Learned counsel as above accept notice for the respective
respondents.
We have considered the submissions made by Shri Kahil Sibal,
learned Senior Counsel appearing for the petitioners in support of the
application and oral submissions were also made by Shri Rakesh Dwivedi,
learned Senior Counsel appearing for the Telecom Regulatory Authority of
India.
We are of the considered view that once the Regulatory Authority
insisted on migrating to the new regime after 31.01.2019, the impugned
action now taken by means of the show-cause notice issued prima facie
creates two sets of subscribers and implementation of the instructions
contained in the show-cause notice i.e. implementation of Regulation 17 of
the Telecommunication (Broadcasting and Cable) Services Standards of
Quality of Service and Consumer Protection (Addressable Systems)
Regulations, 2017 read with Regulation 45 and the amendment made thereto

would have fiscal repercussions on the petitioners which, in our considered
view, warrants consideration.
Accordingly, till further orders and till a reply is filed and the matter
is heard, no action shall be taken on the show-cause notice dated 23.01.2019
issued to the petitioners and the subsequent directions issued vide letter
dated 01.05.2019 shall be kept in abeyance.

It may also be taken note of that these petitions were being heard
continuously. In fact, arguments on behalf of the petitioners in W.P.(C)
No.4135/2017 and connected cases were over but due to unavoidable
circumstances further hearing in these petitions is not possible and therefore
these petitions be released from part heard and be listed before an
appropriate Bench as per roster.
List on 11.07.2019.
