CBEC, as amended,
periods of deputation to directorates do not count for towards
calculation of stay at a particular station. However, posting to those
Directorates on “loan basis” may be considered as part of posting in
those places while taking into consideration the tenure in Bhubaneswar,
Cuttack and Rourkela.

Point (18):
A list of officers due for transfer may be published while inviting option
from the officers.

 This proposal may be accepted, if approved.

Point (19):
Officer Bearers of Service Associations may be consulted before the
AGT.
 Earlier in the Third amendment to the Transfer Policy, 2005 issued on
01.01.2015, there was a clause mentioning “Before issue of AGT order in
each and every year, certain postings/places shall be identified as
sensitive postings/places by the office of the Chief Commissioner in
consultation with the Commissioners and recognized Staff Association”.
The said clause may be continued in the proposed Transfer Policy, if
approved.

A copy of CBEC’s Transfer Policy for Group ‘B’ Gazetted Officers is also
enclosed at pages C/104-110, for kind perusal. This is also to submit for
considering formation of a Committee for the said policy which may put up a
draft Transfer Policy before the Chief Commissioner for approval.

Pages C/1-30 contain copies of Transfer Policy, 2005 and amendments


made to the said policy at subsequent periods, which is voluminous.

To pre-empt misinterpretation of the said policy and to facilitate


uploading the Transfer Policy on the Zonal website, a consolidated Draft
Transfer Policy-2017 was put up on 17.05.2017 for perusal and orders, which
had become imperative in view of proposed new GST formations. However, in
view of immediate implementation of GST in the Zone and related postings of
officers in various new/old formations, the same could not be finalized.

In the meantime, various Service Associations of this Zone have


forwarded proposals to be inserted in the Transfer Policy, brief of which are
reproduced below:

Proposals by AICEGEO (Superintendents), Odisha Unit:

(i) Grading of postings as (i) Sensitive, (ii) non-sensitive (iii)


difficult/hard place of posting.
(ii) All the Ranges in GST regime may be declared as non-sensitive.
(iii) Divisions and its Range under Rayagada Division and Balangir
Division along with Nayagarh Range, Gajapati Range, Kandhamal
Range, Dhamra Range, Deogarh Range, Rairangpur Range & Talcher
Range to declared as difficult place of posting.
(iv) The tenure in Posting classified as difficult/hard place may be
01(one) year.
(v) All the Audit circles may be stationed at Bhubaneswar except
Rourkela circle.
(vi) Posting in static Section of Audit Commissionerate may be given
only after completing four years in different Audit circles & vice
versa.
(vii) Officers having ward studying in class 10 th & 12th & appearing Board
examination in that particular session may not be transferred from
the station.
(viii) Lady Officers may be posted in their choice of station irrespective of
number of years of stay in a particular station.
(ix) Representation on medical ground may be considered irrespective of

Proposals by AICEIA (Inspectors), Odisha Unit:


(i) AGT may be effected in April every year preferable after completing
the promotional DPC from feeder grade to Inspector and Inspector to
Superintendent.
(ii) Declaration of Sensitive and Non-Sensitive Post by the Chief
Commissioner in consultation with the respective Commissioners
(iii) All seats of Customs and Audit should not be declared as sensitive.
(iv) Posting in difficult places of posting may be for one year only.
(v) Station tenure may be counted from AGT to AGT, irrespective of
minor variations in the tenure.
(vi) Government quarter allotted to an officer before his posting to Hard
Place, may be allowed to be retained.
(vii) Posting of Spouse at same station.
(viii) Representation of officers on Medical ground may be considered
favourably.
(ix) Premature transfer should not be done unless the officer opts.
(x) Service Associations may be called for general consultation before
AGT every year.

Proposals by Ministerial Officers’ (Odisha Unit) Association:


(i) Since staff strength in different grades of Ministerial cadre very low
compared to the Sanctioned Strength, they may not be transferred
unless any request is received from any officer in this connection.
(ii) Ministerial officers left with less than two years of service may not be
transferred to far away locations
(iii) The request of the ministerial officers seeking transfer/retention on
special grounds like spouse ground, physical disability and medical
ground of family members etc. may be considered as per DOPT
guidelines.
(iv) While considering posting of fresh Direct Recruit Tax Assistants, the
vacancy position of different formations may be taken into account.
(v) The JCM members like General Secretary/President should not be
posted out of Bhubaneswar, unless requested for smooth
management of staff welfare work.

Proposals by Group ‘C’ Officers’ (Odisha Unit) Association:


(i) Officers having ward studying in class 10 th & 12th and appearing
Board Examination in that particular session may not be transferred
from the station.
(ii) Representation on medical ground and superannuation may be
considered irrespective of number of years of stay in a particular
station.
(iii) At present, in the jurisdiction of Bhubaneswar Zone, more than 95
posts in the Grade of Havaldar/Head Havaldar are lying vacant. Some
range offices are functioning without any Havaldar/Head Havaldar.
(iv) The tenure in posting at Customs House Paradeep & Dhamra may be
extended upto four years.

Most of the points raised by the above Associations have been taken
care of in the draft proposal placed at pages C/32-38, extra copy of which is
placed opposite for kind perusal and orders by the Competent Authority,
please.
