WHEREAS, on March 19, 2020, the Governor of the State of Arizona issued Executive Order 2020-09,
pursuant to which bars were required to close access to the public and restaurants were required to close
access to on-site dining but could continue serving the public through pick up, delivery, and drive-thru
operations; and

WHEREAS, on June 29, 2020, the Governor of the State of Arizona issued Executive Order 2020-43,
pursuant to which bars were required to pause operations (i.e., close) effective at 8:00 p.m. on Monday
June 29, 2020, and remain closed until at least July 27, 2020, but could continue serving through pick up,
delivery, and drive-thru operations as provided for in Executive Order 2020-09; and

WHEREAS, on July 9, 2020, the Governor of the State of Arizona issued Executive Order 2020-47,
pursuant to which restaurants with indoor seating were required to operate at less than 50 percent of the
permitted fire code occupant load, ensure all seating areas for patrons while dining or waiting to be
seated are separated by at least six (6) feet, and eliminate any indoor standing room where patrons can
congregate; and

WHEREAS, on July 23, 2020, the Governor of the State of Arizona issued Executive Order 2020-52,
pursuant to which the pause in operations for bars required under Executive Order 2020-43, was
ordered to be extended, remain in place, and continue to be reviewed for repeal or revision every two
weeks; and

WHEREAS, on August 4, 2020, the Honorable Timothy J. Thomason, in Maricopa County Superior Court
Case No. CV2020-093916, ruled that indoor gyms and fitness clubs or centers must be provided an
opportunity to apply for reopening and the process for reopening must be implemented no later than
August 11, 2020 (“Ruling); and

WHEREAS, the Governor of the State of Arizona and the Director of the Arizona Department of Health
Services determined that the process ordered in the Ruling also should be applied to the paused
operations at bars; and

WHEREAS, on August 10, 2020 the Director of the Arizona Department of Health Services (“ADHS”)
issued Emergency Measure 2020-02(https://www.azdhs.gov/preparedness/epidemiology-disease-
control/infectious-disease-epidemiology/index.php#novel-coronavirus-admin-orders), which established
the phased re-opening process for businesses operating with a liquor license; and

WHEREAS, pursuant to Emergency Measure 2020-02 and prior to reopening, an affected business is
required to apply to ADHS for approval to reopen by completing an Attestation, implementing and
abiding by Department-specified mitigation Guidelines and posting a copy of the Attestation and
Guidelines in a prominent place on or near the main entry into the business; and

WHEREAS, pursuant to Emergency Measures 2020-02, law enforcement, any regulatory agency,
pursuant to its regulatory authority, ADHS and local health departments may take immediate action
against any entity that operates in violation of Emergency Measure 2020-02; and

WHEREAS, pursuant to Emergency Measure 2020-02, law enforcement, any regulatory agency, pursuant
to their regulatory authority, ADHS and local health departments may take immediate action against any
entity that operates in violation of its Attestation or the applicable ADHS-specified mitigation Guidelines;
and

WHEREAS, pursuant to Emergency Measure 2020-02, if ADHS becomes aware of continued actions taken
by entities covered by Emergency Measure 2020-02 that jeopardize the health, safety and welfare of the
public, ADHS will take additional action as necessary to protect the same; and

WHEREAS, pursuant to Executive Order 2020-47, failure to comply with Executive Order 2020-47 or any
other guidance issued by ADHS related to precautions to mitigate the spread of COVID-19 shall constitute
a public nuisance and action to abate the nuisance is authorized to be taken by county health inspectors,
law enforcement, or state agencies as mandated by the Director of ADHS, including the immediate closure
of such facility; and

WHEREAS, as of September__7th____, 2020, ADHS has reason to believe that __Rick’s Pub and Grub _____
located at ______4910 W. Ray Rd., Chandler, AZ 85226____________________________________________________________,
is operating in violation of Executive Order 2020-47 and Emergency Measure 2020-02, and thus is
jeopardizing the health, safety and welfare of the public; and

WHEREAS, by operating, ___Rick’s Pub and Grub____ located at __4910 W. Ray Rd., Chandler, AZ
85226______ ________________ is in violation of Executive Order 2020-47 and Emergency Measure 2020-02.
Accordingly:
YOU ARE HEREBY NOTIFIED THAT Rick’s Pub and Grub located at_4910 W. Ray Rd., Chandler, AZ,
MUST IMMEDIATELY:
1. CLOSE FOR BUSINESS AS MANDATED BY EXECUTIVE ORDER 2020-47 AND EMERGENCY
MEASURE 2020-02 AND REMAIN CLOSED UNTIL IT IS GRANTED PERMISSION TO REOPEN BY
ADHS PURSUANT TO THE PHASED REOPENING PROCESS ESTABLISHED IN EMERGENCY
MEASURE 2020-02; AND
2 CEASE AND DESIST FROM VIOLATING EXECUTIVE ORDER 2020-47 AND EMERGENCY
MEASURE 2020-02.
CONTINUED DEFIANCE OF THE FOREGOING IS UNLAWFUL, WILL RESULT IN LEGAL ACTION, AND
MAY RESULT IN THE IMPOSITION OF ANY AND ALL AVAILABLE CIVIL AND CRIMINAL PENALTIES
