 Write a review on the rights and


responsibilities of teachers.
Knowledge is power. As educators we know that,
and we try to teach it. All too often though, we
don’t even know the rights we have on the Job.’

Special Rights and Privileges of a Teacher
Article XIV ( Education, Science and
Technology, Arts, Culture and Sports) of the
1987 Constitution Section 5 paragraph 5 states
that, State shall assign the highest budgetary
priority to education and ensure that teaching
will attract and retain its rightful share of the
best available talents through adequate
remuneration and other means of job
satisfaction and fulfillment.
In GAA, P631.77 billion was officially allocated to DepEd at the
bicameral level — a 6.34 percent increase from the agency's 2021 GAA
at P594.11 billion.
DepEd Allocation:
 Learning Tools and Equipment (P2.72 billion);
 DepEd Computerization Program (P11.76 billion);
 Basic Education Facilities (P5.94 billion);
 Last Mile Schools Program (P1.51 billion)
 Madrasah Education Program (P356.83 million); and
 Indigenous Peoples Education

 AN ACT TO AMEND ARTICLE ONE HUNDRED FIFTY-TWO OF THE
REVISED PENAL CODE, SO AS TO INCLUDE TEACHERS, PROFESSORS,
AND PERSONS CHARGED WITH THE SUPERVISION OF PUBLIC OR DULY
RECOGNIZED PRIVATE SCHOOLS, COLLEGES, AND UNIVERSITIES,
WITHIN THE TERM "PERSONS IN AUTHORITY”.
ART. 152. Persons in authority. — Who shall be deemed as such. — In applying the
provisions of the preceding and other articles of this Code, any person directly vested
with jurisdiction, whether as an individual or as a member of some court or
governmental corporation, board or commission, shall be deemed a person in authority.
 The Philippines state recognizes the status of teacher as professionals. In this
regard, it enacted Education Act of 1982 otherwise known as Batas Pambansa Blg.
232 or an “Act Providing for the Establishment and Maintenance of an Integrated
System of Education”
 Case No.1. Sabino, a secondary school principal, directed her three teachers
through a memorandum to decorate her house that will be used as reception for the
wedding of her daughter. However, the teacher resisted. In effect, Mrs. Santiago got
angry. Is the resistance of the teachers to the job, right? Why?

1. The right to be free from compulsory assignments not related to their duties as
defined in their appointment or employment contacts, unless compensated thereof,
conformably to exciting law.
 Case # 2 Mr. Lor made a new invention using his official time in school as he was
deloaded for one year to finish the task. When the invention was sent for patenting,
the teacher solely put the creation under his name and not the school’s. Is the act of
the teacher in order? Why?

3. Teachers shall be accorded the opportunity to choose alternative career lines in
school administration, in classroom teaching, or others, for purpose of career
development.
 Case # 3 A learner boxed his teacher after receiving a failing mark in mathematics.
The act was done in the market where two met. Can the learner claim that the act
was not disrespect of “person in authority” because the teacher was not inside the
school and was not also doing an actual professional duty? Why?
 4. Teacher shall be deemed persons in authority when in discharge of lawful
duties and responsibilities and shall, therefor, be accorded due respect and
protection

married couples to be employed in the same locality; 5) academic freedom; 6) not more
than 6 hours of actual classroom teaching; 7) additional compensation for activities outside
normal duties; 8) salaries comparable to other occupations to insure teachers a reasonable
standard of life for themselves and their families; 9) salaries appropriated by local
governments not to be less than those paid to teachers of the national government; 10) cost
of living allowance; 11) special hardship allowances; 12) medical examination free of
charge once a year during the teacher's professional life; 13) prohibition of unauthorized
deduction from teachers' salaries; 14) study leave; 15) indefinite leave; 16) salary increase
upon retirement; and 17) freedom to establish or join organization of their choice..
