NEW MODIFIES IN FIDIC (1999 to 2017)

(The following is to define the changes in the numbers of the sub-clauses which are mostly used in the claims of the contractors- with noticing that
in FIDIC 2017 even if the number didn’t change, most of the sub clauses have modified and clarified more. E.Suhair Hamza)

– changed into 4.23 “Archaeological and Geological Findings” – there are

changes in sub-clause 4 regarding (4-19 & 4-20).
7.4 Testing – almost same titled by “Testing by the Contractor”
8.4 Extension of Time for Completion & 8.5 Delays Caused by – there are changes and new sub clause have been added (8.4 Advance
authorities Warning) and (8.4 &8.5) renumbered by (8.5 & 8.6) respectively.
8.9 Consequences of Suspension – as mentioned above became (8.10)
10.2 Taking Over of Parts of the Works – same with title “Taking Over Parts”.
10.3 Interference with Tests on Completion – didn’t change.
11.2 Cost of remedying defects – didn’t change.
11.8 Contractor to Search – didn’t change.
13.1 &13.3 Variations – didn’t change.
– renumbered into (13.4), there is no sub-clause of (13.4 Payment in

16.1 Contractors Entitlement to Suspend Work – same with title “Suspension by Contractor”.
– all this 17 sub-clause have changed – from “Risk and Responsibility” into
“CARE OF THE WORKS AND INDEMNITIES”- instead we can use this
