RESOLUTION AFFIRMING THE INTENTION OF THE LOCAL GOVERNEMNT UNIT OF BARANGAY

YATI, LILOAN, PROVINCE OF CEBU TO CONTINUE THE PAYMENT OF COVID-19 HAZARD PAY TO
THE BARANGAY HEALTH WORKERS AND TANODS DESPITE LOCAL STATUS OF MODIFIED
GENERAL COMMUNITY QUARANTINE IN THE PROVINCE OF CEBU.

WHEREAS, the 1987 Constitution, Article II, Section 15 declares that “The State shall protect
and promote the right to health of the people and instil health consciousness among them;

WHEREAS, Administrative Order No. 26 was issued by the DBM in accordance with Congress
Joint Resolution No. 4 dated June 17, 2009 which authorizes the grant of Hazard Pay to
government personnel exposed to hazardous situations, such as, but not limited to, disease-
infected places or persons, which pose occupational risks or perils to life;

WHEREAS, the said Administrative Order only authorizes the grant of COVID-19 Hazard Pay
during the implementation of Enhanced Community Quarantine in their respective localities;

WHEREAS, the level of community quarantine implemented in the Province of Cebu where the
LGU concerned is situated, namely Barangay Yati, Liloan, is placed under Modified General
Community Quarantine (MGCQ);

WHEREAS, as of writing, Barangay Yati currently have a total of forty six (46) confirmed COVID-
19 cases, twenty five (25) of which are active cases, while eighteen (18) previously positive
patients have recovered and three (3) casualities of death recorded. Whilst the entirety of the
Municipality of Liloan has already recorded one hundred thirty seven (137) of confirmed
positive cases of COVID-19, eighty two (82) of which are active cases, forty three (43) have
recovered and twelve (12) casualities of death.

WHEREAS, despite the placement of the local government unit concerned under a less strict
protocol of Modified General Community Quarantine in preparation for the New Normal, the
COVID-19 positive cases continue to rise and the government workers and employees now
more than ever, promptly rises to the occasion of this pandemic, especially the Barangay Health
Workers and Barangay Tanods, who continuously monitor not only patients that are Confirmed
(C) positive of the virus, but also patients held as Persons Under Monitoring (PUM) and Persons
Under Investigation (PUI);

WHEREAS, the evil sought to be addressed and remedied by the issuance of Administrative
Order No. 26, which is to grant the benefit of COVID-19 Hazard Pay to government employees
and workers who physically report for work and are directly engaged in the administration of
the pandemic, in consequence thereof, are inevitably exposed to imminent health risks and
hazards, continue to persist despite placement under MGCQ Protocols;

WHEREAS, in accordance with Administrative Order No. 26 Paragraph (12.0) for the Resolution
of cases not covered by the provisions of aforementioned Circular, a petition for resolution as
to the continued grant of Hazard Pay shall be made before the Department of Budget and
Management;

NOW THEREFORE, by mass motion ------------------------- be it;

RESOLVED, AS IT IS HEREBY RESOLVED, to affirm the intention of the Local Government Unit of
Barangay Yati, Liloan of the Province of Cebu to appeal before the DBM the allowance of the
continued grant of COVID-19 Hazard Pay to Barangay Health Workers and Tanods who
physically report for work and are directly engaged in the administration of the pandemic.
Provided, in such occurrence that the petition before the DBM may be granted, it shall retroact
to the last payment of COVID-19 Hazard Pay received by the subject Barangay Workers after
being halted due to the implementation of less strict protocol other than Enhanced Community
quarantine. Provided further, the COVID-19 Hazard Pay to be granted shall be in accordance
and within the 55% limitation for Personal Services under the Local Government Code (R.A. No.
7160).

RESOLVED FURTHER, to send copy of this Resolution to the Department of Budget and
Management Central Office to be attached to the Petition for the Grant of COVID-19 Hazard Pay
despite being under MGCQ, and other offices concerned for their information and guidance.
