Draft Moot Proposition

Ananda is one of the poor states in the Union of Gindola. Since the Gindola’s independence from
its colonial oppressors, the people of the state of Ananda are striving for emancipation. It is
considered as an economically poor state, but the level of education of the people is
comparatively better than other states in Gindola. Lot of people from Ananda go to various other
states for education, employment and at times for livelihood. To better the standard of living of
the citizens of Gindola, various governments in the past have brought in a lot of welfare
schemes. Apart from these the state governments also worked towards uplifting the living
standards of the people. Many citizens are recipients of these beneficial schemes. But time and
again there were reports by media houses that a lot of funds are swindled through the welfare
schemes by creating fake, non-existing, or duplicate beneficiaries.

In 2018, to counter the growing menace related to welfare scheme related scams, the state of
Tinkola hired the services of Hojankuda, a big data based startup in Gindola’s Start4Gindola
Startup accelerator programme. By using complex algorithms and data analytics, Hojankuda had
identified a lot of fake and duplicate beneficiaries. There was a lot of chaos in the state of
Tinkola on the basis for exclusions in the beneficiaries list. The opposition parties have raised
concerns of privacy of people of Tinkola. To answer all the protests, the chief minister of
Tinkola held a press meet and explained that all reasonable security measures were taken for
safeguarding privacy and everything that Hojankuda did was within the government’s network.
The chief minister also explained the data of the beneficiaries was provided in text (.txt) format
and strict data security protocols were adhered too. Looking at the success of the project other
states of Gindola (including Ananda) also hired the services of Hojankuda for weeding out fake
and duplicate beneficiaries from the lists. Considering the importance of the work, Hojankuda
offered its services at a very minimal cost to suit its human resource expenses. This low cost is
also due to a fact that all technical apparatus and space to work is provided by the concerned
states.

In the meanwhile, the election commission has notified elections for the legislative assembly of
Ananda. Mr. Ananda Rao, a retired IAS officer, who is working for the cause of electoral
reforms, has filed a nomination. When the voters list is released by the election commission, Mr.
Ananda Rao hired the services of Hojankuda for finding fake, non-existing and duplicate entries
in the list. After the preliminary work on the list, Hojunkuda opined that there is greater
probability of fake entries in the list, but the same cannot be identified unless they have a text
(.txt) version of the list. Mr. Anada Rao requested the election commission for the text version of
the list, to which the commission said that they had released the pdf version as per the mandate
of the law. The commission further said that a text version cannot be provided.

Mr. Ananda Rao filed a petition in the Supreme Court seeking an appropriate direction to the
election commission for providing text version and contended that this very much essential for
electoral reforms in the country. Frame the issues and identify the relevant law.
