GMA v. COMELEC

The heart of the controversy revolves upon the proper interpretation of the
limitation on the number of minutes that candidates may use for television and
radio advertisements, as provided in Sec 6 of RA No. 9006 (Fair Election Act) [For
national office: 120 mins for TV and 180 mins for radio; for local office: 60 mins
for tv and 90 mins for radio]
COMELEC shall require any broadcast station to submit to COMELEC a copy of its
broadcast logs for review and verification.
For the 2007 and 2010 elections, COMELEC issued resolutions to interpret Sec. 6 of
RA 9006 regarding airtime limits to mean that a candidate is entitled to the
minutes per station but for the 2013 elections, COMELEC promulgated Resolution No.
9615 changing the interpretation to a "total aggregate basis"
GMA: Resolutions are contrary to the Fair Election Act because the intent of the
law should be per station basis, hence there is grave abuse of discretion on the
part of comelec. (Bicameral Conference Committee)
COMELEC: Quoted portions of the Conference Committe as well, adopting the Senate
Bill version, setting the computation of airtime limits on a per candidate, not per
station, basis.
I: WON COMELEC went beyond the authority granted by law in adopting an "aggregate"
basis in the determination of allowable time - yes?
The law (Sec 6 of RA 9006) on its face does not justify a conclusion that the
maximum allowable airtime should be based on the totality of possible broadcast in
all television or radio stations.
The Fair Election ACt actually repealed a previous provision which prohibited
direct political advertisements -the so-called "political ad ban." If under the
previous law, no candidate was allowed to directly buy his broadcast or print
campaign advertisements, and that he must get it through the COMELEC Time or
COMELEC Space, R.A. No. 9006 relieved him from that restriction and allowed him to
broadcast time or print space subject to the limitations set out in the law.
Congress, in enacting R.A. No. 9006, felt that the previous law was not an
effective way of giving voice to the people.
The COMELEC, despite its role as the implementing arm of the Government in the
enforcement and administration of all laws and regulations relative to the conduct
of an election, has neither the authority nor the license to expand, extend, or add
anything to the law it seeks to implement thereby.
WHEREFORE, premises considered, the petitions are PARTIALLY GRANTED, Section 9 (a)
of Resolution No. 9615, as amended by Resolution No. 9631, is declared
UNCONSTITUTIONAL and, therefore, NULL and VOID. The constitutionality of the
remaining provisions of Resolution No. 9615, as amended by Resolution No. 9631, is
upheld and remain in full force and effect. In view of this Decision, the Temporary
Restraining Order issued by the Court on April 16, 2013 is hereby made PERMANENT.
