Data Use and Sharing Agreement

This Data Use and Sharing Agreement is made, entered into, and executed by and between:

The Feasibility Analysis of Syndromic Surveillance Using a Spatio-Temporal Epidemiological Modeler for
Early Detection of Diseases project team, represented by Dr. Maria Regina Justina E. Estuar, Project
Leader, hereinafter referred to as “FASSSTER”

and

(Name of Requesting Party), represented here by (Name of Agency Head), hereinafter referred to as the
“Requesting Party”.

1. The Requesting Party declares that the data requested will be solely used for the purposes as stated in
the FASSSTER Terms and Conditions of Use.

2. The Requesting Party agrees to use the data provided by FASSSTER and TanodCOVID exclusively for the
purposes listed in this Data Use and Sharing Agreement and as stipulated in the FASSSTER Terms and
Conditions of Use. The Requesting Party shall secure the approval of the FASSSTER project team for any
deviation from that which has been stipulated in the FASSSTER Terms and Conditions of Use. The
FASSSTER project team reserves the right to request for a new Data Use and Sharing Agreement.

Following receipt of verified data for TanodCOVID by the FASSSTER project team, it is assumed that the
Local Government Unit, who enters into this agreement with the FASSSTER project team to use its data
as displayed in TanodCOVID, authorizes the FASSSTER project team to use its data in accordance with the
FASSSTER Terms and Conditions of Use. If the Local Government Unit does not want its data to be used
by the FASSSTER project team for use in TanodCOVID, the Local Government Unit will notify the
FASSSTER project team, through the FASSSTER Project Leader, within ten (10) business days. If notified
within this time period, the FASSSTER project team will exclude the data from all requests for data use
from TanodCOVID.

The Requesting Party agrees that nothing in this Data Use and Sharing Agreement shall be deemed a
grant of intellectual property rights of the data or other rights to use the data for any purpose not
declared in this Data Use and Sharing Agreement. The FASSSTER project team has sole ownership of the
data being requested through FASSSTER or TanodCOVID.

The Requesting Party agrees to treat the data provided by the FASSSTER project team with utmost
confidentiality, and use appropriate and adequate safeguards to protect the data from misuse and
unauthorized access or disclosure.

The Requesting Party agrees to observe the highest form of scientific rigor and will not report or
disseminate false, misleading, or inaccurate conclusions based on the analysis of the data. The
Requesting Party will directly clarify and coordinate with the FASSSTER project team should there be any
data concerns.

In no event shall the FASSSTER project team, its employees or agents of the data requested, be liable for
any use by the Requesting Party, or for any loss, claim, damage, or liability, of whatsoever kind or nature,
which may arise from, or in connection with, this Data Use and Sharing Agreement or from the use or
dissemination by the Requesting Party of the data requested. Furthermore, the Requesting Party agrees
to indemnify the FASSSTER project team and its employees and agents from any action, claim, liability,
cost, or expense arising directly or indirectly from Requesting Party’s use or misuse of the data
requested.

No action, suit, or other legal proceedings shall lie against the government or against the FASSSTER
project team for anything which is done or omitted in good faith or in connection with this data request.

Data provided by the FASSSTER project team shall be properly cited if disseminated in any form.

The Requesting Party agrees that any knowledge product from the analysis of data provided by the
FASSSTER project team can only be presented or published in any form with the permission and approval
of the FASSSTER project team.

The requested data shall be destroyed by means of shredding of documents and/or deletion of all
related files after its use as stipulated in this Data Use and Sharing Agreement.

This Data Use and Sharing Agreement must be approved and adopted by all parties before any data use
or data sharing takes place. All parties will ensure that this Data Use and Sharing Agreement is
disseminated to all relevant staff involved, including third party consultants.
