1 OBJECTIVE
Establish the criteria for the conformity assessment program for electrical and electronic equipment for explosive atmospheres in the
conditions of flammable gases and vapours and combustible dust, focusing on security, through the certification mechanism, meeting
the requirements of the technical standards set out in Chapter 2 in this RAC in order to provide greater security for the user and for the
facilities.

4.4 Maintenance test
Tests to prove that the product is the subject of conformity assessment following the issue of the certificate of conformity shall remain in
conformity with the regulatory requirements set out in this requirement.
4.5 Routine test
Test to which is submitted each unit manufactured, during or after manufacture, to verify that it meets the conditions specified in the
standards defined in chapter 2 of this Requirement.
4.6 Electrical equipment for explosive atmospheres
Electrical equipment so constructed as not to cause, under specific conditions, the ignition of the explosive atmosphere around it.
4.7 Family
Set of products that have the same basic characteristics, in relation to the types of protection applied in the equipment.
4.8 Accredited Laboratory
Public, private or mixed entity of third party, accredited (competent recognized) by Inmetro according to the criteria established by it,
based on principles and policies adopted under SBAC.
4.9 Batch
Set of equipment or devices with identical characteristics, belonging to the same model, series or type (the least collective of the three),
produced by the same manufacturer in the same plant at a given time, duly identified.
4.10 Descriptive memorial
Document provided by the applicant containing the description of the constructive characteristics of the electrical equipment for
explosive atmospheres, informing the type(s) of protection, including indicating the model or type and the series.
4.11 Model or type
Designation given by the applicant that differentiates products from the same family.
4.12 Product Certification Body – OCP
Public, private or mixed third party entity accredited by Inmetro, in accordance with the criteria established by it, to carry out product
conformity assessment services, based on the principles and policies adopted, within SBAC.
4.13 Supervisory body
Entity of public law, with legal powers to supervise compliance with the conformity assessment, according to an agreement signed with
Inmetro.
4.14 Conformity Assessment Requirement – RAC
Document that contains specific rules and establishes systemic treatment for the conformity assessment of products, processes, services,
persons or quality management systems in order to provide an appropriate degree of confidence in relation to the requirements set out
in the standard or the technical requirement.

4.15 Conformity identification seal
Graphic representation to be affixed to the equipment and that aims to identify objects with evaluated, compulsory or voluntary
conformity, within the SBAC, according to Annex C.
4.16 Series
Designation given by the applicant that identifies the model version.
4.17 Process Modular Unit - skid Mounted
Unit preassembled in chassis and pre-tested, consisting of the main equipment and its peripheral accessories, such as instruments, filters
and valves, forming a complete assembly, which will be interconnected in the field to its respective system.
4.18 Applicant
Individual or legal entity, public or private, national or foreign, legally established in the country that carries out one of the following
activities: production, assembly, creation, construction, transformation, importation, free distribution or not, or commercialization of
electrical equipment for explosive atmospheres, covered by this Requirement.
Note: In the case of applicants residing abroad, without being legally established in the country, the responsibilities of Chapter 10 are the
legal representative for commercial purposes in the country, importer or the user himself who must be duly notified for such
responsibilities.
5 CONFORMITY ASSESSMENT MECHANISM
5.1 The conformity assessment mechanism used in electrical equipment for explosive atmospheres, in the conditions of flammable gases
and vapours and combustible dust, contemplated by this RAC, is compulsory certification.
5.2 Certification of electrical equipment is performed for equipment that will be installed in locations classified as Zone 0, Zone 1, Zone
2, Zone 20, Zone 21 and Zone 22.
5.2.1 Can be installed in Zone 2, as established by the user, electrical equipment that has been designed according to an industrial
standard and that in normal operation:
a) do not present hot surfaces capable of causing ignition of an explosive atmosphere;
b) in normal operation do not produce arcs or sparks; and
c) are mounted in a housing having adequate degree of protection and mechanical strength to a non-hazardous area with equivalent
environmental conditions.
Note: These devices are not marked for hazardous areas, but should be clearly identified in the documentation of the equipment the
meet the above requirements.

b) Batch Test Model
In this model, it is submitted to tests on samples taken from a product manufacturing batch, which can be imported or not, and an
evaluation of their conformity to a given specification is issued from the results. There is no evaluation of maintenance of the
certification.
c) Model Special Situations for Imported Products
New model that consists of documentary technical evaluation and inspection of OCP, which the body must make sure that the products
are in accordance with the documentation analysed. In this model, there is no evaluation of maintenance of the certification.
5.4 It is the responsibility of the applicant to formalize with OCP the model that should be used for the certification of their equipment
contemplated by this RAC.
5.5 The stages of the conformity assessment process, described in Chapter 6, should be conducted by the OCP.
6 STEPS OF CONFORMITY ASSESSMENT PROCESS
This Chapter establishes the conformity assessment process for granting and maintaining authorization for use of the Conformity
Identification Seal.
6.1 Model with Evaluation of the Quality Management System of the Product Production Process and Product Testing
6.1.1 Initial Assessment
6.1.1.1 Process Start Request
The applicant must submit a formal request to the OCP, which must include the name and the characteristic of the product to be
certified.
6.1.1.2 Analysis of the Request and Documentation
6.1.1.2.1 The OCP, before starting the certification service, should analyse the relevance of the request. If the certification request is
considered impracticable, the OCP must formally communicate to the requestor the reason for the non-availability of the service and
return all documentation submitted.
6.1.1.2.2 During the assessment process the OCP will assessment the product's technical documentation and the manufacturer's QMS, the
descriptive memorial and installation manual and safe use.
Note: The manual of installation and safe use to be delivered in the certification process must be written in Portuguese and in the
version to be made available to the end user. This manual must accompany the supply.

