This contract made and executed in General Santos City, South Cotabato,
Philippines this ___________, by and between:

WITNESSETH THAT:
WHEREAS, the First Party is engaged in the business of sale of Real Estate in
the Philippines;
WHEREAS, the Second Party is a Real Estate Agent, registered to the public as
such, has experience in marketing, advertising, and selling real estate property and has
expressed his interest to provide these services for the First Party, and the former
accepts the services of the latter;
The Second Party will serve as a Real Estate Agent of the First party to
the exclusion of other Real Estate companies. His work includes selling, leasing,
or renting any and all real estate covered only by his listing and exclusively for
the First Party.
The Second Party will only be authorized to sell, rent or lease the
properties under his listing with the First Party and any sale, lease or rent made
to any property not covered thereby is void for lack of authority.
The following acts are specifically prohibited by the First Party and
commission thereof shall constitute a ground for immediate termination of the
services, without prejudice to the right of the First Party to demand the payment
for damages.
1. The Second Party shall act in honesty and good faith in all its dealings in
connection with the trade and businesses of the First Party and shall not
make any substantial changes or disposition of property without written
consent of the First Party.
2. The Second Party shall disclose to the First Party any matter relating to
the properties and businesses of the latter which may affect its operations
and status.
3. The Second Party shall not deal with individuals or corporations in relation
to the properties and businesses of the First Party without first consulting
and securing the approval of the First Party. The Second Party shall be
liable for any loss or damage incurred in relation to any agreement arising
from the afore-mentioned transactions if the same were not conducted
without the First Party’s knowledge and consent.
4. The First Party shall not be bound by any agreement entered into by the
Second Party without her knowledge and consent.
5. Any unauthorized sale, lease or rent of real estate by the Second Party
shall be a round for dismissal and/or termination of his services for the
First Party. The Second Party shall likewise be liable for payment of
damages to the First Party for the said act.
The First Party shall pay the Second Party ____% of the total commission
amount which shall be paid within _____________ after the sale, lease, or rent of
a particular property.
IV. CONFIDENTIALITY
The Second Party shall ensure the secrecy of full confidentiality and work
related information known in the course of his services with the First Party’s
businesses, even after termination of the Real Estate Agent Employment
Contract.
V. TERM
The term of this agreement shall be for a period of _____ (___) year from the
execution of this contract. It shall be valid and binding for the said period or until
the parties agrees to revoke the same even before its expiration, by written
contract between them, when the parties so decide.
VII. AMENDMENT
The failure of either party to enforce any provision of this contract shall not
be construed as a waiver or limitation of that party’s right to subsequently enforce
and compel strict compliance with every provision of this contract.
X. ASSIGNMENT
The Second Party may not assign or transfer the authority, rights,
obligations and privileges granted by the First Party arising from this Contract
without the written consent of the latter.

ACKNOWLEDGMENT
known to me to be the same persons who executed the foregoing Service Contract,
consisting of Four (4) pages, including the page where this acknowledgment is written,
and which the parties signed in the presence of their witnesses and each other. They
acknowledged to me that the same is their own free, voluntary act and deed.
