MOOT PROPOSITION

FACTUAL BACKGROUND:-

The short but an important question of law of general public importance as to whether prior
sanction for prosecution qua allegation of corruption in respect of public servants is required
before setting in motion even the investigation process under Section 156(3) of the Federated
State of Micronesia Code of Criminal Procedure (hereinafter referred to as “FSM Cr.P.C”)

The present Special Leave Petition is being preferred against the judgment and final order dated
22.09.2022 passed in HC/IC/CRL.WP.N0.1/2022 by the Hon’ble High Court of Ivory Coast,
whereby the Criminal Writ Petition of the Respondent No. 4 was allowed while setting aside the
order dated 01.01.2022 passed by the Ld. Additional Sessions Judge, Futuna, Ivory Coast in
IC/Futuna/Crl. Misc Application No. 01/2020. The Ld. Additional Sessions Judge, Futuna, Ivory
Coast upon an application filed by the Petitioner under Section 156(3) of the Cr.P.C, had directed
to register the complaint of the Petitioner against Respondent No. 4 and to investigate the same in
terms of Section 156(3) of the FSM Cr.P.C.

That the Petitioner submits that on 01.01.2020, the Petitioner filed a complaint before the
Director General of Police, Futuna, Ivory Coast under cited Subject “complaint against Lathan R/o
Futuna, Ivory Coast, for cheating and other offences in regard to a deal of a petrol pump where one
Lathan cheated the Petitioner for an amount of $2,50,574.80/-.” The Petitioner furnished
documentary as well as electronic evidence to the Police in support of his allegations against
Lathan but the Incharge of Futuna Police Station was reluctant to take any action on the said
complaint.

Being aggrieved with the negative approach of the officials of Futuna Police Station, the
Petitioner was compelled to approach the higher authorities for action on his complaint. In the first
week of April 2020, the Petitioner met with the then Inspector General of Police, Cosma Brown,
through their common friend Mr. Foster, who had convinced the petitioner to pay bribe to
Respondent No. 4 despite the resistance shown by the Petitioner. During the discussion in the
meeting on 01.04.2020, Respondent No. 4 demanded 20% of $2,50,574.80/- i.e. $50,114.96 to
issue directions to the Futuna Police Station for registration of F.I.R. on the complaint made by the
Petitioner. The Respondent No. 4 also stated that if the said amount is not paid to him, he will
ensure that no F.I.R. will be registered on the complaint of the Petitioner and it will be treated as a
civil matter. Thereafter, negotiations were held and consequently, Respondent No. 4 reduced his
demand to $25,057.48/- from the initial demand of $50,114.96/- i.e. 10% of $2,50,574.80/- and
told the Petitioner to wait outside his chamber. On the same day i.e. 01.04.2020, Mr. Foster came
out of the chamber of Respondent No. 4 and informed the Petitioner that the

Respondent No. 4 won’t act unless his demand is met.

Thereafter, the Petitioner and Mr. Foster went to the pre-designated spot at Heaven Hills near
Futuna Government College, where the Respondent No. 4 was already waiting in a Bungalow to
accept the demanded money. At around 14:00 hours, the Petitioner handed over $12,528.74/- in
cash to Mr. Foster who handed over the same to Respondent No. 4 at Heaven Hills. Mr. Foster told
the Petitioner that he had assured the Respondent No. 4 that the balance amount of $12,528.74/-
will be paid in a short while and that he should issue orders to the Futuna Police Station to register
F.I.R. on his complaint. Soon after the above receipt of $12528.74/-, intimation was received with
the Petitioner from Police Sub Inspector Mr. John, informing that F.I.R. will be registered on the
complaint of the Petitioner as directions has already been received from the superiors.
Accordingly, the Futuna Police registered an F.I.R. on the complaint of the Petitioner vide
Futuna/PS/IC/Crime No. 12/2020 dated 01.05.2020 under Section 420 of the Federated State of
Micronesia Penal Code (hereinafter referred as FSMPC).