6.1.1.3 Initial Testing
The tests should be performed and recorded, taking the following steps.
6.1.1.3.1 Definitions of the Tests to be performed
6.1.1.3.1.1 Type tests shall be performed on the product in accordance with the applicable technical standards, listed in item 2 of this
RAC, on samples collected by the OCP or sent by the applicant, as established in item 6.1.1.3.3.
6.1.1.3.1.2 The type tests shall be carried out on the sample and in the event of failure of the sample, the product shall be deemed to
have been rejected. The test plan (as well as its sequence) must be prepared and reported to the laboratory by the OCP.
6.1.1.3.1.3 The type tests performed shall be reported by the laboratory to the OCP.
6.1.1.3.1.4 The test reports for the product shall be accepted, provided that the tests performed meet the requirements of the standards
in force in this RAC.
6.1.1.3.2 Definition of the Laboratory
It is up to the OCP to select the laboratory to be contracted for the type tests related to the product certification process, as established
in Chapter 12 of this RAC.
6.1.1.3.3 Definition of Sampling
6.1.1.3.3.1 The OCP shall use, in the conformity assessment process, representative samples of the make/model or family of the product.
6.1.1.4 Initial Audit
After demonstrating compliance with items 6.1.1.2 and 6.1.1.3 of this RAC, the OCP, in agreement with the applicant, shall schedule the
realization of the manufacturer's QMS audit.
6.1.1.4.1 The presentation of a quality management system certificate issued under the SBAC, taking into account the agreements of
mutual recognition (MRA) recognized by Inmetro and having as a reference the ABNT NBR ISO 9001:2008 and being this certification
valid for the production plant of the product, object of the request, this certification must be accepted by the OCP. In this case, the
holder of the certificate shall provide OCP with all the records resulting from this certification. The following conditions must be
observed:
a) The factory QMS certification shall cover the production plant of the product to be certified;
b) The applicant for product certification shall provide the OCP, for assessment, with a copy of the reports of the quality system audits
issued by the OCS, including records of corrective actions implemented.
6.1.1.4.2 An audit should be carried out by OCP which covers the additional technical requirements set out in Annex B and does not
exempt the type tests and product evaluation provided for in this RAC. The OCP may, at its discretion, accept audit reports from other
OCP that cover the manufacture of equipment with the same types of protection.

b) Handling of the complaint;

6.1.1.4.3 If the manufacturer does not have his QMS certified under the SBAC, the OCP shall perform the audit in accordance with the
requirements set out in Annexes A and B of this RAC.
6.1.1.4.4 The OCP presents to the Certification Commission the entire certification process, without exception, for appraisal of
certification, after fulfilling all the requirements required in this RAC.
6.1.1.4.5 The opinion of the Certification Commission does not exempt the OCP from responsibilities in the certificates granted.
6.1.1.5 Issuance of Certificate of Conformity
This step must be performed after fulfilling all the requirements required in this RAC.
6.1.1.5.1 The certificate should only be granted to the applicant who has in your process all nonconformities eliminated.
6.1.1.5.2 If the product complies, the OCP shall formalize the granting of the authorization for use of the Conformity Identification Seal,
for a period of 3 years, as set forth in Chapter 9, for the product(s) that meets the established criteria in this RAC.
6.1.1.5.3 The OCP presents to the Certification Commission the entire certification process, without exception, after fulfilling all the
requirements required in this RAC.
6.1.1.5.4 The decision of the Certification Commission does not exempt the OCP from responsibilities in the certifications granted.
6.1.1.5.5 The certificate must contain the following information:
a) Corporate name, CNPJ and full address, of the manufacturer, the importer, and the applicant, and a fancy name where applicable;
b) Complete OCP data (name, accreditation number and signature);
c) Identification of the chosen certification model, the model with the assessment of the Quality Management System of the product
production process and product tests, batch test model, or model for special situations for imported products;
d) A basic description of the product and the types of protection applied;
e) Special conditions of safe use, when applicable;
f) Date of issue and date of validity of the certification;
g) Original issue date (first concession) and review date, when applicable;
h) The number of the certificate of conformity of origin, where applicable;
i) Number of the OCP evaluation report with the date of issue, which shall include the identification of the test laboratory(s) and the test
report(s) with the date of issue;
j) List of certification documents;
k) Complete marking in accordance with the relevant standard;

