Part I
Q.1 X agrees to buy 10 bags of rice from Y at Rs. 500 per bag. Is it a valid contract?
Q.2 X promises his friend Y to give him a pair of shoes if he dances in the party. Y danced in
the party but X did not bring a pair of shoes for him. Can Y bring an action on X in a court?
Q.3 A agrees to sell B ‘five quintals of wheat’. There is nothing whatever to show what kind,
grade & quality of wheat was intended. Is it a valid agreement?
Q.4 A, threatens to beat B if he does not sell his Honda Activa to A for Rs. 15000. B agrees.
What kind of contract it is?
Q.5 A engages B to murder C and borrows Rs. 1 lakh from D to pay B. Is the contract
between A & D valid?
Q.6 A, without knowing that a reward has been offered for a live performance on stage,
performs on the stage. Can he claim to recover the rewards?
Q.7 A, sold his business to B without disclosing this to his customers. X, an old customer
sent an order for goods to A by name. B, the new owner, executed the order. Is X bound to
accept the goods?
Q.8 A offered to sell his house to B for Rs. 50 Lakhs. B offered Rs. 40 Lakhs, for which price
A, refused to sell. Subsequently B offered to purchase the house for Rs. 50 Lakhs. A,
declined to adhere to his original offer. Can B’s suit against A, to obtain specific performance
of the alleged contract, stand in the court?
Q.9 For a valid consideration from B, A, makes a promise to B to render some service to C.
C sues A on the promise. Explain, whether he can succeed?
Q.10 A, renders some service to B during his minority at the request of B. B, on attaining
majority, enters into an agreement with A to compensate A for services rendered during B’s
minority. Is the agreement valid?
Part II
Q.1 An old illiterate woman executed a deed under the impression that she was executing a
power of attorney authorizing her nephew to manage her estate, while in fact it was a deed of
gift in favour of her nephew. Is the contract valid?
Q.2 ‘A’, while his wife ‘B’ was alive, promised to marry ‘C’ in the event of ‘B’s death.
Subsequently ‘B’ died but ‘A’ refused to marry. ‘C’ sues ‘A’ for damages for breach of
promise. Decide.
Q.3 ‘A’ and ‘B’ enter into a wagering agreement and deposit Rs. 1000 each with ‘C’
instructing him to give the total sum to the winner. ‘A’ wins. He sues ‘C’ for the stake
amount. ‘B’ also sues ‘C’ for a return of the stake deposited by him with ‘C’. Decide.
Q.4 ‘A’ contracts to pay a sum of money to ‘B’, on a specified day. ‘A’ does not pay the
amount on that day. ‘B’ in consequence of not receiving the money on that day, is unable to
pay his debts and is totally ruined. ‘B’ claims heavy damages. Advise ‘A’.
Q.5 ‘X’ alight from a train at a railway station. A coolie takes ‘X’s luggage without being
asked by ‘X’. ‘X’ does not object but refuses to pay afterwards. Is ‘X’s act justified?
Q.6 ‘A’ and ‘B’ contract that ‘B’ shall construct a building for ‘A’ for Rs. 25,00,000. ‘B’ is
ready and willing to do the work accordingly. But ‘A’ prevents him from doing so. Decide.
Q.7 An oil merchant contracts to sell to a customer ten drums of a particular brand of oil. At
the time of the contract the oil merchant’s whole stock of oil had been destroyed by fire, but
he was not aware of this fact. What is the effect on the legal rights of the parties?
Q.8 ‘A’ guarantees to ‘C’ as regards payment for rice to be supplied by him to ‘B’ up to the
extent of Rs. 5000. ‘C’ supplies to ‘B’ rice to a less amount than Rs. 5000 but obtains from
‘A’ payment of the sum of Rs. 5000 in respect of the rice supplied. Can ‘A’ recover from ‘B’
Rs. 5000 paid by him to ‘C’?
Q.9 ‘A’ contracts to indemnify ‘B’ against the consequences of proceedings which ‘C’ may
take against ‘B’ in respect of a certain sum of money. ‘C’ obtains judgment against ‘B’ for
the amount. Without paying any portion of the decree amount, ‘B’ sues ‘A’ for its recovery.
Will ‘B’ succeed?
Q.10 ‘A’ employs ‘B’ to recover Rs.10,00,000 from ‘C’, and to lay it out on good security.
