Barley Sheaf Farm HOA Violation Policy

Dear Barley Sheaf Farm Residents:

You are receiving this mailer because the Barley Sheaf Farm HOA Board of Directors
made updates to the HOA’s violation policy and pool rules. Please review the enclosed

Types of violations pertaining to time given to correct-

1. A. Immediate correction violation letter


No additional time is to be given to correct the violation and the violation must be
corrected at the receipt of violation letter.
.
 Any violation that may cause damage to the common area or other
residents’ property.
 Any violation that may cause liability to BFF or be a danger to residents.
 Animals being permitted to run free and not under the control of the
owner.
 Animal waste not being cleaned up.
 Trash can(s) either not being removed from curb within 24 hours of trash
pick-up or trash can(s) not being stored in the proper location of the
property.
 Disturbances to neighborhood.
 Person property not removed from common ground areas (see rules &
regs).
 Littering on Common ground and parking stalls, this includes cigarette
butts.
 Trash being put out, not in a sealable container.

1st Notice - Letter sent- NO FINE. Recheck in one week.


2nd Notice - A reminder letter sent informing the Homeowner that a fine will be
assessed if the violation is not corrected immediately. Recheck in one week
3rd Notice - Fine letter with notification that fines will continue to be
assessed until the violation is corrected. Re-inspect every month.
4th & additional Notices – Additional Letters & fines.

B. Immediate correction violation letter for Parking violations


No additional time is to be given to correct the violation and the violation must
be corrected at the receipt of violation letter

1st Notice - Letter sent- NO FINE. Recheck in one week.


2nd Notice - Letter & Fine. To be rechecked or verified in a week and every week
thereafter.

2. Ten (10) Day permitted correction time from the date of the violation letter.
 Minor Repairs needed such as screens or blinds need to be replaced.
 Removal of prohibited items on the property (see rules & regs).
 Replacement of address markers.
 Tree/shrub trimming or removal.
 Landscape upkeep, weeding, grass seed.

1st Notice - Letter sent- NO FINE.


2nd Notice - A reminder letter sent informing the Homeowner that a fine will
be assessed if the violation is not corrected within ten days. Re-inspect in 10 days.
3rd Notice - Fine letter with notification that fines will continue to be
assessed until the violation is corrected. Re-inspect every month.
4th & + Notices - Additional fines.

If the homeowner cannot complete the corrections within the time specified, he/she must
notify the property management team, giving the team the reason for non-completion and
the date when the work will be completed.

3. Thirty (30) day permitted correction time from the date of the violation
letter.
 Repairs to the home structure, Decks, Patios, Sheds, Fences.
 Upkeep required to the visual aesthetics of the property.
 Power washing of the home structure, Decks, Patios, Sheds, Fences.

1st Notice - Letter sent- NO FINE.


2nd Notice - A reminder letter sent informing the Homeowner that a fine will
be assessed if the violation is not corrected within 15 days. Re-inspect in 15 days.
3rd Notice - Fine letter with notification that fines will continue to be
assessed until the violation is corrected. Re-inspect every month.
4th & + Notices - Additional fines.

If the Homeowner contacts the property management team and asks for an extension, a
fine is not to be issued. The Homeowner must give a date within 30 days that the
violation will be corrected. If it is not corrected within that period and the homeowner has
not made additional contact, a fine should be issued. If the homeowner requests a period
of more than 30 days, it must be approved by the board.

The property management team is to give a monthly report to the violations chair-person.

At the second offense, the management team shall enclose Caln Townships code 73.1 &
73.2 to notify the resident that the Township will be notified, if the violation is not
corrected immediately.

If $1000.00 in fines is reached, a letter notifying the Home owner that they may be taken
to civil court for accumulated fines plus court costs will be sent. This matter should be
brought to the board’s attention at the next board meeting.

Caln Township Code of Ordinances


A. 73.1 Unlawful acts- Curbing of Animals: No person owning, harboring, keeping or
in charge of any animal shall cause, suffer or allow such animal to soil, defile, defecate
on or commit any nuisance on any common thoroughfare, sidewalk, passageway, by-
path, play area or any place where people congregate or walk, or on any public property
whatsoever, or on any private property without the permission of the owner of said
property. The restriction set forth in this section shall not apply to the portion of the street
lying between the curb lines, which shall be used to curb such animal under the following
conditions:

The person who so curbs such animal shall immediately remove all feces deposited by
such animal by any sanitary and reasonable manner.

B. The feces removed from the aforementioned designated area shall be disposed of in a
sanitary manner by the person owning, harboring, keeping or in charge of any animal
curbed in accordance with the provisions of this chapter.

§ 73-2 Violations and penalties.

Any person who shall be convicted of violating or failing to comply with the provisions
of this chapter, in summary proceedings, shall be punishable by a fine of not more than
$600, together with the costs to be collected as fines and penalties are, by law,
collected or to a period of imprisonment not exceeding 90 days, or both such fine
and imprisonment. The continuation of such violation for each successive day shall
constitute a separate offense, and the person or persons allowing or permitting the
continuation of a violation may be punished as provided above for each separate
offense.
