Introduction

The concept of collective bargaining was introduced very late in India as trade unions were
found only in 20th century. The concept of collective bargaining attained significance only after
1962. The phrase collective bargaining is said to be coined by Sydney and Batrice Webb and
Great Britain. It is made up from two words collective means group and bargaining which
means proposals and counter proposals. So it is process in which the representatives of a labour
organization & the representatives of business organization & the representatives of business
organization meet and attempts to negotiate a contract or agreement, which specifies the nature
of employee-employer union relationship.

Definition

According to Tudwig Teller, Collective bargaining is an agreement between a single employer or


an association of employer on the one hand and a labour union and the other, which regulates the
terms and conditions of employment.

According to The encyclopedia of social science, Collective bargaining is a process ofdiscussion


and negotiation between two parties, one or both of whom is a group of persons acting in
contest.. More specifically it is the procedure by which an employer or employers and a group
of employees agree upon the conditions of work.

Objectives of collective bargaining

 Resolve differences over knotty issues.


 Protect the interests of workers through collective action.
 Carry out negotiations voluntarily, without interferences from a third party.
 Arrive at an amicable agreement through a process of give and take.
 To arrive at an agreement on wages and other conditions of employment.
 To have peaceful co-existence for the mutual benefits and progress.
 To maintain employee-employer relation bilaterally.
Characteristics of collective bargaining

 It is a group process.
 Negotiations form an important aspect of the process of collective bargaining.
 Collective bargaining is a formalized process.
 Collective bargaining is a process.

 Collective bargaining tends to improve the relations.

 Collective bargaining takes into account day to day changes, policies,
potentialities, capacities and interests.

 Distributive collective bargaining

o Conjunctive bargaining is the most common type of bargaining & involves zero-sum
negotiations, in other words, one side wins and the other loses.
o This involves bargaining over the distribution of surplus in this, economics issues like
salaries, wages and bonuses.
o Economics issues like wages, salaries and bonus are discussed.
o One party’s gain is another party’s loss. More competitive.
o E.g, Unions negotiate for maximum wag.

 Integrative collective bargaining


o Integrative bargaining is similar to problem solving sessions in which both sides are
trying to reach a mutually beneficial alternative i.e, a win-win situation.
o Both parties may gain or neither party losses.
o Both the parties are trying to make more of something.

 Productivity bargaining
A form of collective bargaining leading to a productivity agreement in which
management offers a pay raise in exchange for alterations to employee working practices
designed to increase productivity.

 Composite bargaining
Workers believed that productivity bargaining agreements increased their workloads. In this
method, labor bargains for wages as usual, but goes a step further demanding equity in
matters relating to work norms, employment levels, manning standards and environmental
hazards etc.

Preparation for Collective Bargaining

Preparation should begin months before the


contract talks.

Assemble a group of nurses who support collective

Arrange a meeting with a representative of the state nurses association

Assess the feasibility of an organizing campaign

Begin the process of obtaining union authorization cards

Schedule an informal meeting for nurses eligible for the collective unit

by various worker categories

Keep ongoing recording agency’s employees grievances and analyzes these before negotiation
begins

Research the wages salary structures of other health agencies in the community and compare against
agencies current wages

Process of Collective Bargaining

visions, strategic planning and negotiated changes.
Advantages

 All union members and management must confirm to term of contract without
exception.
 Nurses gain control of practice.
 Improve professional relationship.
 Give economics security.

Disadvantages

 Reduced individuality.
 Other union members may outvote one’s decision.
 Disputes are not handled with individual and management only.
 Must pay union dues even if one does not support unionization.
