FACTS

The application is under section 14 read with section 18 of the National Green Tribunal Act
2010. It is in regard of seeking permission of carry out mining operation in mining lease area
i.e. Khasara No 69 falling in mauza & Mohal Majri Paharuwala, Paonta Sahib , district
Sirmour, Himachal Pradesh measuring 49-6 Bighas ( 4.08 hectors). The Respondent No 3
has granted the Environment Clearance for the purpose foresaid mining. According to the
applicant all the direction by pollution Control board and Hon’ble Tribunal has been
followed. ‘Letter of intent’ has been issued by state of Himachal Pradesh and environment
Clearance by SEIAA and consent of establish and consent to operate has been granted by
the Himachal Pradesh pollution control Board. No Citizen or cattle nearby are affected.
According to the Tribunal the Himachal Pradesh pollution Control Board to consider the
application of the applicant of the consent to operate in accordance with law expeditiously
and after due inspection. The consent to operate, if granted, along with the inspection report
shall be laced before the Tribunal and the unit will be permitted to operate only subject to the
order of the Tribunal. The mining lease area is located near Yamuna River.

PRAYER

The applicant has fulfilled all the requirements and EC has been received by him. So, Since
all the orders has been followed. The applicant wants permission of carry out mining
operation in mining lease area mentioned above.
