, the Living Individual; the Creator of the Original “Certificate

of Live Birth” Trust known as the Joshua William Gutierrez

 1 Cestui Que Trust. The Living Individual known as Living

2 :Joshua William Gutierrez is also to be referred to as the

3 Trustor/Trustee of the Joshua William Gutierrez Cestui Que Trust

4 and as such has the Right to hereby declare the following actions

5 be EXECUTED.

7 First Part:

8 The Second Trust which was setup from the Joshua William

9 Gutierrez Cestui Que Trust under Constructive Fraud and is known

10 as the JOSHUA WILLIAM GUTIERREZ Social Security Trust, with the

11 Federal corporation being the Trustee and the Living individual,

12 Living :Joshua William Gutierrez was to be the Beneficiary.

13 Created by and as the Settler/Grantor of the initial funding

14 from assets came from the Joshua William Gutierrez Cestui Que

15 Trust, under the direction of the soon to be the Trustees, the

16 Federal Government Corporation, formed the JOSHUA WILLIAM

17 GUTIERREZ Social Security Trust.

18 The JOSHUA WILLIAM GUTIERREZ Social Security Trust contract was

19 never properly ratified only implied, proper considerations were

20 never given, under SUPPRESSIO VERI the truth has been held in

21 Concealment, and under SUGGESTIO FALSI the Trustees have made

22 numerous statements of falsehoods about this Social Security Trust

23 for their OWN UNJUST gain.

24 The Living individual, Living :Joshua William Gutierrez has

25 been a Sub-Funder of labor value into the JOSHUA WILLIAM

26 GUTIERREZ Social Security Trust account and at the same time is

 1 the named Beneficiary but only after the age of 65, thereby being

2 prevented from having Lawful access to full labor funds.

3 The Living individual, Living :Joshua William Gutierrez is

4 hereby rejecting and terminating the Beneficiary part of the

5 JOSHUA WILLIAM GUTIERREZ Social Security Trust, therefore there is

6 no longer a need for this Trust to be in existence.

7 It is hereby requested by the real Trustor/Settlor, that the

8 Iowa State 8th District Chief Judge should also operate as the

9 Protector of the Court and for the JOSHUA WILLIAM GUTIERREZ

10 Social Security Trust liquidation and the return of all required

11 assets to the Joshua William Gutierrez Cestui Que Trust. It is

12 also required that the assets, labor value that was deposited

13 into the JOSHUA WILLIAM GUTIERREZ Social Security Trust – banking

14 system and then held in the Trust account – it is approximately

15 eighteen million dollars in value, of the Living Individual

16 Living :Joshua William Gutierrez by Right are to be returned

17 under ACTIO DEPOSITI DIRECTA.

19 Second Part:

20 The Living individual, Living :Joshua William Gutierrez was

21 the Creator of the Original “Certificate of Live Birth” Trust

22 known as the Joshua William Gutierrez Cestui Que Trust and that

23 the US Bankruptcy Trustees were the Grantor/Settlor of the Trust.

24 The Trust was setup as follows; the Trustor/Trustee is the Living

25 individual, Living :Joshua William Gutierrez and the

26 Federal/State corporations were to be the Beneficiaries.

 1 The requirements of the Joshua William Gutierrez Cestui Que

2 Trust have been fulfilled and the Trust is to be Executed;

3 1. First requirement was the initial time of 18 years as

4 required by the US Bankruptcy Trustees, as the

5 Grantor/Settlor of the Trust. That being completed the next

6 point would be in that the maximum life of a Cestui Qui

7 Trust is limited to 25 years and with no contract renewal

8 and is now operating only on the fact that no one has

9 contested its operation.

10 2. Second requirement falls under the completion of a citizen’s

11 obligation to the defense of the country. This has been met

12 by the filing of the Selective Service Form and/or the

13 completed DD-214 government military form.

14 3. Third requirement is the Living individual, Livin :Joshua

15 William Gutierrez has also under civil law obtained FULL

16 AGE, twenty-five years old as being of the Age of Legal

17 Majority.

18 With the Fulfillment of the above requirements it is also

19 NOTED that the Living individual, Livin :Joshua William Gutierrez

20 has the Free and Clear Title to the property known as the earthly

21 Living Body. NOTE: At this point in time, the Living individual,

22 Living :Joshua William Gutierrez is now to be classified as a

23 Full De Jure State Citizen and is not under the requirements of

24 the Statutory Laws. There can be and is no justifiable Equitable

25 Title claim by any of the Beneficiaries of the Joshua William

26 Gutierrez Cestui Que Trust, because the obligation has been

 1 fulfilled. Therefore, the Trustor/Trustee is hereby terminating

2 the Beneficiaries of the Joshua William Gutierrez Cestui Que

3 Trust and taking control of the Equitable Title.

4 It is a hard and fast rule that in Trust Law the Trustees

5 can’t enjoy the benefits of the Trust property, nor can the

6 beneficiaries exercise any real control (owner-ship) over the

7 Trust property. Whenever a single individual holds both the Legal

8 Title and the Equitable Title to Trust Property, the “Sub-Titles”

9 are once again unified into a single “Perfect” Title, the Trust

10 is said to be “Executed” and Ceases to Exist. So when the

11 Beneficiaries have been terminated, both Titles will have been

12 unified into a single “Perfect” Title.

13 At this point the Trustor/Trustee has determined to have all

14 of the Assets of the Joshua William Gutierrez Cestui Que Trust

15 transferred into a new Express Trust under the name Joshua

16 William Gutierrez Trust.

17 This has also been documented to the IRS through the filling

18 of IRS forms 966 on both Trust. All assets (being stocks,

19 physical or monetary) remaining in the Trust after settlement of

20 the accounts are be transferred to the direct control of the

21 Living individual, Living :Joshua William Gutierrez, as the

22 Creator/Trustor.

This Order is based on the facts of sound law and is also

under the conclusive presumption of law.

Therefore, the ORDER is hereby given and concurred with the
 1 District Court Chief Judge. That the District Court Chief Judge is to

2 have the court contact all of the required parties from both Trusts to

3 meet with Living :Joshua William Gutierrez, Trustor/Trustee and

4 start the Liquidation/Settlement process of these Two Trust matters

5 within the next 3 days.
