COMPLAINT AFFIDAVIT

I, Sophia T. Sy, the undersigned, of legal age, single, and a resident of San

Francisco, San Isidro, Bohol, after having been duly sworn to in accordance with law,

hereby deposes and says THAT:

1. I was on a business trip in Cebu City on January 15, 2020 when I received an

information from my neighbor at on or about 6:00 in the morning that my house

had been forcibly opened and its padlock was destroyed.

2. I had strategically installed several closed-circuit television (CCTV) cameras as

part of security measures in my premises.

3. Upon arrival thereat, I discovered that my jewelry box containing a gold necklace

with a diamond pendant worth P350,000, a rolex watch valued at P420,000, and

a gold ring with diamond worth P80,000 was missing along with the other items

inside my house, such as one LG Smart TV worth P37,000, an acer aspire E5-

573T laptop valued at P37,500 and a P10,000 cash. The total value of this stolen

items was approximately P934,500. Attached hereto as “Annex A” is an Extract

Copy of the official receipts of the missing items and made as an integral part

hereof.

4. After I saw what happened to my house, I immediately went to the Police Station

of San Isidro on or about 1:00 o’clock in the afternoon to report the matter. The

original copy of the excerpt of the police blotter with Entry No. 01015 duly issued

by PLT John P. Jao is hereunto attached and made as an integral part hereof as

“Annex B” of the complaint.

5. At about 3:00 o’clock in the afternoon of January 15, 2020, police personnel of

San Isidro Police Station headed by PSMS Arthur T. Daniel conducted an

investigation in the crime scene and identified the perpetrator as one Carlito A.
Diaz, a bus driver and a resident of a neighboring barangay, through the CCTV

Camera installed in my house. Attached hereto as “Annex C” is an Extract Copy

of the CCTV images taken when the robbery took place.

6. On January 16, 2020 at about 8:00 o’clock in the morning, Savana Tan Javier

approached me upon knowing that my house was robbed on the evening of

January 14, 2020. She then told me that she saw Carlito A. Diaz went out the

gate of my premises carrying a TV and a bag on his back. Attached hereto as

Annex “D” is the affidavit of Savana Tan Javier and made an integral part

hereof.

7. That the act of Carlito A. Diaz in illegally destroying the padlock of the window

and took an entry therein and did take, steal, and carry away the above

mentioned items is a violation of paragraph (a)(1) of Article 299 of the Revised

Penal Code, pertinent provision of the law is quoted hereunder, to wit:

Article 299. Robbery In An Inhabited House Or Public Building Or

Edifice Devoted To Worship. – Any armed person who shall commit robbery

in an inhabited house or public building or edifice devoted to religious

worship, shall be punished by reclusion temporal, if the value of the property

exceed 250 pesos, and if:

(a) the malefactors shall enter the house or building in which the

robbery was committed, by any of the following means:

1. Through an opening not intended for entrance or egress

2. By breaking any wall, roof, or floor or breaking any door or

window.

3. By using any false keys, picklocks or similar tools.

4. By using any fictitious name or pretending the exercise of

public authority.

Or if –
(b) The robbery be committed under any of the following

circumstances:

1. By the breaking of doors, wardrobes, chest, or any other kind

of locked or sealed furniture or receptacle;

2. By taking such furniture or objects to be broken of forced

open outside the place of the robbery.

7. I am therefore executing this affidavit freely and voluntarily in support of my

intent to file a case for ROBBERY and/or the appropriate criminal case against

CARLITO A. DIAZ, who is 35 years of age and a resident of Purok 3, San Diego,

San Isidro, Bohol.

IN WITNESS WHEREOF, I have hereunto affixed my signature this 16th day of
