the docket of this Court, a certain case entitled the STATE OF TEXAS vs. ROBBY ROBINSON.
being Cau:;e No. 0631888, where said defendant is charged with the offense of CAPITAL
MURDER;and
WHEREAS, it further appearing to tlie C.lurt, that Defendant, ROBBY ROBINSON, (B/M
DOB: 12-10-69) is now confined in DENTON COUNTY JAJL, DENTON, TEXAS, and that,
therefore, a necessity exists for the issuance of a Bench Warrant for said Defendant, ROBBY

In light of the requirement in Article 38,!4, Texas Code of


Criminal Procedure, that accomplice testimony be corroborated in
order to support a conviction, the t'efendant would pray for
discovery of the facts, circumstances and witnesses by which the
State intends to prove, beyond a reasonable doub�, that such
evidence tends to connect the Defendant to the offense �ommitted.

III.

Mere presence of the accused in the company of an accomplice


is insufficient to corroborate the accomplice testimony. AYola y.
stAu, 511 s.W,2d 287 (Tex.Crim.App. 1974). Testimony of one
accomplice cannot corroborate the testimony of another. ��PJIAD y•
.5.t.Attl, 470 S.W.2d 656 (Tex.Crim.App. 1971). The mere showin1 that
an offense occurred is not sufficient corroboration. Rica Y,
�. 587 s.W.2d 688 (Tex.Crim.App. 1979).

In Cherb v, State, 472 S.W.2d 273 (Tex. Crim. App. 1971), the
court of Criminal Appeals stated the rule governing the teat of the
sufficiency of the corroboration of an accomplice witness'
testimony: "We must eliminate the evidence of the accomplice from
consideration and then examine the evidence of other witnassee to
ascertain if there is inculpatory evidence or evidence of
incriminating character which tends to connect the accused with the
commission of the offense. If there is such evidence, the
corrobOration is si:fficient, otherwise, it is not."

breached. then the entire plea bargain is null and void and the parties retum to their

offenses of Murder in Indictments# 0703200A and 0703205:\.

2. In return for pleas of "guilty'· to the lesser offense of Murder in Indictments #


0703200A and 0703205A the Defendant will receive two (2) forty-two (42) yc:ir
sentenr s to the offenses of Muraer.

3. The Defendant in Indictment # 0703209A is charged with offorise of Murder. In


return fc: a plea of "guilty" to Indictment fl 0703209A the Defendant will also
receive a forty-two (42) year �entence for the offense of Murder.

4. In exchange for these pleas of "guilty" the State will recommrnd to the Court tint
these three (3) forty-two (42) year sentences shall be sc:rved concurrently or at the
same time.

5. The Defendant shall receive credit for all the time he has been in custody on these
charges, inc!ud:ng any such time as there w11.s a detainer on him from TaiTant County,
Texas.
