The quotation received is for UKL – UPL STUDY, how about Environmental Management Plan &
Environmental Monitoring Plan (RKL-RPL) and Environmental Impact Statement (ANDAL) ? Are these
required for our project or covered by UKL-UPL?

2. . Please confirm that AMDAL is not required for our project and the supporting basis?

Based on the policy of Minister of Environmental and Forestry No.

P.38/MENLHK/SETJEN/KUM.1/7/2019 about TYPE OF BUSINESS AND/OR ACTIVITIES THAT
COMPULSARY HAVE AN ANALYSIS OF ENVIRONMENT IMPACT that must to do AMDAL study is an
activity of industry which as follow :

1. Cement Industry that have been integrated with the production of Clinker
2. Pulp and Paper Industry that the material comes from Forest Plant Industry
3. Petro-chemical Hulu Industry
4. Industry Area
5. Shipyard Industry with Graving Dock System
6. Propylene, Ammunition, and Explosive Industry
7. Lead Smelting Industry
8. Industry that used areas ≤ 20 ha

Outside from list of activities above must make a document of UKL-UPL.

As for managing and supervise in UKL-UPL document also written to do environment’s management
and supervise.

3. What is the permissible equipment noise level per the local regulation? Appreciate if you could
provide this information so that we can plan for provision of noise barriers for our equipment.

Jawab :

The equipment that able to be used is not limited as long as it fulfil environment’s quality standard
for noise which is a decision of Ministry of Environmental No. 48 year 1996 about Noise level
standard.

Environment’s quality standard for:

- Houses and Settlement is 55 dBA
- Commerce/Trading and Services is 70 dBA
As for in the activities of construction environment, employee is compulsory to used Safety Tools.
4. The attached word file list the input engineering data from Linde. At what stage of the project do
we need to submit the UKL-UPL? If it's early / prior commencement of construction, then we will
only have the conceptual / basic engineering data. Is this sufficient for making the submission &
having the approval?
Jawab:
Drafting/Making Environment Study (UKL-UPL) will be done during the construction has not started
yet. So attaching data is compulsory because it will be used to predict causes from construction until
operation. In UKL-UPL document will state management and supervision of environment during
construction stage until operation stage. The require data can be based on basic engineering data or
can be analogical with an activity that has been operated.
5. Can site construction activities commence while waiting for the UKL – UPL approval from the
authorities?
Jawab :
Construction cannot be done before having Construction Permit (in Indonesia called Izin Mendirikan
Bangunan (IMB)). Company will get construction permit after having Environment permit and this
environment permit can be obtained from Environmental study (UKL-UPL).
6. Is there any fee imposed by the authorities to be borne by Linde for the submission / approval of
the permit? Do share with us the cost, if any.
Jawab:
The proposal that we offer has already include for the cost until receiving Environmental Permit,
whereas the requirement that need to be fulfil in making UKL-UPL is Principle Permit from
Governance or business license from BKPM and space compatibility need to be prepared by
company. The requirement of UKL-UPL study that be present must have principle permit/license and
space compatibility.
7. Can you confirm if there's a requirement for Linde to provide a full time trained pollution control
officer on-site during construction (i.e. Environmental Officer) whose duties include monitoring
activities & execute plans to deal with the emission of waste and pollutants to the regulatory body?
Should Linde be required to comply to this, can we engage you to supply this person and what would
be the cost?
Jawab :
We are able to do an environment supervision from construction stage until operation stage based
on UKL-UPL Document. The result of supervising will be reported to related agency every 6 months.
One of activities that will be supervise is supervising air quality ambience and noise. If during time
using an equipment such as genset, we can also do supervising on air emission.

Can you please share with us your cost for undertaking the supervision services per item No. 7. The
service duration is tentatively for 2 years. You may update your quote accordingly to include this
item.

Jawab :

Thanks in advance for your response. For this moment, we can only give you monitoring fee for
construction stage until operation stage after UKL-UPL study that have been approved by local
department of Environment and Forestry. Quality of environment in the study of UKL-UPL will be
more detailed and monitoring location point will also be clearer.

Also, do share with us the document concerning the noise level standard for our reference per item
no.3.

These are two rules that we attached:

1. Ministry of Environment regulation no. 48 year 1996 about Noise level standard
2. Regulation of the Minister of Health of the Republic of Indonesia no 70 year 2016 about
standard and requirement for health of the industrial work environment.
Point number one is possible to be used as the threshold values at the stage of construction and this
point also can be used on operation factory.
