Legal Ethics; Four-fold duty; Lawyers are expected to maintain at all times a high standard of
legal proficiency and morality, including honesty integrity and fair dealing. They must perform a
four-fold duty to society, the legal profession, the courts and their clients, in accordance with the
values and norms of the legal profession.
Same; Lawyer’s Oath; The Lawyer's Oath enjoins every lawyer, not just to obey the laws of the
land, but also to refrain from doing any falsehood in or out of court or from consenting to the
doing of any in court, and to conduct himself according to the best of his knowledge and
discretion with all good fidelity to the courts, as well as to his clients.
Same; Code of Professional Responsibility; The Code provides that a lawyer shall not, in his
professional dealings, use language that is abusive, offensive or otherwise improper. Lawyers
are instructed to be gracious and must use such words as may be properly addressed by one
gentleman to another.

Respondent Atty. Hernando P. Cortes is found GUILTY of violation of Canon 20 of the Code of
Professional Responsibility and is hereby SUSPENDED from the practice of law for three (3) months,
(considering that Atty. Cortes is nearing ninety years old and that there was no question that Atty.
Cortes was able to get a favorable outcome) and is ordered to return to complainant Eugenio E. Cortez
the amount he received in excess of the 12% allowable attorney’s fees.
