EQUIVALENCY OF STANDARDS AND REGULATIONS

1.Equivalency of standards and regulations

In all the cases when the Agreement refers to a certain standard or regulation that
should be adhered to regarding the materials, the site, other procurements that
need to be secured or the execution of works or the investigations, the latest
current regulations or the revised appropriate standards and regulations will be
used, unless isn’t explicitly otherwise stated in the Agreement. If the standards
and the regulations are national, or they are related to specific country or area,
other authoritative standards that ensure at least equal or higher quality of the
standards and regulations stated will be accepted, with previous control and
special permission of the supervisor. The differences between the stated
standards and the suggested alternative standards must be fully explained in
writing by the Contractor and delivered to the Investor for their approval. If the
Investor establishes that the suggested alterations do not ensure the required
equal quality, the Contractor will apply the standards stated in the documents.

2.Equivalency of the Macedonian and European standards and regulations

The technical specifications that are the subject of this book are based on the valid
regulations and legislature of the Republic of Macedonia.
According to article 9 of the Standardization law (OG of RM Nr. 54/2002,
84/2012, 23/2013, 41/2014, 53/2016) for the purpose of preparation of
regulations that regulate the technical requirements for the products with an aim
to ensure the safety of property and protection of the life and the health of the
people, the environment and the nature, ISRM prepares, adopts and publishes
appropriate standards upon requests of the Government of the Republic of
Macedonia.
According to article 22, 23 and 24 of the Standardization law (OG of RM Nr.
54/2002, 84/2012, 23/2013, 41/2014, 53/2016) the Macedonian standards are
published as separate publications and are market with mark MKS.
The use of the Macedonian standards is voluntary. The Macedonian standards
can be prepared based on an original text (source standards) or by adoption of an
international, European or other foreign national standard.
According to article 20 paragraph 6 of the Rulebook for creation and adoption of
Macedonian standards and other standardization documents it is envisioned that
if a regulation is prescribed in certain field (law, rulebook, guideline, order) and it
refers to withdrawn Macedonian standards, they are applied on the basis of that
regulation and up until the alteration or creation of a new regulation to be
available in ISRM.
The bigger portion of the subject standards that are suggested in this document
are harmonized with the EU standards, i.e. European regulations.
