COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Compromise Agreement made and executed this ___ day of March
2020 in the city of ___________________, by and between:

JUSTINE BEATRICE CARLOS APOLINARIO, of legal age, Filipino,

single, and a resident of Blk 28 Lot 3 Carmona Townhomes
Milagrosa, Carmona, Cavite (hereinafter referred to as
“Apolinario”);

-and-

ROSELLE RENEE BEDUYA MARIANO, of legal age, Filipino,

single, and a resident of 781 Medicion 2F Imus, Cavite, (hereinafter
referred to as “Mariano”);

WHEREAS, Apolinario borrowed a limited edition, cherry red, Nikon

D3100 camera from Mariano, the rightful owner of the said camera;

WHEREAS, while the said camera was in Apolinario’s possession, the

latter failed to safe keep the same and in an unfortunate accident, have
unintentionally dropped the camera unit;

WHEREAS, this accident resulted to damage to the camera in the form of

a physically observable crack in the housing of the said camera unit;

WHEREAS, the accident and the damage resulting thereto was neither
intentional nor attended by bad faith and was brought about by Apolinario’s
lack of diligence in safekeeping the borrowed camera unit;

WHEREAS, the parties have voluntarily agreed to amicably settle the

issue to their mutual benefit and satisfaction;

NOW, THEREFORE, for and in consideration of the foregoing premises

and the mutual covenants set forth herein below, the parties agree as follows:

1. Mariano, through the aid of a reputable service center of her choice,

will ascertain the extent of the damage and the corresponding cost of
repairing the unit to restore it to its condition prior to the
aforementioned accident;

2. In the event that Apolinario disputes the cost initially estimated by

the service center of Mariano’s choice, Apolinario will have to suggest
another reputable service center that can repair the said camera unit;

3. In either of the abovementioned instances, Apolinario will pay for the

full assessed fees by the said service center.

4. In the event that the unit cannot be repaired, Mariano has the option
to sell the said camera unit to Apolinario at its current monetary
value, taking into account the costs for depreciation and ordinary
wear and tear.

5. Additionally, Apolinario shall be charged with One Thousand Pesos

(Php 1,000.00) as fee for the inconvenience this event has caused

 Mariano. The amount shall also cover notarial fee and transportation
fee to the service center which should have been avoided if the camera
unit was returned without damage;

6. Finally, Apolinario is given a 15-day-notice to pay the fee satisfied in

either of the provisions above: the first day shall commence upon
receipt of either a quotation from a reputable service center or a
document proving current monetary value of the unit;

7. After settlement and payment of costs, the amount received shall

represent the full and complete settlement of all of Mariano’s claims
arising out of or in connection with the accident;

8. By virtue of this Compromise Agreement, Mariano considers all her

claims in the said issue, as well as all other claims not included
therein, as fully satisfied; and

9. The parties shall faithfully comply with all the stipulations set forth in
this Compromise Agreement.
