From the Vice-Chancellor’s Desk
I am happy to present the second issue of the DSNLU Newsletter- “Waves” which highlights academic activities
organized by the University and achievements of the students of the University.
I took the charge as Vice-Chancellor of this University on 24th December 2018. The mandate and vision of the
University is to advance and disseminate learning and knowledge of law and legal processes with special emphasis
on research activities. Keeping this in mind, the University organizes diverse activities for the students ranging from
juridical lectures by persons of eminence in the legal field to practical training in the form of legal-aid camps.
We are very grateful for the visit of Hon’ble Sri Justice C. Praveen Kumar, Acting Chief Justice, High Court of
Andhra Pradesh and Chancellor, DSNLU on 13.05.2019 along with Hon’ble Sri. Justice A. V. Sesha Sayee, Judge,
High Court of Andhra Pradesh and Administrative Judge, Visakhapatnam District who took keen interest in the
developmental activities and the functioning of the University.
We are also grateful to Hon’ble Sri Justice C. Praveen Kumar, Acting Chief Justice, High Court of Andhra Pradesh
and Chancellor, DSNLU for delivering the First Justice Koka Subba Rao Memorial lecture on “Constitution of India:
Transformative Justice” on 13.07.2019.
The University conducted varied programmes for the enrichment of the students and faculty such as National
Seminar on “Law and Mental Health”, National Conference on “Contemporary Aspects of Direct Tax”, 5th DSNLU
Moot Court Competition, National Workshop on “Civil Trail Advocacy” and National Seminar on “Copy Right
and the Internet Revolution – The Changing Landscape” and Orientation programme for the First year students
etc.
It also organized juridical lectures by eminent personalities like Prof. Sairam Bhat, NLSIU, Bangalore, Dr. S.
Sachidanamdam, Adjunct Professor, NLU, Odisha, Prof. Peter Kuznick, Director of the Nuclear Studies Institute at
American University, Dr. G. Narayana Raju, Secretary, Legislative department, Ministry of Law and Justice, Govt.
of India, Prof. Rajiv Kumar Khare, NLIU, Bhopal, Prof. Uday Pratap Singh, NLIU, Bhopal, Sri A. Satya Prasad,
The University’s future timeline of events include the 7th Novice Moot Court Competition, National Seminar on
“ILO and Child Rights”, International Conference on “Superpowers’ dominion in Outer space and Global Sustainable
Development” and International Conference on “Immanuel Kant and Transformative Justice”. We are certain of
their success.
The University is looking forward with confidence to make its mark among the other National Law Universities in
India.
My special thanks to Hon’ble Sri Justice N. V. Ramana, Judge, Supreme Court of India and Visitor, DSNLU who is
a salient supporter to the University.
I am also grateful to Hon’ble Sri Justice C. Praveen Kumar, Acting Chief Justice, High Court of Andhra Pradesh and
Chancellor, DSNLU for his constant encouragement and guidance in making this University a Centre for Excellence
in legal education.
I would like to congratulate all faculty members, wonderful students and administrative staff of the University for
their Untiring Efforts towards making this University “a cradle of future jurists”.
Before I conclude, I, on behalf of the DSNLU family, would like to express my deep-felt condolences to the family
of Prof. (Dr.) N. R. Madhava Menon. He is the architect of modern legal education in India. National Law Universities
were his brainchild and his passing is an irreparable loss to the legal fraternity. All my years of association with Prof.
Menon kept me inspired to continue to work for the improvement of legal education. I am ever grateful for his
constant guidance and support. The University would like to dedicate this issue of “Waves” to the memory
of Prof. (Dr.) N.R. Madhava Menon.
S. SURYA PRAKASH
Born in an agricultural family on August 27, 1957 in Ponnavaram Village, Krishna District. He enrolled as an
Advocate on February 10, 1983. He has practiced in the High Court of Andhra Pradesh, Central and Andhra
Pradesh Administrative Tribunals and the Supreme Court of India in Civil, Criminal, Constitutional, Labour, Service
and Election matters. He has specialized in Constitutional, Criminal, Service and Inter-State River laws.
He has functioned as Panel Counsel for various Government Organizations. He has functioned as Additional
Standing Counsel for Central Government and Standing Counsel for Railways in the Central Administrative Tribunal
at Hyderabad. He has also functioned as Additional Advocate General of Andhra Pradesh.
He was appointed as a permanent Judge of the Andhra Pradesh High Court on June 27, 2000. He functioned as
Acting Chief Justice of Andhra Pradesh High Court from March 10, 2013 to May 20, 2013. He has- participated in
several National and International Conferences held in India and abroad and submitted papers on various topics
of legal importance.
He was elevated as the Chief Justice of Delhi High Court w.e.f. 02.09.2013 and as a Judge, Supreme Court of India
w.e.f. 17.02.2014.
