PETITION

PETITIONER, through counsel most respectfully states:

1. That plaintiff is a Filipino, of legal age, married and residing at Arlegui, Sampaloc,
Manila, Metro Manila, whereas respondent is likewise a Filipino, of legal age and
residing at Asturias, Sampaloc, Manila, Metro Manila, at which addresses the parties
herein may be served with summons and other court processes;

2. That on February 3, 2000 petitioner and respondent were married in the St. Jude Parish
Church, as shown and evidenced by their marriage contract, photocopy of which is
herewith attached and marked as Annex “A”.

3. That after said marriage petitioner and respondent lived together as husband and wife,
and it was during this time that the petitioner experienced the abusive, manipulative and
self-centered behavior of the respondent making him psychologically incapacitated to
comply with his essential marital obligations such as failing to observe love, loyalty,
respect and responsibility for the petitioner and their children.
4. Through the years the respondent became physically violent to the petitioner and their
kids. The respondent punched the petitioner, called her names and pulled her hair with
their oldest child witnessing all of these happen. Once she came home late since she
thought she deserved a time for herself, the respondent got so angry with her that he hit
her everywhere. The respondent also slapped their oldest child and strangled her while
she was at school.

5. During their time together the respondent would cheat on the petitioner even siring a
child with another woman. The respondent was not apologetic to the petitioner and even
said that he is allowed to be a natural philanderer because he is a man. Their marriage
was marred with quarrels, fights and the intermittent temper of the respondent which the
petitioner and their children experienced. This caused for the petitioner and the
respondent to separate in August 25, 2014.

6. The petitioner developed a Partner Relational Problem which was the result of her severe
stress during her marriage to the respondent. The disorder is defined as a relational
disorder that occurs between two people and involves a pathological problem in the way
that they relate to one another. The ridicules, mistreatment, neglect and dissatisfaction
that she experienced with her husband the respondent are the symptoms of the
petitioner’s Partner Relational Problem.

7. The respondent has Narcissistic Personality Disorder which means that he is absorbed
with himself and that he thinks he is the center of their own universe. As a narcissist the
respondent thinks that people are to be used. The respondent does not understand or
commiserate any compassion towards the petitioner which is his wife. He uses love as
weapon against the petitioner.

8. The respondent’s disorder is defined as enduring, pervasive and inflexible pattern of


behavior and inner experience. He caused psychological, emotional and physical pain to
the petitioner that he robbed her very essence and spirit. He never maintained care, love
support, respect for the petitioner. He is dangerous since he lacks empathy and the
petitioner’s regret and distress may persist if she remains married to the respondent.

9. The respondent’s psychological disorder showed that he is absolutely incapacitated to


perform his marital obligations to the petitioner. The respondent’s incapacity is incurable,
antecedent and permanent based on his personality structures thus making him
incapacitated at the time of the celebration of the marriage.
PRAYER

WHEREFORE, it is most respectfully prayed of this Honorable Court that judgment be


rendered in favor of annulling the marriage of the petitioner with the respondent and declaring
the said marriage null and void, thus ordering the Local Civil Registry of Manila to cancel the
said marriage from the book of marriages and order said marriage to be of no legal effect.

Petitioner likewise prays for such other reliefs that this Honorable Court may deem just and
equitable in the premises.

Manila, after being sworn depose and say

1. That I am the petitioner in this forgoing petition.


2. That I have read and fully understood the case.
3. That all allegations contained in this petition is true and correct of my own knowledge
and based on authentic documents.
4. That I have not commenced any other action or filed any claim involving the same issues
to any court, tribunal or agency; that to the best of my knowledge no same or similar
action or proceeding are pending therein and if I should hereafter learn of any such
pending similar action or claim I hereby undertake to inform this Honorable Court of
such fact within five (5) days therefrom.

by Jane Pilian Marios who has satisfactorily proven to me her identity through her SSS
identification card that she is the same person who has personally signed the forgoing affidavit
before me and acknowledged that she executed the same.

ANNEX A

MARRIAGE CONTRACT

The Authority

In the Name of God our Father and Lord Jesus Christ we, Jane Pilian and Nito Marios hereby
before these witnesses, are joined by holy matrimony, as God intended in Genesis 2: 21-25 from
this day forward until death.

The Authority in and for this marriage shall be Almighty God as revealed in the Holy Bible,
His Words shall be final Authority in every decision and dispute.

The Parties

Nito Marios is a man of sound mind and character and of lawful age, attesting to the Lordship of
Jesus Christ and the preeminence of the Word of God.

Jane Pilian is a woman of sound mind and character and of lawful age, attesting to the Lordship
of Jesus Christ and preeminence of the Word of God.

Contract Stipulations

The parties hereby agree to mutually love, respect, support, trust and be loyal to one another
and to follow the marital laws provided for by the State throughout their marriage.

The parties hereby agree that the property regime that they will follow is Absolute Community
Property as provided by Article 88 of the Family Code.
The parties hereby agree to mutually raise their future children to be lawful and valuable
citizens of the society should they desire to have said future children.

The parties hereby agree to settle their disputes together amicably and privately.

The parties hereby agree respect the privacy of one another and exercise mutual faith and trust
with one another.

The parties hereby agree to never physically, verbally or emotionally cause harm to one
another.

The undersigned parties do hereby agree to terms of this contract.
