CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE made and executed by and between:

_____________________, of legal age, Filipino, married and a resident


of _______________________, hereinafter referred to as the LESSOR;

-and-

______________________, of legal age, Filipino, married and a resident


of _______________________, hereinafter referred to as a LESSEE;

WITHNESSETH:

That the LESSOR is an owner of a commercial building located at


___________________________;

That the LESSOR hereby lets and leases the ground floor of the said
building unto the LESSEE and the latter accepts and lease, subject to the
following conditions:

1. Period and rentals:


The term of this lease is for ONE (1) YEAR commencing from the
period March 1, 2020 and expiring in the same month of March 1, 2021 and
renewable for another year at the option of both parties;

2. Amount of Lease:
The LESSEE shall be bound to pay the LESSOR at her above-mentioned
address the monthly rental in the amount of ELEVEN THOUSAND FIVE
HUNDRED FIFTY (Php11,550.00) PESOS payable every first week of the
month with One (1) month deposit and two (2) months advance rental fee by
the LESSEE;

3. Use and Purpose:


The LESSEE hereby expressly agreed the warrants that the Leased
premises shall be used by them for COMMERCIAL purpose and is hereby
prohibited for any illegal business.

4. Rights of LESSEE non-transferable:


The LESSEE shall not directly or indirectly sublease, assign or transfer
their right of lease over the leased premises or any portion thereof under any
circumstance whatsoever, and any such contract made in violation of his clause
shall be null and void.

5. Electric, Water and Repairs:


Consumption or use by them shall be paid by the LESSEE. Operational
maintenance and repair of the said provision is shouldered by the Lessee.

6. Changes in Existing Installation:


Any changes of installation on electrical and plumping shall constitute a
written notice for approval by the LESSOR

7. Compliance with Laws and Regulations:


The LESSEE shall comply with any and all laws, ordinances,
regulations, or orders promulgated by proper Government authorities arising
from or regarding the use, occupation and Sanitation of the leased premises and
non-compliance therewith shall be at the exclusive risk and expense of the
LESSEE

8. Fire hazards:
The LESSEE shall not bring or store in the leased premises any
inflammable or explosive goods or articles which may expose the leased
premises to fire or increased fire hazards

9. Inspection of Premises:
The LESSOR or his/her duly authorized representatives shall have the
right to inspect the leased premises at any reasonable time of the day in the
presence of the LESSEE;

10. Occupation:
Upon occupancy the LESSEE is assured of a peaceful and good habitual
condition;

11. Insolvency of LESSEE:

a.) The LESSE shall not be able to pay the rent for at least ONE (1)
Month or neglect to perform the said covenant, conditions, agreements or
restrictions stipulated this contract shall be automatically terminated:

b.) If the LESSEE will pre-terminate the contract without finishing the
term of the conditions the deposit amount will answer for the breach of contract
and is not refundable;

12. Return of Premises upon the Termination of Leased:

At the expiration of the term of this lease or upon cancellation thereof as


herein provide, the LESSEE shall promptly surrender the premises to the
LESSOR in as good a tenantable condition as when taken, ordinary wear and
tear accepted, devoid of all occupants, furniture, articles, and effects of any
kind: Provided however, that non-compliance on part of the LESSEE with the
terms of this clause will give the LESSOR the right at their option to refuse to
accept the Delivery of the premises and to compel the LESSEE to pay rent
therefore at the same rate of rental as herein provided, plus fifty percent (50%)
additional in the form of penalty, until the LESSEE, shall have complied with
the terms thereof, this same penalty being likewise to be imposed in case of the
LESSEE shall refuse to leave the leased premises after their right has expired
or terminated for any reason or whatsoever;

13. Sufficiency of Notice to Vacate:


Deposit in the leased premises of a notice to vacate shall constitute due
and sufficient notice to the LESSEE, upon termination of the term of this lease
or earlier thereof as provided the LESSE hereby expressly authorizes in
advance the LESSOR to enter upon the lease premises, remove all personal
property that may be found therein, and deposit the same bodega, and the
LESSEE further agrees to pay all costs for the transfer and storage thereof.

14. Remedial Measures:


In case of violation or infringement of any of the fore going terms and
conditions, the LESSOR reserve the right to terminate this Contract of Lease
immediately and the LESSEE agrees to vacate forthwith the Premises without
need of court proceeding: provided, however, that if for any valid reason it
shall become necessary for the LESSOR to institute appropriate court action for
the enforcement of their right under this contract, jurisdiction for the case to be
filed shall be with courts of Ormoc City, the LESSEE shall be liable for all
other damages, aside from court costs and other legal charges allowed by the
rules of Court including Attorney’s Fees

ACKNOWLEDGMENT
BEFORE ME, a Notary Public for and in the City of Ormoc, this _ day

persons who executed the foregoing instrument and said persons signed the
