1. You have joined a company as an HR Manager employing 500 employees. This company
is 10 years old. The productivity of this company is low. There is no proper discipline in this
company. This company has now been taken over by a Swedish Multinational Company. The MD
of this company is a hard task master. He had a long discussion with you regarding the productivity
and discipline in the company. The MD wants to ensure that the rules of discipline have to be
followed mutinously by all employees and the productivity of the employees has to be improved
manifold. He wants you to devise a grievance procedure which shall have to be very simple with
just four levels and which will enable the company to know and address the grievances of the
employees. Before framing the procedure, the MD also wants to know from you the concept of
grievance, the types of grievances and the various principles of Grievance Management. Explain
to MD as per his directions.

2. You have been appointed by a company as a Consultant to conduct Employee satisfactio n


survey and suggest ways and means by which the satisfaction level of the employees can be
enhanced. At present the productivity level is very low and the profit margins are going down day
by day. Explain as to how you would go about to find out the satisfaction level of the employees.
What concrete suggestions would you give to improve the overall satisfaction level of the
employees? Devise a questionnaire which would be circulated among the employees and from
their responses you shall be able to find out the satisfaction level of the employees.

3. You have been appointed by an American Company as an HR Manager to look after the
entire HR activities of their Plant at Rajangoan. The MD of this company wants to know from you
the provisions of the Industrial Relations Code which has been approved by the Cabinet and is
pending before the Lokhsabha. The MD wants to know from you as to what the Code provides
relating to the various recommendations made by the Second National Commission of Labour on
matters relating to Chapter VB of the Industrial Disputes Act, 1947 concerning Lay-off,
Retrenchment & Closures. Enlighten the MD on the various aspects of the Code relating to the
recommendations of the Second National Commission on Labour.

4. You have been appointed as a Personnel Manager in an Engineering Company employing


1000 employees. In this Company there is a very strong Union of the Bharatiya Kamgar Sena. The
President of this Union is a very strong person as he comes from the local area where this Company
is situated. He repeatedly abuses the Supervisory and Managerial staff. One day when he was
abusing a Supervisor, the Production Manager intervened and asked him not to abuse the Superior.
Immediately he retorted and slapped the Production Manager causing bleeding injuries to the
Production on his face and nose. When the MD of the Company heard about this incident, he
directed you to suspend the President of the Union pending enquiry and schedule a domestic
enquiry. Accordingly a charge sheet was issued to the President of the Union and a Domestic
Enquiry was scheduled against him. On completion of the enquiry the Enquiry Officer submitted
his findings and report, on the basis of which the President of the Union was dismissed from the

services of the Company. Immediately the workmen of the company resorted to a slow down and
the discipline was thrown to the winds. The MD had a meeting with the Union Committee
members. The Union demanded that the dismissal order issued to the President of the Union should
be immediately revoked. The MD told the Union Committee Members that they could file a case
before the Labour Court and if the Labour Court gives a decision granting reinstatement to the
President of the Union, the company would respect the award of the Labour Court and not go in
appeal to a higher court. The Union Committee Members told the MD that the Labour Court will
take not less than 5 years to give its decision. They suggested that the matter could be jointly
referred to Arbitration. The MD wants to know from you the entire process of Arbitration under
section 10A of the Industrial Disputes Act, 1947. The MD also wants to know from you the
difference between Arbitration and Adjudication. Also the MD wants to know from you as to what
precautions should be taken if the matter has to be referred to Arbitration. Satisfy the MD about
his various queries in this regard.

5. You have joined a Public Sector Undertaking employing 5000 employees. This company
is following all the rules and regulations meticulously. The MD of this company wants you to
prepare and implement the following:

1. How the Safety Committees are to be constituted and what are their functions under the
Maharashtra Factory Rules,1963.
2. How the Works Committees are to be constituted and what are their functions under the
Industrial Disputes Act, 1947.
3. How the Grievance Settlement Committee is constituted under the Grievance Procedure
and their functions.
4. How Grievance Redressal Committees are to be constituted and what are their functio ns
under the Industrial Disputes Act, 1947.

Explain how these various committees are constituted and explain in details their functions.