Born on 26.02.1961 at Hyderabad. Had his school education (Class-I to Class-X) at Little Flower High School,
Hyderabad. Passed intermediate from Little Flower Junior College and B.Sc from Nizam College, Hyderabad.
Obtained Law degree from University College of law, Osmania University, Hyderabad.
Enrolled as an Advocate on the rolls of Bar Council of Andhra Pradesh on 28.02.1986 and joined the office of
Sri C.Padmanabha Reddy. Actively practiced on criminal side and also in Constitutional matters. Had developed
independent practice in short span. Elevated as Additional Judge of A.P. High Court on 29.06.2012. Appointed as
Judge of High Court of Andhra Pradesh and assumed charge as such on 04.12.2013.
He was appointed as an Acting Chief Justice of the High Court of Andhra Pradesh on 1st January, 2019.
DSNLU is honoured to have Justice Praveen Kumar as Chancellor of the Univeristy to steer the University to
greater heights.
DSNLU aims to advance learning and knowledge in law and legal processes. To that end, the University has
organized various juridical lectures, moots, seminars, conferences, workshops etc.
A Two-day Regional workshop on Biodiversity Law was organized by DSNLU in collaboration with UNDP, NLSIU,
and GEF. The workshop hosted participants from various disciplines such as law, agricultural sciences, fishery
The objective of the workshop was to create awareness about legal mechanism for conservation of biodiversity in
India. The workshop was inaugurated by Hon’ble Vice-Chancellor of NLSIU Prof. (Dr.) R. Venkat Rao and an
introductory remark was given by Hon’ble Vice-Chancellor of DSNLU Prof. (Dr.) S. Surya Prakash. Dr. K. Tulasi
Rao from AP State Biodiversity Board was the Chief Guest of the event and he spoke on issues concerning biodiversity
law and its application in the state. He lucidly explained the key points of the law and impediments in its
implementation. Other resource persons included representatives from National Biodiversity Authority, the UNDP
and senior professors from NLISU. Thirty-three participants including students, young academicians and senior
professors deliberated over two days on topics such as Nagoya Protocols, Access and Benefit Sharing Agreements.
The 5th DSNMC witnessed the participation of 24 teams from various reputed and prestigious legal institutes of the
country, including other National Law Universities and premier law colleges. The competition commenced with
the Inaugural Ceremony, conducted on 22ndFebruary, 2019, witnessing the participation of 24 enthusiastic teams
from across the country.
The Preliminary Rounds and the Quarter Final Rounds were conducted on 23rdFebruary, 2019, presided over by
18 distinguished judges from different Law Firms (Amarchand Mangaldas& Co., Fox Mandal & Associates, Khaitan
& Co., Lakshmikumaran & Sridharan, etc.) and High Courts. Eight top scoring teams qualified for the Quarter
Finals, which were conducted on the same day. The Semi Finals for the 5th DSNMC were held at the University
premises on 24thFebruary, 2019.
The Judges presiding over this round were Shri Mohan Rao Ronanki, Joint Director (Economic), Competition
Commission of India; Mr. Animesh Sinha, Partner, Animesh Sinha and Partners (the drafter of the Moot Proposition);
and Mr. Tarun Jain, Advocate, Supreme Court of India. The Semi Finalists were National Law Institute University,
Bhopal; Rajiv Gandhi National University of Law, Patiala; NMIMS Kirit P Mehta School of Law, Mumbai; and
TNDALU School of Excellence in Law, Chennai. National Law Institute University, Bhopal and Rajiv Gandhi
National University of Law, Patiala qualified for the Final Round.
The Valedictory Ceremony marked the end of the Competition with Dr. G. Narayana Raju, Secretary, Legislative
Department, Ministry of Law and Justice, Government of India as the Chief Guest and Shri Anand Vijay Jha,
Additional Director General, Competition Commission of India and Prof. (Dr.) T.S. Somashekar, Associate
Professor, National Law School of India University, Bangalore as the Guests of Honour, addressing the gathering
and sharing their views. Dr. Dayananda Murthy, In-charge Registrar, DSNLU proposed the Vote of Thanks.
The Seminar on Civil Trial Advocacy emphasized on the various theoretical aspects of civil law practice such as
jurisdictional claims, foundational terms, fundamentals of filing a suit, etc and practical knowledge relating to
includes drafting, pleading, and presentation of oral arguments before the Court.
Hon’ble Justice Dr. K. G. Shankar (Retd.) Judge of High Court of Andhra Pradesh, Hon’ble Justice K. V. Vijaya
Kumar (Retd.) as Principal District Judge, and Sri. Mohan Rao, Senior Advocate, Hyderabad presided over various
sessions of the Seminar. Drawing from their long years of experience at the Bench and Bar, they gave valuable
inputs to students and budding lawyers.