That after registration of F.I.R., the police officials refused to take further action and thereby
the Petitioner again met with the Respondent No. 4 in his office and informed him that officials of
Futuna Police did not take further action in the matter. The Respondent No. 4 informed the
Petitioner that no further action will be taken till the balance amount of $12,528.74/- was paid to
him. Thereby, the Petitioner personally handed over an amount of $4,176.24/- to the Respondent
No. 4 and assured him that the balance would be cleared in the next meeting within a few days.
The Respondent No. 4 also instructed the Petitioner to not meet him in his official chamber and
that all communication should be done through their common friend Mr. Foster. That the balance
amount of $8352.5/- was paid to the Respondent No. 4 through RTGS in the account of the
common friend Mr. Foster. On 01.06.2020, the Petitioner again went to the office of Respondent
No. 4 and handed over an additional amount of $4176.21/-. During this meeting, at about 16:00
hours, the Petitioner recorded the conversation held between the Petitioner and the Respondent
No. 4, on the audio device carried by the Petitioner. Wherein the Respondent No. 4, admitted the
fact that the amount of $25,057.48/-, which he had accepted from the Petitioner, is only for the
registration of the F.I.R. and not for recovery of the cheated amount.

On 01.07.2020, the petitioner filed a complaint before the Officer In Charge, Anti Corruption
Bureau, Directorate of Vigilance, Futuna, Ivory Coast against Respondent No. 4 for demanding
and accepting bribe and other public servants for protecting Respondent No.4. The Petitioner also
wrote to the Chief Secretary, Government of Ivory Coast, to accord sanction for prosecution of the
Respondent No. 4. On 15.07.2020, the petitioner wrote to the Secretary (Home), Ministry of Home
Affairs, Government of Federated States of

Micronesia to bring to their notice illegal acts of Respondent No.4 and sought investigation on his
complaint.

On 01.08.2020, the Petitioner sent a letter to the Chief Secretary, Government of Ivory Coast
vide letter dated 01.09.2020 to accord sanction for Prosecution against Respondent No. 4. Since no
action was forthcoming in the matter, the Petitioner approached the Superintendent of Police, Anti
Corruption Branch under the provision of Section 154(3) of the FSM Cr.P.C vide letter dated
15.09.2020 with the request to register F.I.R. and order investigation on the complaint of the
Petitioner under the provisions of the Federated States of Micronesia Prevention of Corruption
Act (hereinafter referred as FSMPC) against the Respondent No. 4 and also filed several
complaints to the Respondents as no action was being taken on the complaint of the petitioner.

That the petitioner aggrieved by the non registration of FIR against Respondent No.4 preferred
IC/Futuna/Criminal Misc. Application No. 01/2020 before the District & Sessions Judge, Futuna,
Ivory Coast seeking an order directing the Anti Corruption Branch to register FIR under the
relevant provisions of the FSMPC.

The Ld. Additional Sessions Judge, Futuna, Ivory Coast upon an application filed by the
Petitioner under Section 156(3) of the FSM Cr.P.C had directed the police officials to register the
complaint of the Petitioner against Respondent No. 4 and to investigate into the same in terms of
Section 156(3) of the FSM Cr.P.C.

That the Respondent No. 4 being aggrieved by the order passed by The Ld. Additional Sessions
Judge, Futuna, Ivory Coast preferred a Criminal Writ Petition before the Hon’ble High Court of
Ivory Coast registered as HC/IC/CRL.WP.N0.1/2022. While deciding the criminal writ petition
filed by the Respondent No. 4, the Hon’ble High Court of Ivory Coast set aside the order of
Hon’ble Additional Session Judge, Futuna, Ivory Coast dated 01.01.2022 and further ordered the
authorities to decide the sanction as expeditiously as possible as a period of around two years had
elapsed.

Hence, aggrieved by the impugned judgment dated 22.09.2022 passed by the Hon’ble High
Court of Ivory Coast, Special Leave Petition is filed by the Petitioner before the Hon’ble Supreme
Court of the Federated State of Micronesia for the adjudication of the issues raised by the
petitioners in the present matter.

