GUIDELINES FOR THE IMPORT OF SCHEDULED WASTES GUIDELINES FOR THE IMPORT OF SCHEDULED WASTES Published by: Deparament of Environment Ministry of Science, Technology and the Environment 13th Floor, Wisma Sime Darby Jalan Raja Laut 50662 KUALA LUMPUR PREFACE ‘The Guidelines are to assist waste handlers and manufacturers who intend to apply for a written approval from the Director- General of Environment, Malaysia to import scheduled wastes. The importation of scheduled waste into this country for disposal is not allowed. Waste imported and used as. raw material by the manufacturing or processing industries may be allowed under very stringent conditions. For this purpose, the importers must show proof that the importation of such waste cannot be avoided. It is to.be noted however, in using such raw materials, there shall be minimum amount of residues left for treatment and disposal. ‘The permission granted to the applicant will be on a case-to- case’basis and the Diréctor-General is by no means obliged to approve the application unless he is satisfied that there is no better alternative. In this regard, ‘Malaysia being a party to the Basel Convention on the Control of ‘Transboundary Movements of Hazardous Wastes and Their Disposal 1989 (came into force’ for Malaysia on 6 January 1994) is strictly following the procedures as outlined in the Convention. ‘The guidelines shali-be in addition to aiid not in derogation of any written law. GUIDELINES FOR THE IMPORT OF SCHEDULED WASTES 4d 24 Introduction * ‘The import of scheduled wastes as defined under the Customs (Prohibition of Import) (Amendment) (No.3) Osder 1993, for recovery or as raw matérial must obiain prior writen opproval from Director-General of Environmental Quality, Malaysia. Submission of Information The application to import scheduled wastes must be submitted to the Department of Environment (DOE) using AS 14 Form detailing inter alia the following information: @ names and addresses of waste importer and receiving parties; Gi). types and quantities of wastes; Gi) physical characteristics; (iv) chemical characteristics; () justification for the import; wi) wii) (viii) x) methods of handling including collection, packaging, labelling, transportation and transport route. (Note: The method of handling the wastes, especially packaging and labelling, must conform to international code of practice); @ complete curriculum vitae of the personnel supervising the collection, packaging, transport and other related works; emergency response plan describing steps to be taken by parties concemed in case of spill/accident/fire which may occur during transportation (by land, sea, or air) from the premises of waste generator to the port of. entry. (Note: The plan must include a description on the action to be taken in clean-up operation, the equipment and safety apparels to be used, etc); a written agreement between the exporter, importer, transport agents (land, sca, and air) and the party receiving the wastes. This agreement shall specify inter alia: @ parties responsible for clean-up operation in case of spill. and emergencies; and Gi) the responsibility. of the exporter to retrieve the waste when denied entry 3.1 3.2 3.3 4.2 5.1 (%) a copy of an insurance coverage for the shipment. Conditions of Application ‘The importers must apply to the Director General of Environmental Quality, at Jeast 90 days prior to importing scheduled wastes. All documents such as the agreement, and approvals submitted to DOE must be of the original-or certified true copies. A valid Bank Guarantee for the scheduled waste shipment process should be deposited ‘with the DOE. when requested for. The Bank Guarantee will be returned upon fulfillment of the conditions ‘of the shipment. Process of Application ‘The procedure involved in processing an application for importing scheduled wastes is shown in Appendix A. Important Notice In accordance with the requirement of Basel Convention on the. Control” of Transboundary Movements of Hazardous Wastes and Their Disposal 1989, the Competent Authority of the exporting country should notify the Government of Malaysia of the intended shipment of the scheduled waste. 5.2 5.3 5.4 5.5 5.6 No shipment shall proceed unless the Competent Authority of the exporting country received the approval from the Government of Malaysia. ‘The transportation of scheduled waste in Malaysia shall be carried out by a DOE licenced transporter. ‘The intended transporter can apply the licence from the DOE by using DOE form AS 1 & AS 13 obtainable from the Head Office or the DOE State Offices. ‘The importer must ensure that the waste is handled by a DOE licenced/approved facility, Failure to submit complete information will result in the rejection of the application.
