ORDER

I. The petitioner and respondent stipulated on the following:

1. That the petitioner and respondent got married at Manila Cathedral in the
City of Manila, August 8, 1988;

2. That during the period of their cohabitation, they had 3 common children
namely; Alexander, Alejandro and Alessandro;

3. That at the time of their marriage, the petitioner and respondent did not
have any settlement of their properties.

II. The petitioner marked its documentary/object evidence, to wit:

Exhibit “A” - Marriage Certificate of the Petitioner & Respondent;

Exhibit “A-1” - Aug. 8, 1988, date of marriage of the Petitioner and


Respondent;

Exhibit “B” - Marriage Certificate of Respondent and Eleanor


Domingo;

Exhibit “B-1” - June 20, 1976, date of marriage of Respondent and


Eleanor Domingo;

Exhibit “B-2” - Father Hernando L. Mendoza, the name of the


solemnizing officer and his signature;

Exhibit “C” - PSA Certificate of Registration of Rev. Mendoza;

Exhibit “D” - Authority to Solemnize Marriage of Rev. Mendoza;

Exhibit “E” - Judicial Affidavit of the Petitioner, Maria Lea C. Salonga;

Exhibit “F” - Judicial Affidavit of Fr. Hernando L. Mendoza, the priest


who solemnized the marriage between Respondent
Agaton L. Mulach and Eleanor R. Domingo.
The defense marked its documentary/object evidence, to wit:

Exhibit “1” - Birth Certificate of respondent to prove that he is not the


same person who contracted the prior marriage as
alleged
by the petitioner;

Exhibit “2” - Adopting exhibit "A" of petitioner;

Exhibit “3” - Certificate of Employment of respondent to prove his


capacity to provide and acquire properties;

Exhibit “4” - Judicial Affidavit of respondent;

Exhibit “5” - Judicial Affidavit of respondent's brother, Bryan Mulach;

III. The witnesses of the petitioner and the respondent were named, as follows:

PETITIONER

1. Maria Lea C. Salonga - To prove her allegations in her petition;

2. Rev. Fr. Hernando Mendoza - To prove that he solemnized the marriage


between the Respondent and Eleanor
Domingo on June 20, 1976;

3. Representative from PSA - To prove the facts as stated in the Marriage


Certificates to be true and correct based on
the public records that the Respondent
contracted two (2) marriages.

RESPONDENT

1.

Both the Petitioner and Respondent manifested their reservation as to the


marking of other Exhibits not available during Pre-Trial.

There being no other matter to be considered, the pre-trial of these cases is


hereby declared terminated.

The reception of the petitioner’s evidence is set on February 28, March 6, and
13 at 6:30 in the afternoon.

The reception of the respondent’s evidence is set on April 3 and April 17 at


6:30 in the afternoon.

The promulgation of judgment of these cases is tentatively set on ________


at ________.
The court shall not allow the presentation of documentary evidence or
testimonial evidence not presented during the pre-trial, except for exceptional
reasons, and/or rebuttal purposes.

The contents of this pre-trial order shall control the subsequent course of
action.

The trial dates are final and not transferable and no motions for postponement
shall be entertained by the Court. If such motions are granted in exceptional cases,
the postponement shall be deducted from such party’s allotted time from to present
their evidence.