In the present Special Leave Petition (Criminal) following question of law are before the
Hon’ble Supreme Court of the Federated States of Micronesia for adjudication:-
MOOT PROPOSITION

1. Whether prior sanction for prosecution qua allegation of corruption in respect of public
servants is required before setting in motion even the investigation process under Section
156(3) of the Federated State of Micronesia Code of criminal Procedure?
2. Whether the Hon’ble High Court of Ivory Coast erred in making a distinction between
directions for investigation in terms of 156(3) of the Federated State of Micronesia Code of
criminal Procedure at a pre cognizance stage and post cognizance stage?
3. Whether the Hon’ble High Court of Ivory Coast rightly appreciated the stage of "taking
cognizance of an offence" within the contemplation of Section 190 of the Federated State of
Micronesia Code of criminal Procedure?
4. Whether the guidelines laid down by the Hon’ble Supreme Court of the Federated States of
Micronesia in Vineet Narain & Ors v Union of India (1998 (0) AIR(SC) 889) and Dr.
Subramanian Swamy v Dr. Manmohan Singh & Another (2012 (0) AIR(SC) 1185) ought to be
adhered to?

Researchers of both the parties (Petitioner and Respondents) are required to submit the
final submission before the Hon’ble Court as conclusion for the arguments advance by
the speakers of each party (Compulsory).

NOTE:-

Participants are requested to argue on the side of the Petitioner as well as on the side of the
Respondents before the “Hon’ble Supreme Court of the Federated States of Micronesia”
pertaining to the above case and further elucidate the arguments with appropriate case laws
and inputs.

The laws of the Federated States of Micronesia are pari material with laws of the India. The
Hon’ble Supreme Court of the Federated States of Micronesia considers the leading common
law precedents as being highly persuasive. Hence, all the relevant ancient, modern, texts of
Indian laws may be referred for arguing the case.

This Moot Problem has been formulated solely for the purpose of this competition for
furthering the academic exercise only.
RULES AND REGULATIONS

Article 1 – Team Composition

1. Each team shall consist of minimum 2 and maximum of 3 members. This number cannot
be modified under any circumstances. In case only Two Members are participating then
speaker-1 and 2 can participate then neither of them is allowed to give researcher test.
2. In case 3 members are participating then there shall be 2 Speakers and 1 Researcher in
each team.
3. Each team will have a team code. Teams should not disclose their identity or that of
their institution or city, etc., under any circumstances during competition and such
disclosure shall invite penalties including disqualification from the Competition directly.
The decision for the same shall be at the discretion of the Organizers.

Article 2 – Date and Venue

1. The said competition shall be held from 26ᵗʰ-28ᵗʰ November, 2022 at the Faculty of
Law, Vivekananda Global University, Sector 36, NRI Colony Rd, VGU Campus, Jagatpura,
Jaipur, Rajasthan 303012.

Article 3 – Dress Code

1. Male: Advocate’s attire (black blazer, black trouser, black formal shoes and white formal shirt with black
tie) is compulsory. Participants are expected to make their own arrangements regarding the same. Not
abiding by the said rule can lead to direct disqualification and the Organizing Committee will have
complete discretion regarding the same.
2. Female: Advocate’s attire (black blazer, black trouser, black formal Belly and white formal shirt with black
tie) is compulsory. Participants are expected to make their own arrangements regarding the same. Not
abiding by the said rule can lead to direct disqualification and the Organizing Committee will have
complete discretion regarding the same.

Article 4 – Eligibility Criteria

1. Students pursuing any three-year or five-year integrated course of the LL.B. degree from
any recognized Law college/ University in India by UGC/BCI are eligible to participate.
2. Participant shall carry their college Identity card for the purpose of identification during
the said competition.

