INSTRUCTION TO BIDDERS

PROJECT: A PROPOSED THREE-STOREY MIXED-USE BUILDING WITH BASEMENT


LOCATION: SGT. RIVERA ST., A. BONIFACIO AVE., QUEZON CITY
OWNER: TRIGROUP DEVELOPMENT CORPORATION

PART 1. PREPARATION OF BIDS

1.1. Before bidding, the bidders shall visit the site of works on their own
responsibility and expense for necessary investigation of the nature of the
project and make themselves acquainted with the existing site conditions.
Bidders must make their own estimates of the facilities and difficulties
attending the execution of the proposed project including site conditions,
water and power supplies, storage of materials, uncertainly of weather,
availability and delivery of materials and other contingencies.

1.2. The bids shall be enclosed in a single sealed envelope endorsed clearly on
the outside with the words “BID FOR THE CONSTRUCTION OF A PROPOSED THREE
STOREY MIXED-USE BUILDING WITH BASEMENT OF TRIGROUP DEVELOPMENT
CORPORATION. The sealed proposal shall include the following in triplicate:

1.2.1.1. Bid Letter stating the Total Bid Price


1.2.1.2. Breakdown of work
1.2.1.3. Included/excluded items
1.2.1.4. Time Frame
1.2.1.5. Liquidated Damages

PART 2. PRICES IN THE PROPOSAL

2.1. Prices shall be written in words as well as expressed in figure in Philippine Peso.
In case of discrepancy, prices in words shall be construed as the bid price.

PART 3. CLOSING DATE OF BIDDING

3.1. Sealed proposals for the above mentioned project shall be received in the
prescribed proposal form not later than JULY 8, 2019 (MONDAY) at #3
Josephine Street, Parkway Village, Quezon City. The bids submitted shall be
opened thereafter under closed bidding procedures.

PART 4. CONTRACTED SCHEDULE

4.1. It is the duty of the bidders to specify the number of calendar days required to
satisfy the completion of the project.

4.2. The work to be done under this contract shall consist of furnishing of all labor,
materials (except those furnished by the Owner or by others) equipment,
supervision, facilities, and performing all other related works necessary for the
contract construction within the time specified in the Proposed Time Schedule
attached in strict compliance with the contract drawings, specifications and
other related documents. Bidders shall examine the site drawings,
specification schedules and all instructions. Failure to do so will be at the

bidder's that is aware of any concourse with all of the requirements or


conditions incorporated in the invitation to bid.

PART 5. FAILURE TO COMPLETE WORK ON TIME

5.1. For failure to complete the work on the stipulated Contract time, the Owner
shall charge the Contractor penalty in the form of liquidated damages
amounting to one-tenth (1/10) of one (1%) percent of the total contract
amount for the added cost incurred by the Owner for such delay and also for
the inconvenience caused the users of this utility. It is understood that this is
not penalty but is a fixed sum representing the liquidated damages for each
calendar day of delay. Delay shall be counted from the agreed completion
date considering further time extension approved by the Project Manager or
CM to the date the Owner accepted the completed work.

PART 6. ACCEPTANCES OR REJECTION OF PROPOSAL

6.1. The contract will be rewarded to the bidder whose proposal appears the most
advantageous to the owner. The owner, however, reserves the right to reject
any or all bids, without limiting of the generality of the foregoing, any proposal
which is incomplete, obscure, or irregular may be rejected; any proposal
having erasures or corrections in price sheet may be rejected; any proposal in
accompanied by an insufficient of irregular certified check may be rejected.

6.2. The owner also reserves the right to waive any defects or informality in the
proposal reserved, to disregard the proposal which is obviously unbalanced or
below that the work can be done for. The owner also reserves the right to
reject the proposal of a bidder who has previously failed to perform properly
or complete on time contracts of similar nature, or proposals bidder who is not
a position to perform the work stipulated in the proposed contract.

6.3. Where bids are not qualified by specified limitations, the owner reserves the
right of awarding all or any of the items according to its best interests, in
according with his exclusive judgment and discretion.

6.4. The acceptance of a proposal will be a notice in writing signed by of the


owner and no other act of the owner shall constitute the acceptance of
approval. The acceptance of a proposal shall bind the successful bidder to
execute the contract and to be responsible for the liquidated damages as
provided in paragraphs mentioned herein. The right and obligations provided
for in the Contract shall become effective and binding upon parties only with
its final execution.

PART 7. EXECUTION OF CONTRACT & DAMAGES FOR FAILURE TO EXECUTE

7.1. The bidder whose proposal shall be accepted will be required to appear at
the office of the Owner in person, shall appear and to execute the Contract
within ten (10) days after notice that the contract has been awarded to him
agreement affecting the acceptance of the proposal.

PART 8. PERMITS AND LICENSES

8.1. All necessary permits and licenses and charges, taxes, and fees for the lawful
prosecution of the Contract shall be obtained by the Contractor at his
expense.

PART 9. COMPREHENSIVE GENERAL LIABILITY (CARI)

9.1. The Contractor shall hold the Owner free and harmless from any claim for
injury or damages caused by third parties and for this purpose he shall secure
at his own expense a comprehensive general liability policy in the amount of
one hundred (100%) percent of the contract cost, in the name of the Owner.
This policy shall be secured from the Insurance Company accredited by the
Owner.

PART 10. PERFORMANCE BONDS AND PAYMENT GUARANTEE BONDS

10.1. The Contractor shall deliver to the Owner a Performance Bond and a
Payment Guarantee Bond one-(1) week after signing the Contract in the sum
equivalent to the amount of the payment as security for the performance by
the Contractor of its obligations herein for payment(s) of all losses or damages
which the Owner may incur as a result of the Contractor's failure to faithfully
comply with the provisions of this Contract and to protect the Owner from the
Contractor's possible failure to pay its just labor wages and cost of materials
applied in the project.

10.2. Such Performance and Payment Guarantee Bonds shall be from the
PRUDENTIAL GUARANTY AND ASSURANCE INC.

PART 11. RELEASE OF PERFORMANCE AND PAYMENT GUARANTEE BONDS

11.1. The Contractor's Performance and Payment Guarantee Bonds will be


released by the Owner after the expiration of one (1) year from the final
acceptance of the work.

PART 12. RETENTION

12.1. The Owner shall retain ten (10%) percent of the Contractor's Billings until the
expiry of the one (1) year warranty period.

PART 13. RELEASE OF RETENTION

13.1. The Owner may, upon representation by the Contractor, release said
percentages before expiry of the one (1) year warranty period, provided the
Contractor submits a guarantee bond from the FGU Insurance Corporation in
favor of the Owner for an amount equivalent to the retention to be released.
Such guarantee bond shall be enforced during the warranty period and shall
be cancelled upon advice by the Owner.

PART 14. ADDITIONAL SECURITY

14.1. The Owner reserves the right to require the contractor to submit additional
insurances/bonds a may be deemed necessary in accordance with its
exclusive judgment.
