AFFIDAVIT OF DESISTANCE

I, LHYZA GALLATE y Parento, 18 years old, single, and a resident of Barangay

Banaoang, Mangaldan, Pangasinan, after having duly sworn to in accordance with law
hereby depose and state:

1. I am the complaining witness for Frustrated Homicide against Rodel Padua Y

Posadas in the case entitled "People of the Philippines versus Rodel Padua y Posadas",
Criminal Case No. 2018-0504-D, Regional Trial Court, Branch No. 43, City of
Dagupan.

2. After my sober and soul searching assessment and analysis of the incident, I
have realized that because the incident transpired at dawn and it was dark because
there was no light in the area of incident, I cannot point out, without a doubt the
accused or any other person/s who did wrongful acts against me.

3. Since I could not state with certainty and without doubt the liability of Rodel
Padua, in fairness to him, I am permanently withdrawing my complaint against him. I
clear him of whatever responsibility or liability to me.

4. I hereby inform the Provincial Prosecutor of Dagupan City that I am

withdrawing my complaint for Frustrated Homicide in Criminal Case No. 2018-0504-
D entitled "People of the Philippines versus Rodel Padua y Posadas", Criminal Case
No. 2018-0504-D, Regional Trial Court, Branch No. 43, City of Dagupan.

5. I likewise request the Regional Trial Court, Branch No. 43, City of Dagupan to
dismiss with prejudice the said criminal case.