l) The observation:
"Products must be installed in compliance with the relevant Standards in Electrical Installations in Explosive Atmospheres";
m) Standardized note, where applicable, as follows:
"The installation, inspection, maintenance, repair, overhaul, and recovery of the equipment are the responsibility of the users and must be
performed in accordance with the requirements of the current technical standards and with the manufacturer's recommendations."; and
n) Other observations concerning the application of the product at the discretion of the OCP.
o) "The format of the certificate number shall be in accordance with the paragraph "d" of item 29.2 of ABNT NBR IEC 60079-0 - General
Requirements, including the use of the point." (NR) (Included by Ordinance INMETRO/MDIC number 89 of February 23, 2012).
Note: The certificate may consist of several pages and should not contain attachments, such as extracts from test reports containing
important details for the user, such as restrictions, special considerations regarding the application of the product, etc.
6.1.2 Maintenance Assessment
Maintenance of certification is carried out to verify, through periodic evaluations, whether the conditions that gave rise to the initial
granting of the authorization for the use of the conformity identification seal are being maintained. The realization of conformity
assessment services for maintenance is the sole responsibility of OCP.
6.1.2.1 Planning of the Maintenance Assessment
The certification maintenance process must be carried out every 18 months, in accordance with the requirements established in Annexes
A and B of this RAC.
6.1.2.1.1 Provided there is evidence to justify them, OCP can perform extraordinary audits without the need to be announced.
6.1.2.2 Maintenance Testing
These tests should be performed and recorded, taking the following steps:
6.1.2.2.1 Definition of Tests to be performed
6.1.2.2.1.1 The tests shall be carried out on the product that has been found to be non-conforming during the maintenance audit
according to item 6.1.2.3, or that has undergone changes that modify the original characteristics or for a formal complaint by the user,
upon evaluation of the OCP.
6.1.2.2.1.2 The required tests are defined by the OCP according to the assessment carried out, according to 6.1.2.2.1.1.
6.1.2.2.2 Definition of the Laboratory
It is up to the OCP to select the laboratory to be contracted to carry out the tests related to the maintenance process of the product
certification, as established in item 12 of this RAC.

6.1.2.2.3 Maintenance Sampling Definition
6.1.2.2.3.1 The OCP shall use in the conformity assessment process representative and expressive sampling for each type of protection of
the assessed product.
6.1.2.2.3.2 Sample collection may be carried out at the production plant, provided that the product has already been inspected and
released by the quality control of the factory, or in the shipping area, in packaging ready for commercialization.

6.1.2.3.1 The OCP shall ensure that the applicant (manufacturer) maintains its controlled production process in order to avoid deviations
that could compromise the conformity of the final product.
6.1.2.3.2 If the manufacturer has its QMS certified, the OCP shall proceed as defined in items 6.1.1.4.1 and 6.1.1.4.2.
6.1.2.3.3 If there is any nonconformity in the process of maintenance of the certification, this may cause the suspension or cancellation of

6.1.2.4.3 The decision not to grant the maintenance of the certification entails the immediate suspension of the certificate and,
consequently, the de-authorization to use the Conformity Identification Seal for the reproved product, and may take other actions, such
as the withdrawal of the same from the market and/or recall.
6.2 Model with batch test
6.2.1 Initial Assessment
For this model, the authorization to use the conformity identification seal is only linked to the assessed manufacturing and/or
importation lot, not allowing any process for the maintenance of said authorization.
6.2.1.1 Process Start Request
6.2.1.1.1 The applicant must submit a formal request to the OCP, which must include the name and the characteristic of the product to
be certified.
6.2.1.1.2 In the case of fractional lots, sample collection and the certification should only be performed after receipt of all subsequent
fractions of the lot.
6.2.1.1.3 The OCP must, in the case of a foreign applicant, confirm in the import documentation the identification of the lot object of the
request and, in the case of a national applicant, analyse the procedure for identifying the lot object of the request.
6.2.1.2 Analysis of the Request and Documentation
The OCP, before starting the certification service, should analyse the relevance of the request. If the certification request is considered
impracticable, the OCP must formally communicate to the requestor the reason for the non-availability of the service and return all
documentation submitted.
6.2.1.3 Initial testing
The tests shall be performed and recorded, taking the following steps:
6.2.1.3.1 Definitions of the Tests to be performed
6.2.1.3.1.1 The test shall be performed on samples as specified in item 6.2.1.3.3. The OCP shall inform the applicant of the number of
samples for the performance of all the tests required by the standard, informing the quantity submitted for destructive tests. The entire
lot must be rejected if there is a failure in any requirement tested according to the type tests.
6.2.1.3.1.2 If the sample (s) collected for the type test is approved, the remainder of the batch shall be submitted to routine tests in
accordance with the relevant standard. Every piece that is unsuccessful in the routine test should be excluded from the batch.
6.2.1.3.1.3 The batches that make use of components certified under SBAC do not require type tests on their components.
6.2.1.3.2 Definition of the Laboratory
It is up to the OCP to select the laboratory to be contracted to carry out the tests related to the product certification process as
established in Chapter 12 of this RAC.

6.2.1.3.3 Definition of Sampling
6.2.1.3.3.1 The OCP or even the applicant must forward the sample (s) for the type tests. Tests shall be carried out on a sampling of 6%
of the lot, with a minimum of one unit.

6.3.2.2 Analysis of the Request and Documentation
The OCP should analyse the relevance of the request. If the request for the certification is considered impracticable, the OCP must
formally communicate to the requestor the reason for the non-availability of the service and return all documentation presented.
6.3.2.2.1 The certificate may be issued only if met, concomitantly, the following conditions:
a) A certificate of conformity of the products for use in explosive atmospheres or another equivalent document in the country of origin
issued by a third party and valid for the complete equipment shall be presented.
b) Data contained in equivalent certificates issued by foreign bodies shall contain at least the information: type of protection, subgroup,
temperature class and reference standards.
c) The production plant of the product, the object of the request, must have a valid Quality Management System certificate or be
replaced by a monitoring report of the foreign certification body of the product.
d) Be presented tax invoice of the entrance of imported products and will not exceed a total of 20 units, except in case of item
description of the modular process unit and subject to the conditions established in this RAC.

