AFFIDAVIT OF DESISTANCE

I, MARILYN T. DEL MUNDO, of legal age, Filipino, single with

address at Block 1 Lot 3 Perfect Homes Subdivision, Tres de Mayo, Digos
City, Davao del Sur, after having duly sworn to in accordance with law, do
hereby depose and state:

1. That I am the private complainant in a criminal case for Violation

of RA 9262 (Anti-Violence against Women and their Children Act
of 2004) against Karl Badilles filed before the Office of the
Prosecutor in Digos City docketed as XI-06-INV-19L-00347;

2. That for several times, the accused and I had a long conversations
and for that several long talks that we had, he pleaded to me his
sincere and solemn plea of forgiveness for the apparent wrong he
caused not only against me but also to our child;

3. That we decided to settle the problem amicably;

4. That his goodwill of extending his sincere apology coupled with his
reflection of the wrongdoings he has caused towards me are very
much appreciated;

5. Due to the aforesaid developments between us, I would like to

manifest that I now completely and absolutely exonerate the
accused from any liability and that I am no longer interested, and
I hereby desist, in prosecuting the said criminal case;

6. I am executing this Affidavit of Desistance without Force,

Intimidation, Undue Influence of threats exerted upon me and to
the best of my knowledge and ability;
 7. I hereby inform the Public Prosecutor of Digos City that I am
withdrawing the complaint for Violation of RA 9262 (Anti-Violence
against Women and their Children Act of 2004) against Karl
Badilles docketed as XI-06-INV-19L-00347 pending before the
Office of the Prosecutor in Digos City;

8. Further, I am executing this Affidavit of Desistance to attest to the

truthfulness of all the foregoing facts and for the purpose of
securing a dismissal of the above-entitled criminal complaint
against the accused.
