A PUBLIC school teacher is facing criminal charges in court for allegedly sexually
harassing his pupil inside the classroom in March this year.
Cebu City Assistant Prosecutor Jill Ann Gealon found evidence to charge the teacher
with violation of Republic Act 7877, or the Anti-Sexual Harassment Act.
“(Teacher’s) act of touching (his pupil’s) thigh was sufficient to constitute sexual
harassment,” read Gealon’s three-page resolution. A P60,000 bail was recommended for
the teacher’s temporary freedom.
Sun.Star Cebu is withholding the teacher’s name until he formally answers the
allegations.
Indictment
The teacher’s indictment came after he failed to submit his counter-affidavit, which
would have allowed him to dispute the charges leveled against him.The suspect teaches
Home Economics and Livelihood Education at Guadalupe Elementary School in Cebu
City. In her complaint, the 12-year-old pupil said she and some of her classmates were
directed by the respondent to go to the classroom for their failure to submit their project.
He asked the victim to submit either a rope or show him her thigh. The student told
her teacher that she preferred the rope since she would just text her mother to buy it. But
the teacher allegedly wanted to see the student’s thigh by holding and raising her skirt.
The student quickly moved away, but the suspect kept asking her to show him her thigh.
The teacher later pulled up her skirt and touched her thigh.

The student reported her ordeal to her mother and grandmother, who confronted the
teacher about the incident. Instead, the teacher turned the tables on his student and told
them that the pupil “volunteered” to show him her thigh.
In the resolution, Prosecutor Gealon said the elements of sexual harassment exist in
the complaint. The prosecutor said the student was afraid when the teacher touched her
thigh.
The Mathematics teacher of the school in the state capital has been accused of
sexually harassing girl students of Class VI and VII for the last few months.
The police have registered a case against the teacher, said Chandrasekhar police
Inspector-In-Charge Deepak Kumar Mishra.
The police registered the case based on a complaint lodged by the school authorities
after it was revealed that the allegation against the teacher was true.
The entire incident was captured by CCTV installed inside the school premises,
an official said.
As per the complaint, the teacher used to sexually harass girl students for the last
few months. Earlier, the school authorities were informed about the teacher's activities by
a girl student who hailed from Kharagpur and stayed in the hostel.
The girl narrated her ordeal before the school authorities following which the
principal checked the CCTV footages. Later, some other girls also came up with similar
allegations.
The girl students said the teacher harassed them in classrooms, libraries and while
checking their homework.
"On the basis of CCTV footage, we have lodged a complaint and urge the police to
initiate proper probe and take stringent action against him, said school Principal Rabi
Kumar.
The student council said it would not name the professor yet
so as not to compromise ongoing investigations.
Despite this, Bendaña said the student council will use its
two seats on the University Committee on Decorum and
Investigation and the University Discipline Committee “to ensure
justice for students.” The two bodies are the school’s official
investigating body and the body in charge of hearing and
deliberating cases filed among members of the Ateneo
Community, respectively.
The case comes almost two weeks after the student council
last October 3 initially called on students victimized by the
teacher to come forward with their testimonies should they be
willing to file a case.