6.4 Treatment of Deviations in the Conformity Assessment Process
6.4.1 Treatment of Non-Conformities in the Initial Assessment Process
If the product fails the tests, the applicant must implement corrective actions in your process, prior to the performance of new tests.
6.4.2 Treatment of Non-Conformities in the Maintenance Process
The product failing in the laboratory maintenance tests defined by the OCP and that is in the possession of the applicant and cannot be
repaired must be rendered unusable by the OCP. The records shall be made available to the OCP for an analysis of the extent of such
disapproval. Authorization to use the Compliance Identification Seal on the failed model must be suspended until the applicant

6.4.3 Treatment of Distributed and Marketed Non-Conforming Products
In the event of distributed and marketed nonconforming products, and depending on the degree of risk associated with the
nonconformity, the OCP should consider the option of substitution of the product, with the applicant being responsible for this action.
Nonconforming products must be destroyed, if they are not a product that can be repaired, with OCP monitoring.
Note: Products with repairs, before being reused, must be reassessed in order to ensure compliance with the safety requirements
established in this RAC.
7 HANDLING COMPLAINTS
The applicant shall keep records of all claims or deficiencies brought to his knowledge regarding the product covered by the
authorization to use the Conformity Identification Seal, as well as the appropriate actions taken to meet the certification requirements,
making them available to the OCP, when solicited.
7.1 A Policy for the Handling of Complaints, signed by the legal representative, giving evidence that the applicant:
a) It values and gives effective treatment to the complaints presented by its clients;
b) Knows and undertakes to comply with and be subject to the penalties provided for in the laws (Law no. 8078/1990, Law no.
9933/1999, or others.);
c) It stimulates and analyses the results, as well as takes the necessary measures, according to the statistics of the complaints received;
d) Define responsibilities regarding the handling of complaints;
e) It undertakes to respond to Inmetro any complaint that it has received and within the period established by it.

7.2 A person or team formally designated, properly trained and with the freedom to handle complaints.
7.3 Development of training program for the person or team responsible for the handling of complaints, as well as for the others
involved, contemplating at least the following topics:
a) RACs and standards applicable to the product, process, service, people or quality management system;
b) Understanding Laws No. 8,078, of September 11, 1990, which provides for the protection of the consumer and provides other
measures; and No. 9,933 of December 20, 1999, which provides for the powers of Conmetro and Inmetro, establishes the rate of
metrological services, and provides other measures;
c) Notions of interpersonal relationship;
d) Policy for the Treatment of Complaints;
e) Complaint handling procedure.
7.4 When relevant, individual and easily accessible facilities by customers wishing to file complaints, as well as indicative signs and posted
posters encouraging complaints and reporting on how and where to complain.
7.5 Procedure for Handling Complaints, which should include a simple form for recording the complaint by the customer, as well as
tracking, investigation, response, resolution, and closing of the complaint.
7.6 Adequate records of each of the complaints presented and treated.
7.7 A map that allows you to view with ease the situation (e.g. in the analysis, progress, current situation, solved, or others) of each of
the complaints presented by clients in the last 18 months.
7.8 Statistics showing the number of complaints made in the last 18 months and the average resolution time.
7.9 Conduct a biannual critical analysis of the statistics of complaints received and evidence of the implementation of the corresponding
corrective actions, as well as the opportunities for improvement.
8 CONFORMITY IDENTIFICATION SEAL
The conformity identification in the scope of the SBAC indicates that the products contemplated in this Ordinance are in accordance with
the provisions of Ordinance Inmetro nº 179/2009 and in accordance with the requirements and with the mechanism of conformity
assessment established in this RAC.
8.1 Use of the Seal
The Conformity Identification Seal shall be placed on all electrical equipment for certified explosive atmospheres, in a visible form
permanently and indelibly affixed, as established in Annex C of this RAC.

8.2 Specification
The Compliance Identification Seal must meet the requirements of this RAC, especially Annex C, and it will be the responsibility of the
authorized applicant, and the Inmetro may at any time and at any time request a sample of the seals made to verify compliance with
them.
8.3 Traceability
The authorized applicant must implement a control for the traceability of the products bearing the Conformity Identification Seal, and
this control must be available to Inmetro for at least five years from the commercialization. The OCP should verify the implementation of
this control, as well as the effectiveness of the traceability of these certified products.
9 AUTHORIZATION TO USE OF THE CONFORMITY IDENTIFICATION SEAL

9.2 Authorization Granting
9.2.1 The granting of authorization to use the Conformity Identification Seal is conditioned to the absence of non-conformity with the
initial assessment process, as defined in sub-items 6.1.1, 6.2.1, 6.3.1 and 6.4.1 of this RAC.
9.3 Authorization maintenance
9.3.1 Maintenance of the authorization to use the Conformity Identification Seal is conditioned to the absence of non-conformity with
the maintenance assessment process, as defined in sub-items 6.1.2 and 6.4.2 of this RAC.
9.4 Suspension or cancellation of the authorization
The suspension or cancellation of the authorization for use of the conformity identification seal occurs when not attended any of the
requirements established in this RAC.