The seminar focused on themes like promotion of mental health, prevention of mental disorders, legal issues
related to treatment, mental health laws and rights, emerging trends in mental health, Conventions on the rights
of Persons with Mental Disability and critical issues in the Mental Healthcare Act, 2017.In the Inaugural Session,
the Hon’ble Vice Chancellor emphasized on the interplay between law and mental health. He argued for improving
awareness on mental health issues. He also emphasized on the need to go beyond the Mental healthcare Act
2017 to ensure true protection of the rights of Persons with mental Disability.
Prof. M. Lakshmipathi Raju, the Convener of the Seminar, referred to the minor mental health disorders like stress,
anxiety, fear etc which affect the people. He stated that these minor issues, when compounded, result in mental
illnesses. He argued for the adoption of holistic treatment options to counteract minor and major mental health
issues. He also commended the shift from custodian-based care to a rights-based approach in the treatment of
mental health illnesses under the 2017 Act.
Prof. Muralidhar, NIMHANS emphasized on a multidisciplinary approach to curing mental health illnesses through
cooperation of all human service professionals like psychiatrists, psychologists and psychiatric social workers in the
treatment of patients.
Dr. Radha Rani, Superintendent of Mental Hospital, Visakhapatnam, the Chief Guest of the Inaugural Session,
noted an increase in the incidence of mental illness and asserted the need for medical professionals to collaborate
with legal professionals to promote awareness, treatment, and counseling services.
Other eminent invitees like Prof. Roopesh, NIMHANS, Dr. Rajakumari Reddy, NIMHANS. Ms. Deesha Claire, Ms.
Aruna Srilakshmi spoke on varied topics such as juvenile delinquency, anxiety disorder, and rights of mentally ill
persons. Over thirty papers on varied themes were presented during the technical sessions. Selected papers are
proposed to be published into a book.
Tax regime in India has undergone elaborate reforms over the last couple of years in order to enhance rationality,
ensure simplicity and improve compliance. The tax authorities constantly review the system in order to remain
relevant. To capture such contemporaneous developments in taxation, this Seminar invited papers on various tax-
related themes.
In his Welcome Address, the Hon’ble Vice Chancellor highlighted the background of India’s Direct Tax Policy. Dr.
P. Sree Sudha stressed on the need to realign tax policy with the developmental strategy of the Nation and hence,
the need for constant review of the taxation regime.
After inauguration by the Chief Guest Sri B. G. Reddy, Chief Commissioner of Income Tax (Visakhapatnam), Shri G
V N Hari, senior advocate, highlighted the practical and prosecution- related aspects of direct tax administration.
Sri G. Venu Gopal, Director-Finance, Visakhapatnam Steel Plant detailed the realignment of taxation policy with
the developmental needs of the Nation through his paper “Recent Trends on Exemptions and Deductions under
Income Tax Act.” Shri. O. Naresh Kumar, CEO of Symbiosis Technologies, criticized the aggressive taxation policies
of the government and the wide discretion powers given to tax authorities as resulting in ‘pain of doing business’.
The Technical Sessions were chaired and attended by Chartered Accountancy Professionals, Government of India
officials working in the Indian Revenue Services, and budding lawyers. The seminar witnessed participation of
more than 150 persons.

perspectives and practical knowledge.
A few noteworthy juridical lectures organized by the University between January 2019 and June 2019 are:
“Law making process and interpretation of law- the beginning and the end”
by Dr. G. Narayana Raju, Secretary of Legislative Department, Ministry of law and Justice,
Government of India on 23rd February 2019
In his lecture, Dr. Raju explained the integral role played by the Legislative
Department of the Law M ministry. He emphasized on the role-played by
the Constitution in Legislative Drafting- stating the Constitutional Morality
will prevail over all moralities as the Preamble of the Constitution begins
with “We, the People”. He also elaborated on the Tools acted techniques of
Legislative Drafting.
Dr. Khare established facts to conclude that Union Carbide’s sheer negligence led to
the disaster in Bhopal. He then explained the legal challenges faced in prosecuting
Union Carbide- jurisdictional challenges against a Company executive who had fled to
the United States, application of the Doctrine of Absolute Liability- that culminated
into the enactment of the Bhopal Gas Leak Disaster (Processing of Claims) Act,
1985. He also discussed the fixation of State responsibility and corporate
responsibility in the event of an industrial disaster.
The team from Ethos Alliance gave insight into the practical working
of the Insolvency and Bankruptcy Code. Through illustrations, they
explained strategy formulation with respect to formal and informal
restructuring, drafting the relevant transaction documents, modes
of enforcing and implementing security mechanisms, and liquidation
processes.
