ACKNOWLEDGMENT RECEIPT WITH UNDERTAKING

We, FORTUNATO C. VICENTE and MYRNA SINAG VICENTE, both of

legal ages, Filipinos, married to each other, and residents of Laserna, Nabas,
Aklan, after having duly sworn to in accordance with law, hereby depose and
state that:

1. We are the owners of a parcel of land designated as Lot No. 4920-B,

Csd-06-014773, consisting of 662 square meters, located at
Nagustan, Nabas, Aklan and covered by Katibayan ng Orihinal na
Titulo Blg. CARP2017000151 and ARP/TD No. 1981 both in the name
of Myrna Vicente;
2. We previously mortgaged the said property to Ibajay Rural Bank,
Ibajay, Aklan and the property was about to be foreclosed;
3. We sought the help of Atty. Rowena Mae Nedic Mencias in redeeming
the property so it may not be foreclosed. She paid an amount of One
Hundred Sixty Seven Thousand Pesos (P167,000.00) to the
aforementioned bank, thus we were able to secure a cancellation of
mortgage on July 11, 2018;
4. We have decided to sell one half (1/2) portion of our said property to
Atty. Rowena Mae Mencias in a diminished amount of P100,000.00
due to her help in the redemption of the property and in the fact that
we could not repay her for the expenses she incurred in the
redemption and processing of the cancellation of mortgage of the
property;
5. The true consideration price of the sale includes the mentioned cost of
redemption and other expenses which were not accounted for in
relation to its redemption;
6. We undertake to return to Atty. Rowena Mae Mencias the whole
consideration price of the sale and the mentioned redemption price
and expenses she incurred in the cancellation of mortgage in any
event that the sale is rescinded or cancelled for whatever reason.
