1.DNA results that exclude the putative parent from paternity shall be
conclusive proof of non-paternity
2. For purposes of criminal investigation, DNA identification is a fertile
source of both inculpatory and exculpatory evidence.
3. DNA evidence collected from a crime scene can link a suspect to a crime
or eliminate one from suspicion in the same principle as fingerprints
are used.
4. DNA print or identification technology has been advanced as a uniquely
effective means to link a suspect to a crime, or
5. to exonerate a wrongly accused suspect, where biological evidence has
been left.
3.What are the factors to be considered in determining the probative value of DNA
evidence?
(a) The chain of custody, including how the biological samples were
collected, how they were handled, and the possibility of contamination of the
samples;
The U.S. Supreme Court, in the case of Daubert vs. Menell Dow Pharmaceuticals
(1993) came up with a test of reliability and directed that trial judges are to
consider four factors when determining the admissibility of scientific evidence, to
wit:
Post-conviction DNA analysis is typically available in cases where testing was not
available at the time of the original trial or when technology has advance to a level
that offers a more accurate test than the one used previously.
This analysis can result in the release of a convicted prisoner in two ways:
1. The DNA evidence could prove conclusively that the prisoner didn't commit the
crime in question;
2. The DNA evidence could raise a reasonable doubt that justifies overturning the
conviction without conclusively proving innocence.