10 RESPONSIBILITIES AND OBLIGATIONS
10.1 For the authorized applicant:
a) Maintain the technical-organizational conditions that served as the basis for obtaining the authorization to use the conformity
identification seal;
b) Comply with all the conditions established in this Ordinance, in the legal provisions and in the contractual provisions regarding
certification, regardless of its transcription;
c) Report any changes in its structure that imply changes in the product with the evaluated conformity, as well as submit to the analysis
and approval of the OCP of any modification made before its commercialization;
d) Immediately notify the interruption of the manufacture, importation or commercialization of the certified product;
e) To assume directly with the technical, civil and penal responsibilities, according to the current legislation, regarding the product that it
commercializes, as well as to all the documents provided for the conformity assessment;
f) To comply with the pertinent decisions to certification made by the OCP, appealing in the first instance to the OCP and in the second
instance to Inmetro, in cases of complaints and appeals;
g) If the authorized applicant is not the manufacturer, it must ensure that the conformity identification is applied, preferably at the
factory, to all certified products, according to the criteria established in this RAC;
h) To comply with all the conditions established in the respective technical standards related in Chapter 2 of this RAC, in the legal
provisions and in the contractual provisions regarding authorization, regardless of its transcription;
i) Provide the OCP or its contractor, upon proof of this condition, the audit and monitoring works, as well as the performance of tests
and other certification activities provided for in this RAC;
j) When the manufacture and/or importation, and the commercialization of the products for which it has authorized the Use of the Seal
of Conformity, cease definitively, the authorized applicant shall inform the OCP immediately, which in turn shall notify this to Inmetro. In
this case, the OCP shall schedule an extraordinary audit to verify the records of the following requirements:
- When the last production lot was manufactured and in what quantity;
- Material available in stock for new productions;
- The quantity of finished product in stock and what the forecast for this lot to be consumed;
- Whether the requirements laid down in this RAC have been fulfilled since the last monitoring audit.
k) Meet the other legal requirements regarding the certified product.
10.2 For the OCP:
a) Implement the conformity assessment program in accordance with the requirements established in the Conformity Assessment RAC,
deciding the doubts with Inmetro;
b) Use a database system provided by Inmetro to maintain updated information about certified products;
c) Immediately notify Inmetro, in case of suspension, extension, reduction and cancellation of certification, through the database system
provided by Inmetro;
d) To comply with any penalties imposed by Inmetro;
e) To pass on to the authorized applicant the requirements established by Inmetro that impact them;
f) Be responsible for the selection and contracting of third parties, such as an accredited third party laboratory, inspection body,
personnel competent to evaluate the product and factory.
g) In cases where the marking is not carried out at the place of manufacture, the OCP must also carry out an audit at the place of
marking.

11 PENALTIES
Failure to comply with the requirements covered in this RAC will result in the application of the penalties provided for in article 8 of Law
No. 9933 of December 20, 1999.
12 USE OF TEST LABORATORY
12.1 The OCP, accredited by Inmetro, and that use test laboratories, the rule for selection of these laboratories is the use of a laboratory
accredited by Inmetro, for the scope provided in this RAC.

12.2 Exceptionally and precariously, provided that conditioned to an assessment by the OCP, you can use a laboratory not accredited for
the specific scope, when configured one of the hypotheses described below:
a) When there is no Inmetro accredited laboratory for the scope of the conformity assessment program.
b) When there is only one laboratory accredited by Inmetro, and OCP, evidence that the price of analyzes of the laboratory not

12.4 The reasons that led the OCP to select the laboratory, considering the possibilities described in sub-items 12.2 and 12.3, must be
duly registered by the OCP, through supporting documents
12.5 For tests carried out by foreign laboratories on products already certified in the country of origin, the equivalence of the test
method and the sampling methodology established shall be observed. In addition, these laboratories must be accredited by Inmetro or
by an Accreditation Body that is a signatory to one of the following mutual recognition agreements, which Inmetro is a part of:
a) Interamerican Accreditation Cooperation – IAAC
b) European Cooperation for Accreditation – EA
c) International Laboratory Accreditation Cooperation – ILAC
Notes: 1) The list of accredited laboratories can be obtained by consulting the website of Inmetro, www.inmetro.gov.br, of the
cooperations and the signatory bodies of these agreements;

13 ACTIVITIES CARRIED OUT BY OCP FOREIGN
13.1 Conformity assessment activities carried out by a foreign body may be accepted provided that all the following conditions are met:
a) The Brazilian Product Certification Body (OCP) accredited by Inmetro must have a Memorandum of Understanding (MOU) with the
foreign body;
b) The foreign body must be accredited by the same international rules adopted by Inmetro for the same scope or equivalents;
c) The activities carried out by a body abroad must be equivalent to those regulated by Inmetro;
d) d) The body accredited by Inmetro must issue the authorization to use the Conformity Identification Seal to the Brazilian regulations
and must assume all responsibilities for the activities carried out by the organization abroad and as a result of this issue, as if it had
conducted all the activities;
e) The Brazilian OCP, accredited by Inmetro, should be responsible for judging and granting the authorizations to use the Conformity
Identification Seal, and
f) Inmetro must approve the MOU.
13.2 In case the assessment is carried out by a foreign OCP and does not include all the requirements established in this RAC, the OCP
must complement the evaluation by fulfilling the unmet requirements.

