8. The Defendant agrees to implicate and truthfully testify against the other three co-
defcndants: Julian Burt, Malcom Alvin Griffin II, and Robby Robinson. If there are

The Defendant agrees to cooperate with representatives of the Tarrant County


Criminal District Atcomey's Offict: and to make himself available for any pre-trial
preparations and tcstify111g as often as needed. This includes any situation where one

9. Regarding Indictment II 06 184 I 3D, the State of Texas will dirmiss that case.
However, that dismissal will be "without prejudice."

The Def,mda111 is specifically put on 11otice that the allegations contained in


lndictme11t # 06184/3D are Capital Murder and that the elements of that
Indictment are different and apart from those elemenll contained in Indictment
# 0703196A and 0703202A. Accordingly, there is no Do11hk Jeopardy problem.
Also, there is no Statute of Limitations on Capital Murder.

The State of Texas will only proceed to trial on Indictment# 0618413D if tlte
Defendant fails to abide by the entire terms of tbu Written Plea Bargain
Agreement.

10. In the event that a11y requirement of tnis Written Plea Bargain A,;,eemenl is
breached, then the entire plea bargain is null and void and the panics return to their
respective positions as if this written pica bargain never existed.

section 9 below.) The State of Texas intends to proceed on the lesser-included
offenses of Murder in Indictments # 0703196A and 0703202A.

0703196A and 0703202A the Defendant will receive two (2) thirty-five (35) year
sentences to the offenses of Murder.

3. The Defendant in Indictment# 0703207A is charged with offense of Murder. In


return for a plea of "guilty'' to Indictment # 0703207A the Defendant will also
receive a thirty-five (35) year sentence for the offense of Murder.

4. In exchange for these pleas of"guilty" the State will recommend to the Court that

Dear Judge Wisch:
I am writing this letter to advise you of the work that I
performed on behalf of my client, Anthony Fennell and to assist
the court in making a decision with regard to pdyment of court-
appointed attorney's fees.
Mr . Fennell wc.1s charged by indictment in Cause Nos. :
0618413D, 0703196A, and 0703202A with the offense of Capital
Murder. In Cause NO.: 0703207A, he was charged with the offense
of Murder. The Defendant entered a plea of guilty to three of
the cases in exchange for the state's recommendation of a 35-year
sentence to run concurrently in each case. The indictment in
Cause No. : 0618413D will be dismissed by the State if the
defendant provides testimony agai nst the other three co-
defendants and complies wilh o t her conditions of a written plea
bargain agreement entered into wi th the State.
In connection with my representation of Mr. Fennell, I
visited with him on several occasions at the Tarrant County Jail
and conferred with his f .mily on aeveral occasions at my off ice .
It was important that I confer not only with Mr. Fennell, but
also with his family insofar as they were very concerned and
involved participants in the actual negotiations of the
disposition of t hese cases. Additionally, in prepar.a tion of the
defense for Mr. Fennell, I performed r e search i nto several issues
that both he and I thought were relevant. Specifically, Mr.
Fennell advised me of issues concerning the confessions that he
made to the police. In that connect.ion I prepared a Motion to
Suppress. Although the Motion to Suppress was never filed, the
issue was thoroughly researched. Further research was done
concerning the matter of parole eligibility.
