Note: The Project cost is excluding cost of land, cost of external electrification &
KHB overhead charges & subject to changes based on DPR.

* Approximate project cost is inclusive of cost of development of land and cost of


construction of office complex.

2. PAYMENTS AND MODE OF PAYMENT:

2.1 Fees:
a) Consultant’s fee for rendering the services shall be calculated at the quoted percentage *
as per Annexure – E on the:-
i) Tendered amount of Development works (excluding external electrification)
and
ii) Tendered amount of construction of Office complex.
awarded to the Contractor and not on any other amounts the BOARD may spend for the
project and providing any other services or amenities or any other contract, the BOARD
will execute for this project.

b) The Consultant have to submit the bills through the concerned Executive Engineer.

c) In the event of reduction of work entrusted to the contractor in course of


execution of work the fee payable will be limited and adjusted to the actual work
carried out.
d) The BOARD will be entitled to deduct any amounts from and out of the payments to be
released as may be required by any state or central statute.

* NOTE : The consultant scoring maximum final score will be called for negotiations and
further award of consultancy work. Consultants fee shall be calculated at the negotiated
percentage.
2.2 Payments made to the Consultant are on account and shall be adjusted against the
final payment payable.

(a) Until award of construction contract the fee shall be released to the Consultant based on
preliminary estimate cost and shall be adjusted with tendered cost after award of work
as mentioned in 2.1 (a) and (c). The mode of payment shall be as under:
(b) The break up of the stages of payment will be as follows.
1) Preparation of land boundary drawing as per revenue 5% of the fee
documents payable
2) On submitting and approval of conceptual project report and 5% of the fee
designs by the BOARD in terms of clause 5.1 of technical payable
proposal terms and conditions and finalizing.
3) On submitting and approval of the final drawings/designs and 20% of the fee
project report, all other drawings needed for getting approval payable.
from the competent authorities in terms of clause 5.2 (i) to
(vi), and 5.11 of terms and conditions of technical proposal.
4) On submitting detailed specifications, BOQ, working drawing 10% of the fee
in term of clause 5.2 (vii) and (viii) of terms and conditions of payable
technical proposal., for calling for tenders, evaluation and
acceptance of the tender by execution of the contract
5) On installments after completion of each milestone (to be 40% of the fee
divided equally for each milestone) with submission of
necessary working drawings in terms of Clause 5.3 to 5.7 and
submission of color perspective as per Clause 5.9 of terms
and conditions of technical proposal in the first milestone,
submission of required drawings during execution and
submission of all completion drawings in terms of Clause 5.8
and 6.2 of terms and conditions of technical proposal. after
completion of work, including site visit and monitoring
6) After obtaining completion certificates from relevant 15% of the fee
authorities.
7) Payable in four equal installments after one year of the virtual 5% of the fee
completion certificate issued by the project management committee
till the end of defect liabilty period.

2.3 Sequence of Payment:


The payment will become due and payable by the Board only on the completion of each
of the stage for which the payment is due. The consultant shall follow the sequence of
events and the consultant will not be entitled for payment for any work done prior to its
stage without fully complying with the earlier stage.
2.4 Terms of Payment:

(a) The fee is inclusive of charges towards remuneration for all the personnel employed
during the execution of this agreement and during the defect liability period and for
boarding, lodging, transportation, office accommodation, furniture, equipment,
communication facility, consumables, costs of document and reports, insurance
liabilities other expenses etc.
(b) The fee is inclusive of all taxes including service tax, duties, fees, levies and any other
imposition levied under the law of India and Karnataka and that would be payable by
the Consultant. The BOARD shall perform such duties in regard to the deduction of
such impositions as may be lawfully required to be imposed and in terms of this
agreement.
(c) Security Deposit :
Security deposit will be deducted at 5% of bill amount, in each of the running account
bills of the Consultant. This amount of security deposit will be refunded after virtual
completion certificate issued by the project management committee against on Demand
irrevocable Bank guarantee of any Nationalised Bank which shall be valid for a period
of 25 months from the date of virtual completion certificate issued by project
management committee.
(d) Performance Security:
i) The Bid Security amount of Rs. 5,00,000/- (Rupees Five lakhs only) deposited by
the Consultant along with the technical proposal in the tender shall be retained as
Performance Security and this amount shall be refunded after defect liability period of
the project without interest.
ii) In the event of the Consultant at any point of time abandons the services to the
project without giving prior notice as per clause 23 of the terms of reference of the
Technical Proposal for any reason for more than 15 days the performance security
deposit shall be forfeited.
(e) The BOARD shall cause the payment of the Consultant’s bills within one month after
the receipt by the BOARD of such bills with supporting documents. Portions of bills
that are not satisfactorily supported may be withheld from payments. Should any
discrepancy be found to exist at any time between actual payment and costs authorised
to be incurred by the Consultant, the BOARD may at any time, add or subtract the
difference from any subsequent payment.

(f) Final payment shall be made only after the completion of the Services and a final
statement, identified as such, shall have been submitted by the Consultant and approved
as satisfactory by the BOARD.

(g) All payments under this contract shall be made by cheques drawn on the BOARD’s
bank payable to the Consultant.