ANNEX B - ADDITIONAL TECHNICAL REQUIREMENTS FOR THE ASSESSMENT OF THE QUALITY SYSTEM
B.1 Control of Documents
Subclause 4.2.3 of NBR ISO 9001:2008 applies, with the following addition:
a) Technical documentation and manufacturer’s documentation shall be controlled;
b) Documented procedures shall ensure that information contained within manufacturer’s documentations is compatible with the
technical documentation. The manufacturer shall not initially approve or subsequently amend related drawings unless they are in
compliance with the schedule drawings;
c) The quality system shall ensure that no factor (type, characteristic, position, etc.) defined within the Ex certificate and technical
documentation (e.g. schedule drawings) is modified;
d) There shall be a documented system that refers all related drawings to the relevant schedule drawings;
e) Where there are common schedule drawings associated with more than one Ex certificate, there shall be a documented system to
ensure simultaneous supplementary action in the event of an amendment to such drawings;
NOTE 1 Some manufactures use common components with common drawings numbers one more than one product. Some of these
products may have different persons responsible for them. Therefore, if one product with a common component and drawing number is
revised to meet a need, and if the necessary supplementary certificate is obtained, there needs to be a system for ensuring that any
other certificates that call up such components are also subject to supplementary certification. This is in order to avoid such products not
being in compliance with their technical documentation. The system should identify the component drawing version, and this version
shouldn’t be modified by anybody other than the person(s) responsible for equipment.
f) Where a manufacturer also has drawings for equipment not intended for use in explosive atmospheres, the manufacturer shall have a
system that enables both the related drawings to be clearly identified;
NOTE 2 The following examples indicate some methods of achieving this:
- The use of visual markers;
- The use of a unique series of drawing numbers, e.g. all drawings concerning a certified equipment have an Ex prefix to the drawing
number.
g) The manufacturer shall document who is responsible for the quality system of each Ex certificate.
NOTE 3 In some certification schemes, the body responsible for the quality system associated with each Ex certificate may be different
from the body that issued the Ex certificate and therefore needs to be clearly identified.
h) Where technical documentation or manufacturer’s documentation are passed to a third party, they shall be provided un a way that is
not misleading;

B.2 Control of Records

Note: It is the sole interest of the manufacturer to retain adequate quality records to demonstrate conformity of the product and satisfy
national regulation and legislation. Examples of documents that require control and retention are:
- Those arising from regulatory requirements;
- Customer order;
- Contract review;
- Training records;
- Inspection and test data (per batch);
- Calibration data;
- Sub-contractor evaluation;
- Delivery data (customer, delivery date and quantity, including serial numbers where available).
B.3 Planning of Product Realization

B.3.1 Ex d – Flameproof enclosures
B.3.1.1 Castings
Castings should be subject to verification that demonstrates conformity, e.g.:
- 100% visual inspection should be done on each part;
- Wall thickness (including those parts not subject to machining);
- Flaws, inclusions, blow holes and porosity (by either a visual or test method depending upon the criticality).
Recovery of porous casting by impregnation methods, e.g. silicon, is not permitted. In the event that a casting is recovered by welding it
will become subject to the requirements applicable to fabricated enclosures, e.g. routine pressure testing.

B.3.1.3 Cemented joints and potted assemblies
Documented procedures should address the following:
a) Shelf life and storage of cement, potting compounds;
b) Mixing;
c) Surface preparation (degreasing or equivalent is usually required immediately before the potting-operation to ensure good adhesion);
d) Application e.g. filling instructions, freedom from voids and temperature conditions;
e) Curing: this should include curing period, any relevant environmental factors, provision to ensure product undisturbed during the
curing period.
B.3.1.4 Routine pressure testing
The purpose of the test is to check that the enclosure does not suffer damage or permanent deformation and that there is no leakage
from the enclosure during the test other than through constructional gaps, e.g. flamepaths
Leakage through cemented joints or potted assemblies would constitute a failure.
The test can be a single test conducted on a complete assembly, or a series of tests on each sub-assembly or component part. For
enclosures that contain more than one discrete compartment, each compartment should be tested individually. The method used should
ensure that the assembly, sub-assembly or component parts are subjected to representative stress patterns e.g. actual fastening facilities
are used. Clamping that affects the mechanical properties of the type of protection would invalidate the test results.
Due to safety considerations and difficulty in detection leakage, hydraulic rather than pneumatic methods are recommended.
The test facility should be adequate to readily provide the required pressure during the test period. Leakage from flamepaths can be
reduced by the use of gaskets or O-rings.
The pressure gauge should be calibrated, of suitable resolution and range, located such that it does not invalidate the test (e.g. due to
pressure drop down pipelines).
The method of test should enable any leakage to be monitored during the test period.
The verification of the routine pressure test should include verification of the product for damage or deformation, e.g. flange flamepaths
are still within stated tolerances and fastenings are not stretched.
B.3.1.5 Flanged joints
Flanged joints should be verified after final assembly to ensure the specified gap is not exceeded. If not possible, special measure should
be taken during the production.

