FERDINAND SAMPOL

I, FERDINAND SAMPOL, of legal age, Filipino, married,


Immigration Officer II of the Bureau of Immigration, Department of
Justice, with office address at the 1st Floor Immigration Booth, Ninoy
Aquino International Airport Terminal 1, Pasay City, after having
duly sworn to in accordance with law, depose and state that:

PRELIMINARY STATEMENT

This Judicial Affidavit shall take the place of my direct


testimony in the above-entitled cases, the same being prepared in
English, a language known and understood by me;

This Judicial Affidavit is taken before Atty. Jan Darrel Oliver, at


Pioneer Building, 21 Matalino Street, Quezon City;

I am answering the questions herein propounded to me, fully


conscious that I do so under oath and that I may face criminal
liability for false testimony or perjury.

The testimony of Mr. FERDINAND SAMPOL is respectfully
offered in the above-captioned case to prove the following:

1. He is the Immigration Officer II at the Philippine Immigration


Booth at Pasay City from January 6, 1985 to present;

2. As Immigration Officer II, he is in-charge for the final


verification of Philippine nationals departing and arriving to
the country;

3. In the course of the performance of his official duties, he


verified and stamped upon passport marked as Exhibit 4 ;

4. He can identify Exhibit 4;

5. Witness executed a Judicial Affidavit in connection with the


present cases, which shall constitute as his direct testimony;

6. He can identify his Judicial Affidavit, his signature thereon, as


well as the attachments thereto; and

7. He can affirm and confirm the veracity of the contents of his


Judicial Affidavit.

The testimony of the witness is likewise offered to prove other


matters relevant to the purposes of his testimony and the material
allegations in the Information.

DIRECT EXAMINATION PROPER

1. Q: Mr. Sampol, what is your present occupation, if any?

A: I am the Immigration Officer II of the Bureau of Immigration


at the Philippine Immigration Booth at the Ninoy Aquino
International Airport Terminal 1.

2. Q: When were you appointed as Immigration Officer II of the


Bureau of Immigration at the Philippine Immigration Booth?

A: I was appointed as Immigration Officer II on January 6, 1985

3. Q: How long have you been working at the Bureau of


Immigration?

A: Since 1985, sir.

4. Q: What are some of your duties and responsibilities as


Immigration Officer II?

A: Among my duties and responsibilities are to verify the


identity of Philippine nationals going out of and arriving to the
country before boarding at the airport, checking if there are
pending hold departure orders or warrants of arrest issued
against Philippine nationals going out of the country, and
detaining those persons who are flagged as persons with
warrants of arrest until we can turn their custody over proper
law enforcement agencies, and deny boarding to persons who
have hold departure orders issued against them by the courts.

5. Q: In the connection with your duties, what do you do when


there is no warrant of arrest or hold departure order issued
against a Philippine national?

A: We stamp the passport.

6. Q: What do you do if the person has a warrant of arrest issued


against him or her?

A: We deny them boarding and detain them until we can turn


them over to the law enforcement agencies.

7. Q: In connection with your duties do you remember Mr.


Hubert Jefferey Webb having passed through the immigration
booth at the NAIA Terminal 1 on March 9, 1991?

A: Yes, sir.

8. Q: What did you do when Mr. Hubert Webb went to the


immigration booth?

A: I checked the records and files we have with the Bureau


regarding warrants of arrest and hold departure orders if there
is any issued against Mr. Webb.

A: No, sir.

10. Q: After checking and verifying that Mr. Webb has no


warrants of arrest or hold departure orders issued against him,
what did you do?

A: I issued the final clearance to allow Mr. Webb to depart and


board his flight.

11. Q: After you issued the final clearance to Mr. Webb, what did
you do?

A: I stamped on his passport the date of departure which is


March 9, 1991.

12. Q: In connection with your duties do you remember Mr.


Hubert Jefferey Webb having passed through the immigration
booth at the NAIA Terminal 1 on October 26, 1992?

A: Yes, sir.

13. Q: What did you do when Mr. Hubert Webb arrived at the
Immigration booth?

A: I checked his passport and the first immigration stamp when


he departed from the Philippines. After checking, I stamped on
his passport the date of his arrival which is October 26, 1992.

14.Q: Are you prepared to sign and swear to the truth of the
matters you have testified to in this Judicial Affidavit?

A: Yes, sir.

15. Q: Are you executing this Judicial Affidavit freely and


voluntarily?

A: Yes, sir.

16. Q: Did anyone force, coerce, threaten or pay you to execute this
Judicial Affidavit?

A: None, sir.

17. Q: Do you affirm and confirm the veracity of the contents of


this Judicial Affidavit fully conscious that you are under oath,
and that you may be criminally liable for false testimony or
perjury?

A: Yes, sir.

1. I personally conducted the examination of the above-named
affiant, a witness in the case entitled “People of the Philippines,
Plaintiff, vs. Hubert Webb, et al., Accused,” docketed as Criminal
Case No. 123456;

2. I faithfully recorded the questions I propounded and the


corresponding answers that the aforesaid affiant/witness gave;
and

3. Neither I nor any other person then present or assisting me


during the examination coached the aforesaid affiant/witness
regarding the latter’s answers.
