SUBJECT: - LEGAL NOTICE (REGISTERED A.D.)

The upshot of the instructions made by my client Mirza Yahya


Baig S/O Mirza Latif Baig R/O Ram Pura Lahore, I am serving
you with the following legal intimation / notice: -

1.That my client purchased a plot measuring 7 Marlas vide


Khasra No.68 & 70/2 situates inside Mauza Gallo Tehsil
Cantt, District Lahore with distinct Union Council no.52
through registered sale deed no.4388 Bahi No.1 Jild No.1005
registered with sub-registrar Shalimar Town vide Dated
25.04.06.It is need less to mention that my client had 1/3
ownership whereas you were also equal owner with an other
entity namely Ch. Muhammad Afzal Jatt. All three had 1/3
equal share in the chunk and eventually mutation was duly
entered vide number 3822.

2.That subsequently you entered into an agreement to sell with


my client regarding your aforementioned estate/property
which in existence form comprised of shops, vide dated
01.07.06.

3.That as per terms and conditions of the referred


contract/agreement to sell, all three joint owners affirmed the
alienation process as well as relinquishment of your share in
the business, being processed under the joint supervision
which is obviously, the sequel of aforementioned registered
sale deed.

4.That the contract / agreement to sell depicts that on the date


of its execution i.e. 01.07.06 you received earnest money
Rs.35, 000/- and subsequently also received Rs. 15,000/- on
03.07.06 and it is needless to remained you that total
consideration was settled as Rs.3, 25,000/- which was
inconsideration of your 1/3 share in the property as well as
business.
5.That according to the terms and conditions it was settled that
the contract /agreement to sell shall be performed in terms of
duly executed sale deed on to before 25.11.06.On the other
hand my client has been requesting you since 02.11.06 that
he is ready to pay remaining amount i.e. Rs. 2,75,000/-
subject to condition that you have to provide Fard for the
purpose of sale but due to some Mens Rea you have been
tolerating the matter with one and other lame excuses.

6.That due to forgoing relations my client has been bearing your


baseless excuses and now the irking is being developed
because my client is anxious to lodge some business projects
but due to your adjournments every thing is hanging.

That now through this legal notice you are


being informed and warned that kindly provide the Fard
for sale and also execute the registered sale deed in
favour of my client immediately and it is needless to
mention that my client is still ready to pay the remaining
amount i.e.Rs.2, 75,000/-. And mind it that in case of your
flunk, my client would wait up to two weeks and would
have no corner/option to avail all legal remedies including
the institution of Suit for Specific Performance, Suit for
damages etc. All costs of the litigation shall be born by
your entity and you will be the sole responsible for the
expected crises or stress relations, seldom required by
my client.

further reference or proceedings.