B.3.1.6 Sintered Components
Sintered material is used in many products, such as gas detectors and loudspeakers.
When the Ex certificate involves such components, then the design parameters for the component normally covers three factors:
- Maximum bubble pore size;
- Minimum density;
- diameter and thickness of the sintered
Therefore, the purpose of this annex is not to add any technical requirements but to provide manufacturers with guidance as to how
they can demonstrate that the actual components comply with the design requirements as detailed in the Ex certificate.
B.3.1.6.1 Verification guidance
Three options are available:
- The manufacturer conducts the verification examination and tests;
- The manufacturer conducts a pre-contract and follow-up periodic documented assessment of the component supplier and accepts
sinters with a “declaration of conformity”;
- The manufacturer accepts sinters with a “declaration of conformity” from a component manufacturer, who has an acceptable quality
management system with an appropriate scope.
B.3.1.6.2 Tests
The tests for all verification options should be performed in accordance with the requirements of the Ex certificate. Typical test
requirements are given in ISO 4003 and ISO 2738.
The test may be conducted sampling, provided that the sampling is not less than 1% of the lot size or 10 units, whichever is the greater.
When tests to determine the maximum bubble pore size and density are conducted on a sample basis, then the results should be
calculated to establish the standard deviation () for the sample batch, i.e.
- P is the maximum bubble pore size standard deviation;
- D is the density standard deviation.
The maximum bubble pore size should not be exceeded and the minimum density should remain equal to or greater than the value as
stated in the Ex certificate when 3 is taken into account. Therefore, the mean value of the sample batch, plus 3P (for pore size) and
minus 3D (for density) should not invalidate the requirements of the Ex certificate.

17050-1, and should also include the following:
- The manufactured batch size;
- The sample size taken to establish the maximum bubble pore size and the minimum density;
- The number of components supplied;
- The calculated maximum bubble pore size and minimum density, e.g. the mean values and standard deviation should be stated.
B.3.1.6.6 Measurement and monitoring
Upon receipt of the components, the manufacturer should:
- Check the “declaration of conformity” against the requirements of Clause B.3;
- Check the compatibility of the purchase order requirements with the “declaration of conformity”;
- Conducting the tests (if testing on site);
- Conducting a statistical check on the overall size of the component e.g. diameter and thickness.

B.3.2.2 Printed circuit boards (PCB)
B.3.2.2.1 Non-populated PCBs
B.3.2.2.1.1 For high density PCBs or complex, e.g. multilayer PCBs, the batch can be accepted with a declaration of conformity. The
declaration should state compliance to the purchase documents e.g. a quality plan that lists the factors that together demonstrate
conformity of the product.
B.3.2.2.1.2 For simple single or double sided PCBs, the copper artwork should be visually verified using photographic negative
(transparency), a certified drawing or controlled inspection sample.
B.3.2.2.1.3 Purchase documents should specify copper thickness tolerances, PCB thickness with tolerances and CTI values.
B.3.2.2.2 Populated PCBs
B.3.2.2.2.1 Varnish and coatings should be controlled with respect to the specification of material, effectiveness of cover and, where
required, application of two independent covering, i.e. the first covering is allowed to cure or to dry for a suitable time before application
of the second covering.
B.3.2.2.2.2 For PCBs, the manufacturer should maintain a list of safety critical components used in production (e.g. resistors and Zener
diodes), as defined by the OCP that issued the Certificate of Conformity. The safety critical components placed on the PCB should be
verified on a 100% basis.
This may be conducted by one of the following methods:
- A visual verification;
- For surface mount components, by ensuring correct loading of the “pick and place” machines and a visual verification of correct
placement;
- By automatic test equipment (ATE) provided that the ATE addresses each individual safety critical component and by a visual
verification is conducted to verify type number of components in shunt Zener diode/diode assemblies.
Note: Where the surface mount component “pick and place” machine selects the component reel based on measuring the component

B.3.2.2.2.3 Documented procedures should be provide that ensure that workmanship standards are defined with respect to component
mounting and soldering.
B.3.2.2.2.4 Specified distances and clearances on manual assembled PCBs should be verified on a 100% basis.
B.3.2.3 Sub-assemblies and assemblies
B.3.2.3.1 Documented procedures should ensure that production documentation includes all relevant variations of the product design.
B.3.2.3.2 Production documentation should address all safety critical components and, in the case of encapsulated parts, the compound

When Ex d, Ex p or Ex q enclosures contain intrinsically safe circuits, then precautions should be taken as stated in the Ex certificate or
assessment or test report to ensure that other items listed in the Ex certificate or assessment or test report are selected, mounted and
installed in accordance with schedule drawings.

B.4 Verification of Purchased Product
Subclause 7.4.3 of ISO 9001:2008 applies, with the following addition:
a) For purchased products that can compromise the type of protection the manufacturer shall determine and implement verification
arrangements which demonstrate the product’s compliance with Ex certificate, taking into account the nature of the product and the
nature of the supplier;
b) When deciding what type of verification is required for a particular purchased product, the manufacturer shall consider the nature of
the purchased product, the supplier and how critical it is to the type of protection;
Note: In considering whether the supplier should carry out the verification, the manufacturer should take into account the results of the
evaluation carried out in the purchasing process. The decision should reflect the competence of the supplier, including whether they
have a quality system that covers the activity, the resources, e.g. equipment, and personnel with sufficient skill and experience to do the
job. This latter point is particularly significant when judgement is required, such as when inspecting a flameproof casting. When the
manufacturer elects to have the supplier carry out tests or inspections relevant to the type of protection, the product should be supplied
with a declaration of conformity according to ISO/IEC 17050-1 that confirms it has been done.

