COMPLAINT-AFFIDAVIT

I, RENANTE E. BENZON, Filipino, single, of legal age, residing at

Blk. 9, Lot 39, Phase I, Pinagsama Village, Taguig City, after having duly
sworn to, in accordance with law, hereby depose and state:

1. That on January 7, 2016, in Bingo Tronic Sratch Zone, Miramonti

Bldg., Roxas Blvd. cor. Gil Puyat Avenue, Pasay City, due to
financial difficulties, I had to mortgage my motorcycle, Suzuki
Raider 150, with plate number NE-47469, Model: FU150SCDZ2,
with Engine No: G427221518, Chassis No: BG41H206053, to Mr.
Rowel Padillo Austria in the amount of Nine Thousand Pesos
(₱9,000.00);

2. That under our agreement, I will redeem the said motorcycle after
two (2) months in the amount of ten thousand five hundred pesos
(₱10,500.00);

3. That on the same day, January 7, 2016, Mr. Rowel Padillo Austria
took possession of my motorcycle, and in return, I received from
him the amount of nine thousand pesos (₱9,000.00), In view
thereof, we executed and signed a mortgage agreement. A copy of
the mortgage agreement is hereto attached as Annex “1”

4. That on January 8, 2016, at around 8:45 P.M., he sent me a text

message telling me that my motorcycle was carnapped.

5. That the truth of the matter is that my motorcycle was not

carnapped and Mr. Rowll Padillo Austria misappropriated and
converted, the my motorcycle, to my prejudice and damage.