Article 5 – Registration Fees

1. Registration Fee with Accommodation: Rs. 5000/- (Rupees Five Thousand Only)
2. Registration Fee without Accommodation: Rs. 3000/- (Rupees Three Thousand Only)

1. All the teams will be provided with a Team Code once after the confirmation of
Registration with confirmation of Payment has been completed.
2. Teams shall provisionally register with the host college by 20ᵗʰ October, 2022 before
sending the Registration Form and Payment Receipt. Forms will only be accepted if the
host has confirmed the Registration formalities.
3. Teams from each participating college are required to send a scanned copy of their
duly filled-in registration form along with the Payment Receipt/ Screenshot for
registration via email to info.moot@vgu.ac.in and send the hard copy of the
Registration form along with Payment Receipt at “Faculty of Law, Vivekananda
Global University, Sector 36, NRI Colony Road, VGU Campus, Jagatpura, Jaipur,
Rajasthan - 303012” latest by 31ˢᵗ October, 2022. Each college must ensure that the
subject of the mail reads “Registration for 2ⁿᵈ VGU Ranka National Moot Court
Competition, 2022”. Forms received after the deadline shall not be considered.
4. Memorial Submission by soft copy on 5ᵗʰ November, 2022.
5. Memorial Submission by hard copy on 12ᵗʰ November, 2022.
6. No pickup drop services will be provided by the host college.

Article 6 – Language

1. The said competition shall be in ENGLISH LANGUAGE only. Use of vernacular language
by the participants during the said competition is prohibited.

Team Code: The team code must be ascribed on the top right corner of the cover page. The
code must be succeeded by the side for which the written submission is prepared.

Margin: The Written submission must maintain an equal margin of 1 inch on all sides.
Non-compliance will result in a penalty of 1 marks per each side of Written Submissions.
Font, size and line spacing: The text font should be Times New Roman or Garamond, size
12 and must be in 1.5 line spacing. Non-compliance will result in a penalty of 0.5 marks
per incorrect format of font, size and line spacing with a maximum of 2 marks per page
of the Written Submissions.
Footnotes: The footnotes must be in Times New Roman or Garamond font, size 10 and
singly spaced. There should be double line spacing between two footnotes. The
Bluebook: A Uniform System of Citation (20ᵗʰ Edition) should be followed in the written
submission throughout. Non-compliance will result in a penalty of 1 marks per page.
Substantive/Speaking footnotes are strictly prohibited. Non-compliance will result in a
penalty of 1 marks per substantive citation.
Header and Footer: The font used for the header/footer, if any, shall be Times New
Roman or Garamond, size 10, 1 spacing. Non-compliance will result in a penalty of 1
marks per page of the Written Submissions.
Page Limit: The memorial shall not exceed from 40 Pages and minimum shall be 25
pages. No annexures, photographs, exhibits, etc. should be added to the written
submission. The written submission shall be marked on a score of 100 marks.

Article 8 – Scouting

1. Teams will not be allowed to observe the oral rounds of any other teams. Scouting is
strictly prohibited. Scouting by any of the teams shall result in disqualification, as per the
discretion of organizers.
2. Any participating team can file a written complaint to the Organizers, regarding the
incident of scouting. The Organizers decision shall be final.
3. The researchers will sit with the speakers at the time of orals and shall not attend the
rounds of any other team participating in the said competition.
RULES AND REGULATIONS

Article 9 - Researcher test

1. The Researcher test will take place on 27ᵗʰ November, 2022 in order to determine the
best researcher. The test will be for 60 minutes comprising of questions both legal and
factual, relating to the moot proposition and concerning laws.

Article 10 – Rounds

Registration for the Preliminary rounds will be held on 25ᵗʰ November, 2022 and draw of
lots for other rounds shall be on the day of the round.
The Preliminary rounds will be held on 26ᵗʰ November, 2022 comprising of Two (2)
Rounds for each Team. In the Preliminary rounds, each team shall appear from both
petitioner and respondent sides.
Eight teams shall qualify for the Quarter finals.
The Quarter finals round will be held on 27ᵗʰ November, 2022.
The Semi finals round will be held on 28ᵗʰNovember, 2022.
The Final round will be held on 28ᵗʰ November, 2022.

