PETITION

THE PETITIONERS through counsel, to this Honorable Court, and


by this petition, most respectfully aver:

1. Petitioners are both of legal age, Filipino Citizens, husband and


wife, with residence at _________, Philippines. Orders and processes of this
Honorable Court can be served through their undersigned counsel at the
address indicated below.

2. Petitioners were married on 14 March 1984 at ______,


Philippines, as evidenced by Certificate of Marriage, photocopy of which is
hereto attached as Annex “A”, to form part hereof.

3. Petitioners’ age difference and the minor child to be adopted is


more than 16 years.

4. Petitioners have 4 children, all of legal age and have given their
express consent to this adoption as shown by their Joint-Affidavit of
Consent attached to this Petition as Annex “B”. Birth Certificate of their
children showing their ages are also made part of this Petition as Annexes
“C” to “C-3” for F1, F2, F3 and F4, respectively.
5. Petitioners are serious and desirous to legally adopt as their
own child (actually the niece of petitioner Alexander Sario Reyes) the
minor, C2, who was born on 25 May 2010 at _________, as shown by her
Certificate of Live Birth, photocopy of which is hereto attached as Annex
“D”, to form part hereof. Said minor is the natural child of J1.

6. Said minor child have been residing and living with the
petitioners since 4 months after her birth. When the care and support of
said minor child was given to and taken by herein petitioners since that
time up to the present, her natural parents were not insane nor
intemperate, and with full knowledge of petitioners’ good intention and
best welfare and interest of said minor and that petitioners had been
rearing/caring and/or supporting and will be in a more and better position
to finance, care, educate and support said minor whom they have
considered as their own child aside from being their niece.

7. Although a long-time resident of _________, the Petitioners


have an existing business in __________. They also have a house there. The
adoptee has been living with the Petitioners and their family in _________
ever since she was 4 months old.

8. The petitioners are earning and grossing sufficient income


which is more than enough/sufficient to support, care and educate the said
minor child.

9. The petitioners are of good reputation and irreproachable


moral character, are emotionally and psychologically capable of caring for
children and have never been charged, indicted nor convicted of any
crime/offense involving moral turpitude by any judicial court of the
Philippines.

10. The minor’s natural parents are not married. The father has
disappeared even before the minor adoptee was born and could no longer
be found. The mother has given her express/tacit written consent and
conformity to this adoption, as confirmed by her signature below aside
from her Affidavit of Consent attached as Annex “E”, to form part hereof.

11. Petitioners have all the qualifications and none of the


disqualifications to adopt said minor, and this adoption would surely
redound to the best interest and welfare of the said minor.
12. The said minor has no property of her own, whether real or
personal, and has never been adopted before by any other person.

ALLEGATIONS IN SUPPORT FOR THE PETITION FOR CHANGE OF


NAME:

13. From the time minor adoptee lived in the house and with the
family of the Petitioners, she had been known by the name of C1. In fact,
during her baptism, she was baptized under the rites of the Catholic
Church under such a name. Copy of her baptismal certificate is hereto
attached as Annex “F”. She in now in fact fondly called “PPP”, a short term
for her name, Peepee.

14. In the minor adoptee’s school records, she had been using the
said name of C1. Copies of her school records are hereto attached as
Annexes “G” to “G-2” to form part hereof.

15. In order for minor adoptee to properly blend in to her new


family and for purposes of personal safety, it is respectfully prayed that
minor adoptee be allowed to use the name C1, and that her birth certificate
be amended and this name be entered as her own.

PRAYER

WHEREFORE, IN VIEW OF THE FOREGOING, petitioners most


respectfully pray that after notice, publication, investigation and hearing:

a. The instant petition for adoption of C2 by Spouses SPS. A1AND B1


be APPROVED and GRANTED;

b. The Petitioners be declared as the adopting parents of the said minor


and henceforth, the said minor be declared and pronounced as the
duly adopted child of herein petitioners and for all legal intents and
purposes as the child of the petitioners, be free from all legal
obligations of obedience and maintenance with respect to her natural
parents;

c. The minor adoptee be allowed to use the name C1, and that her birth
certificate be amended and this name be entered as her own; and
d. Petitioners further pray for such other reliefs just and equitable under
the premises.
