AFFIDAVIT OF DESISTANCE

I, Alex Atkinson Reyes, of legal age, single, Filipino, residing at 109

Cowey St., Batasan Hills, Brgy. Bagumbayan, Quezon City, under oath
depose and state THAT:

1. I am the brother of the deceased RYAN ATKINSON REYES and I

am the complainant against JUAN DE LA CRUZ under GR No .
123456 for MURDER QUALIFIED BY ABUSE OF STRENGTH
pending before the Regional Trial Court, Branch 71, Quezon City;

2. After a careful and meticulous re-examination of the facts and

circumstance, I arrived at a definite conclusion that there was a pure
misapprehension of facts with regard to the identity of the accused
JUAN DE LA CRUZ. Hence, I am no longer interested to prosecute
the case against the above named accused;

3. I am executing this Affidavit of Desistance out of my own free will

and that no person forced, coerced or intimidated me to execute the
same;

4. I am fully informed in language known to me of the consequence of

executing this Affidavit, and that I can no longer file any case against
JUAN DE LA CRUZ;

5. Finally, I am executing this Affidavit of Desistance to attest the truth

and veracity of the foregoing statements and I am executing this
Affidavit to request the Prosecutor’s Office thru Prosecuting Fiscal for
the Dismissal of the case against JUAN DE LA CRUZ.

IN WITNESS WHEREOF, I have hereunto set my hand this 17 th day of