‘B’ recovers Rs. 10,00,000 and lays out Rs. 9,00,000 on good security, but lays out Rs.
1,00,000 on security which he ought to have known to be bad, whereby ‘A’ loses Rs. 20,000.
Is ‘B’ entitled to his remuneration?(Hand written)

Part I
Q.1 ‘A’ sales a refrigerator to ‘B’ with a stipulation that ‘B’ shall pay ‘A’ a fixed sum every
month by way of installments till the full price of the refrigerator is paid. ‘B’ after paying few
installments, discontinues payments of further installments. What should ‘A’ do, recover the
rest of the amount or take back the refrigerator?
Q.2 ‘A’ sells 10 cases of goods to ‘B’ on credit. ‘B’ takes delivery of the goods and a week
thereafter sells and delivers the same to ‘C’ on receipt of the price thereof. Both the said sales
are by the same samples. ‘C’ on opening the cases finds that the goods are not in accordance
with the sample. ‘C’ at once gives notice of rejection to ‘B’ and ‘B’ gives notice to ‘A’. ‘A’
files a suit against ‘B’ for the price of goods. ‘C’ also files a suit against ‘B’ for the refund of
the price paid by him to ‘B’. Are the claims of ‘A’ and ‘C’ justified?
Q.3 ‘A’ buys some furniture and agrees to pay for that in two monthly installments, the
ownership to pass to him on payment of the second installment. Having obtained possession
of the furniture, ‘A’, sells the furniture to ‘B’ before paying the second installment. ‘B’ buys
the furniture bonafide. Subsequently ‘A’ does not pay the second installment. Can the
furniture dealer take back furniture from ‘B’?
Q.4 ‘A’ of Mumbai writes to ‘B’ of Pune to send him a book by parcel post. ‘B’ accordingly
sends the book by parcel post. The parcel is lost on the way. Can ‘B’ recover its price from
‘A’?
Q.5 ‘P’ sells to ‘R’ a quantity of wheat lying in ‘P’s warehouse. It is agreed that three
month’s credit shall be given to ‘R’. ‘R’ allows the wheat to remain in ‘P’s warehouse.
Before the expiry of the three months ‘R’ becomes insolvent and the Official Assignee
demands delivery of wheat from ‘P’ without offering to pay the price. Is ‘P’ entitled to retain
the goods until paid?
Part II
Q.1 ‘P’ owes ‘Q’ some money on account of credit purchases made by him. ‘P’ gives a
promissory note, after affixing one rupee revenue stamp and signing, leaving the amount
blank to ‘Q’ authorizing him to fill it up in accordance with the account. ‘Q’ fills Rs. 7500
while actual amount due is Rs. 5500 only. Can ‘Q’ recover the amount? What if ‘P’ transfers
it to ‘R’?
Q.2 ‘A’ draws a bill payable to his own order on ‘B’, who accepts. ‘A’ afterwards indorses
the bill to ‘C’, ‘C’ to ‘D’, and ‘D’ to ‘E’. As between ‘E’ and ‘B’, ‘B’ is the principal debtor,
and ‘A’, ‘C’ and ‘D’ are his sureties. As between ‘E’ and ‘A’, ‘A’ is the principal debtor, and
‘C’ and ‘D’ are his sureties. As between ‘E’ and ‘C’, ‘C is the principal debtor and ‘D’ is his
surety. Decide on the rights of holder in due course.
Q.3 ‘A’ draws a bill of exchange payable after 60 days on ‘B’. ‘B’ accepts it payable after
three months. Is it a valid acceptance?
Q.4 ‘A’ makes a promissory note in favour of ‘B’ and delivers the same to ‘B’ without
consideration. ‘B’ indorses the same to ‘C’ without consideration. ‘B’ indorses the same to
‘C’ without consideration. ‘C’ indorses it to ‘D’ for consideration and ‘D’ indorses it to ‘E’
without consideration. Discuss the rights and liabilities of the holders in due course.
Q.5 ‘A’ drew a cheque of a co-operative bank for Rs. 1,00,000 in favour of ‘B’ on 1st January
2017, and gave it to him on the same day. The cheque was presented for payment on the 30 th
March 2017. In the meantime the bank had failed in February 2017. Discuss the legal
position of ‘B’s recourse against ‘A’ and the Bank for recovering the amount.(Hand written)