Article 11 – Oral Rounds

In the Preliminary and Quarter final rounds the time slot for each round shall be as follows:

Opening Statement on behalf of Petitioner 5 minutes

Opening Statement on behalf of the Respondent 5 minutes

Arguments by Petitioner 15 minutes

Arguments by Respondent 15 minutes

Prayer from Petitioner 5 minutes

Prayer from Respondent 5 minutes


RULES AND REGULATIONS

Therefore, the Petitioner will get a total of 25 minutes and the Respondent will get a total of
25 minutes in the Preliminary rounds. Each speaker shall have to argue at least on one issue.
This rule shall apply to the Two (2) rounds comprising the Preliminary round. Each Speaker
shall deliver either the opening statement or the final argument in each round.

In the Semi finals and Final round, the time slot shall be as follows-

Opening Statement on behalf of the Respondent 5 minutes

Arguments by Petitioner 20 minutes

Arguments by Respondent 20 minutes

Prayer from Petitioner 5 minutes

Article 12 – Judging Criteria

Parameters for judging are:


Knowledge of facts.
Logic & clarity in reasoning.
Persuasiveness and deference to court.
Proper, articulate and systematic analysis of the issues arising out of facts.
Understanding of the laws and procedure.
Ingenuity (ability to argue by analogy from related aspects of law) or knowledge of the
relevant provisions relating to penal laws.

Note
Both the teams must be aware about the appellate procedure followed by the courts.
The first 8 teams who scores highest marks and win both the preliminary rounds shall be
selected for the Quarter Finals.
In case no 8 teams win in both the preliminary round 1 and preliminary round 2, the
aggregate scores in both the rounds (i.e. an aggregate of marks given by all the judges)
shall be considered and the top scorers teams shall be selected for Quarters.
The teams with the highest aggregate marks by all the judges in their respective rounds
shall qualify for Semi-Finals. The same scheme shall apply for finals.

Article 13 – Awards

1. Winner - Rs. 21,000/-


2. 1st Runner Up - Rs. 11,000/-
3. Best Speaker - Rs. 5,000/-
4. Best Researcher - Rs. 5,000/-
5. Best Memorial - Rs. 5,000/-

Article 14 – Certificates

Certificates will be awarded only to the participants during the valedictory ceremony and
under no circumstances they will be provided to any of the participants absent during the
ceremony. In the event that the participants fail to collect their certificates, no mail will be
sent by the host college acknowledging their participation.

Article 15 – Accommodation and Meals

1. The registration amount of Rs.5000/- is inclusive of Registration Amount &


Accommodation. The Accommodation shall not be provided by the host Institution in any
case before 25ᵗʰ November, 2022 11:59 AM and after 29ᵗʰ November, 2022 11:59 AM.
2. Respective team who wishes to arrive a day before the event begins or leave a day
after the event ends, needs to submit a regular accommodation amount for adjustment.

Note: Drinking and Smoking is strictly prohibited at the place of accommodation & college
premises and Non-compliance of this rule will lead to disqualification and the host institution
can institute action against the team found violating this rule and impose heavy penalty.

Article 16 – Miscellaneous

Case laws that the parties wish to rely on at the time of final arguments shall be
submitted in three copies in form of a Compendium (one for the judges, one for the
other side and one for itself).The source of Judgements should be from a verified
database like SCC Online, Manupatra etc.
Opening statement of the petitioner shall be from facts and the issues raised . It shall be
necessary to point out the supporting material from the factsheet herewith provided to
sustain the arguments. As far as the respondent is concerned, the opening address shall
require them to point out the allegations against them.
RULES AND REGULATIONS

Judges are at liberty to ask questions to the Participants on relevant points of law which
may arise as per the fact sheet arising during the conduction of proceedings, in order to
test the Participant’s knowledge of the relevant provisions relating to penal laws.
Last date for seeking clarification with respect to the said competition is 03/11/2022.

Article 17 - General Rules

Each team must prepare memorials for both sides.


Once the memorials have been submitted, no revision, supplements or additions will be
allowed.
One advance softcopy in PDF format must reach the organizers latest by 05ᵗʰ November
2022 on info.moot@vgu.ac.in.
12 Hard Copies (6 copies from each side) of the memorials should reach the organizers
latest by 12ᵗʰ November, 2022 at the aforementioned address.