c) Where the supplier has been evaluated, and documented objective evidence has been obtained to demonstrate that the supplier is
fully capable of producing and verifying the product or service, no further verification of the product or service is required, provided a
declaration of conformity according to ISO /IEC 17050-1 is supplied with each batch or product.
d) Where the Ex certificate specifies routine tests or inspections, these shall be carried out on each product. They may be carried out by
either the supplier or the manufacturer. When carried out by the supplier, this shall be specified in the purchasing documents, e.g. by a
quality plan, and confirmed by the supplier, e.g. by a declaration of conformity according to ISO/IEC 17050-1 including test results, if
required;
e) Where verification of a purchasing product cannot be carried out after manufacture, e.g. the internal parts of encapsulated intrinsically
safe circuits, then the product shall only be accepted if supplied with a declaration of conformity according to ISO/IEC 17050-1. This shall
specifically state compliance to the purchase documents, e.g. a quality plan that lists the factors that together demonstrate conformity of
the product;
f) Where sample inspections or tests are permitted they shall be conducted in a manner which demonstrates conformity of the entire
batch;
g) Where either the supplier or the manufacturer requires training or specialist skills or knowledge to carry out a verification, then the
training material, specialist skill, knowledge or background shall be document and training records maintained;
h) Where the manufacturer chooses not to carry out inspections and tests on his own premises, then inspections and tests shall be
performed on the supplier’s premises under the responsibility of the manufacturer;
i) Where a supplier provides product with evidence of conformity applicable to use in an explosive atmosphere (e.g. Ex certificate), then
further verification is not required unless the manufacturer considers it necessary;
B.5 Control of Production and Service Provision
Subclause 7.5.1 of ISO 9001:2008 applies, with the following addition:
Note: The manufacturer shall provide procedures, production equipment, working environments and inspection/testing facilities that
together provide assurance with respect to the compliance of the product with the type as described in the Ex certificate.
B.6 Identification and traceability
Subclause 7.5.3 of ISO 9001:2008 applies, with the following addition:
a) The manufacturer shall establish and maintain procedures for product identification during all stages of production, testing, final
inspection and placing on the market;
b) Traceability is required with respect to the final product and its significant parts. Traceability can be achieved using serial number,
batch or other acceptable method.
Note: Significant parts include, for example, a printed circuit board (PCB) and a safety component of an intrinsically safe circuit, but not
each electronic component on a PCB.

B.7 Preservation of Product
Subclause 7.5.5 of ISO 9001:2008 applies, with the following addition:
Note: The manufacturer shall provide an instruction manual in Portuguese to its customers that enable the safe use of the product. If it is
considered necessary by the manufacturer, the instructions must contain special requirements for the installation and maintenance of the
product. This can be specified in the Certificate. Procedures for components with limited life may be required if they affect the type of
protection, such as batteries.
B.8 Control of Monitoring and Measuring Equipment
Subclause 7.6 of ISO 9001:2008 applies, with the following addition:
Note: Compliance 7.6 (a) of ISO 9001: 2008 can be achieved by using an accredited calibration laboratory (which can demonstrate to the
OCP that it operates in compliance with an internationally recognized standard and is preferably covered by a multilateral agreement)
and obtaining a certificate bearing the accreditation logo. Where such a certificate is obtained, the laboratory need not be subjected to
further evaluation.
a) Where a calibration certificate does not bear accreditation logo of national accreditation authority, each calibration certificate shall
include at least the following information:
- An unambiguous identification of the item calibrated;
- Evidence that the measurements are traceable to international or national measurement standards;
- The method of calibration;
- A statement of compliance with any relevant specification;
- The calibration results;
- The uncertainty of measurement, where necessary;
- The environmental conditions, where relevant;
- The date of calibration;
- The signature of the person under whose authority the certificate was issued;
- The name and address of the issuing organization and the date of issue of the certificate;
- A unique identification of the calibration certificate.
b) Where a calibration certificate does not bear the accreditation logo of a national accreditation authority or does not contain the
information listed in B.8.b, the manufacturer shall demonstrate a valid relationship to international or national measurement standards by
other means (e.g. a document site assessment).
B.9 Customer satisfaction
Subclause 8.2.1 of ISO 9001:2008 applies.
Note: For the purposes of this RAC, customer satisfaction is related to product compliance with standards requirements, test report and
certificate.

B.12 Control of nonconforming Product
Subclause 8.3 of ISO 9001:2008 applies, with the following addition:
Note: One of the purposes of this standard is to prevent nonconforming products being supplied.
a) The manufacturer shall maintain a system such that in the event of the product not complying with the Ex certificate, and having been
supplied, then the manufacturer’s customer can be identified;
b) The manufacturer shall take action, appropriate to the degree of risk, where a nonconforming product has been supplied to customer;
Note: It is recommended that the manufacturer liaise with the certification body responsible for the issue of the Ex certificate.
c) Where an unsafe nonconforming product has been supplied to a customer, the manufacturer shall inform the customer, in writing as
well as the body responsible for the verification of the quality system, and issuer of the Ex certificate;
d) Where it is not possible to trace the unsafe, nonconforming product (e.g. product supplied via a distributor, or for high volume
products such as cable glands) then a notice shall be placed in appropriate publications providing recommend action to be taken;
e) For all nonconforming product that has been supplied to a customer, the manufacturer shall maintain, for a minimum period of 10
years, records of:
- Serial numbers or identification of products supplied;
- The customer who received the product;
- The action taken to inform customers and the body responsible for the verification of the quality system in the case of unsafe
nonconforming product;
- The action taken to implement corrective and preventative action;

f) Concessions for the product that take it outside the design, as defined in the Ex certificate and technical documentation, are not
permitted.
