LEGAL NOTICE Date- 21/09/2016

Subject- Dishonour of Cheque bearing No. 123456, drawn on ABC Bank, at Lohagaon
branch, dated 21/08/2016 amounting 37,50,000/-.

Sir,

I, the undersigned, has been instructed upon by my client Mr. Sandesh, to send you this notice
which you may take the note of,

1. My client Mr. Sandesh says that he is a manufacturer and seller of high-end sport bicycles
having manufacturing unit at, A-105, at plot no. 20, survey no. 35 at village Lohagaon Pune.
2. My client said that M/S Sanket Sports Pvt. Ltd. ,the withdrawer having shop at ‘Asiana’,
Swargate, Pune is a reseller of the high-end bicycles manufactured by Mr. Sandesh.
3. According to my client M/S Sanket Sports Pvt. ltd. placed an order of 500 bicycles worth Rs.
10,000 each which were delivered as per the date agreed. M/s Sanket Sports Pvt. Ltd. paid 25%
that is Rs 12,50,000 in advance of the total amount and balance was to be paid within a week’s
time on delivery of the bicycles on 20/08/2016.
 4. My client says that,after that accordingly cheque for balance amount i.e., 37,50,000 was issued
by M/S Sanket Sports Pvt. Ltd. on 21/08/2016 in the name of Mr. Sandesh.
5. The cheque bearing no. 123456 drawn on ABC bank at branch Lohagaon Pune dated 21/08/2016
was presented by Mr. Sandesh on 12/09/2016, the same was dishonored by his ECB bank on
14/09/2016 and a written memo of dishonor of cheque was received from ECB bank to Mr.
Sandesh on 17/09/2016 stating that “cheque dishonored due to insufficient funds”.

Failing to comply with this notice within 15 days after the receiving of the notice, after the receiving of
the notice, after the receipt, my client shall be force to initiate to take a appropriate action, complaining
to section 138, or any other civil or criminal action or remedy, of which you may take note of.

The cost of this notice of amount of Rs. 1500 shall be born by you.

REPLY TO THE NOTICE Date-30/09/2016

Subject- Notice (21/08/2016) regarding dishonour of cheque baring no.123456.

Dear Sir,

I am instructed upon by my client and entrusted with your notice date 21/09/2016 which
my client received on 26/09/2015, which my client has received on Monday. Reply on behalf of my
client of here above mention notice is as follows.

1. My client denies contains and the allegation made by you in your notice, unless specifically
accepted by my client on this notice
2. My client, M/s. Sanket Sports Pvt. Ltd. having shop at ‘Asiana’, Swargate, Pune is a reseller
of the high-end bicycles manufactured by Mr. Sandesh.

3. According to my client, M/s Sanket Sports Pvt. Ltd. returned 50 defective bicycles to Mr. Sandesh
and requested Mr. Sandesh not to deposit the cheque bearing no 123456 for presentment over
telephone which was acknowledged positively.

4. M y client says that, he issued a fresh cheque bearing no. 123457 dated 25/09/2016 pertaining to
the balance amount for total order of 450 bicycles i.e cheque of amount of Rs. 32,50,000. Based on
communication, my client said that he does not owe you Rs. 37,50,000 and the cheque need to be
return to my client or destruct it.
5. My client has already issued a check to you baring no. 123457 dated 25/09/2016 from a ABC bank
for an amount of balance amount 32,50,000/- , which your client was asked to deposit and in cash.
But the same does not appears to have been complied.

6. With the given circumstances my client warns you not to filed for any false and fraudulent
complaint and in case your client initiates any false and fraudulent complaint from your client against
my client, your client alone will be responsible for the all cause and legal expenses which may be
incurred by my client in legally defending such case or complaint.
