THE PUNJAB LAND REFORMS ACT, 1972

PERMISSIBLE AREA (S.4)

 Applicability.
The provisions of Section 4 of the Act apply to the following:
i. Owner of a land.
ii. A mortgagee with possession.
iii. A tenant.

 Classification of Permissible Area.


The permissible area would mean one of the following:
i. Land assured under irrigation:
a. Capable of yielding two crops in a year – 7 Hectare area.
b. Capable of yielding one crop in a year – 11 Hectare area.
ii. Barani land – 20.5 Hectare area.
iii. Factors to be considered to determine permissible area for other classes of land
including Banjar land: - (21.8 Hectare area.)
a. Intensity of irrigation.
b. Productivity.
c. Soil classification.
*Permissible area in such case would be 21.8 Hectare.

 Two conditions for classification of Permissible Area.


i. In case of two or more classes of land:
a. Area shall be determined on basis of relative evaluation of such classes;
and
b. It should not exceed 21.8 Hectare.
ii. In case of more than five family members:
a. Permissible area shall be increased by 1/5th of the permissible area for each
member; and
b. Additional land shall be allowed only for three such members of the
family.

 Determination of permissible area with respect to land held by a person who is a


member of a Registered Co-operative Farming Society.
The following shall be taken into consideration while determining the total share held by
such a person:
i. His share in the land held by the Society; and
ii. Other land held by him in private capacity; and

iii. In case he is a member of a family, land held by every member, whether
individually or jointly shall be taken into account.

 Determining Permissible area with respect to a land comprised in an Orchard


 Any and comprised in an Orchard shall be considered as a Barani land for the
purpose of determining the permissible area under the Act.

 Determining permissible area with respect to land transferred by sale, gift or otherwise.
 Any land which was transferred by sale, gift or otherwise, other than a bona fide
sale or transfer, shall be taken into account as if such land had not been
transferred.
 The onus of proving the transfer as bona fide shall be on the transferor.

 Evaluation of area of ‘Banjar’ Land.


 1 Hectare Barani Land = ¼ Hectare of Banjar Land.
