JUDICIAL AFFIDAVIT

This Judicial Affidavit of MARBEN B. JALO-OT is executed to

serve as his direct testimony and is prepared in Visayan dialect with
English translation, which dialect and language are known and
understood by him, by Atty. Shalimar Mae S. Tome-Napigquit, who
conducted his examination at KLIM Law Offices at Lacaya Street,
Brgy. Central, Dipolog City.

The witness is answering the questions asked of him, fully

conscious that he does so under oath, and that he may face criminal
liability for false testimony or perjury.

I, MARBEN B. JALO-OT, of legal age, Filipino, single, and

residing in Bagacay, Sibutad, Zamboanga del Norte under oath,
depose and say that:

1. Q: Unsa’y pinakataas nimong naeskwelahan?

[What is your highest educational attainment?]
A: Grade 9.

2. Q: Unsa man imong trabaho karon?

[What is your current occupation?]
A: Wala ko’y trabaho karon pero kaniadto kay tig-bantay ko ug
tindahan.
[I have no work now but I used to assist in a sari-sari
store.]

3. Q: Unsay rason nganong nagbuhat ka og Judicial Affidavit?

[What is the reason for the execution of the Judicial
Affidavit?]
A: Silbi akong testimonya sa kaso kabahin sa malicious mischief
nga ipasaka batok kay RUJECIL A. GUIGUE (“Guigue”).
[To testify on the case of malicious mischief filed against
Rujecil A. Guigue.]

4. Q: Giunsa nimo pagkaila kay Guigue?

[How did you know Guigue?]
A: Kaila ko niya kay naa man siya’y gipatrabaho sa akoa sa iyang
yuta ug gapa-koral pod siya.
 [I know her because she made me work on her land and I
also made a fence on her lot.]
5. Q: Pila man iyang ginabayad nimo pag magpatrabaho siya?
[How much does she pay you whenever she asks you to
work?]
A: Php 250.00 ang adlaw ug pakan-on pod ko niya.
[Php 250.00 per day and a free meal.]

6. Q: Unsa man ang nahitabo atong 2 August 2019?

[What happened on 2 August 2019?]
A: Anang buntaga, nagpahimo si Guigue ug prisohan sa kanding
sa usa nila ka-yuta. Dayon pagka-udto kay niadto mi sa ilang
balay para mokaon.
[That morning, she hired me to make a cage for goats in
one of her lands At noon, we went to her house to eat
lunch.]

7. Q: Pila mo kabuok nagtrabaho atong adlawa?

[How many people did she hire that day?]
A: Duha mi kabuok gahimo sa prisohan sa buntag. Kuyog nako si
Ronel Embrado (“Embrado”).
[There were two of us. I was working with Ronel
Embrado.]

8. Q: Dayon unsay nahitabo pag-abot ninyo sa iya balay?

[Then what happened when you arrived at her house?]
A: Naniudto mi didto dayon nagtan-aw mi og TV hantod mga
2:45 sa hapon.
[We had lunch there and then we watched TV until
around 2:45 in the afternoon.]

9. Q: Unsa’y nahitabo pagkahuman ana?

[What happened after that?]
A: Niabot na si Guigue. Gasugod sila og guba sa koral na
kawayan dayon gitawag mi niya para maghimo ug koral gamit
ang interlink wire.
[Guigue arrived. They then started destroying the fence
made of bamboo and then she called us so that we could
make a fence made of interlink wire.]

10.Q: Kinsa ang nitabang niya na mag-guba atong koral na

kawayan?
[Who helped her destroy the bamboo fence?]
A: Ang iyang igsuon si Rogen Guigue ug usa ka-lalaki na wala ko
kaila.

 [Her brother, Rogen Guigue and another guy that I do not
recognize.]

11.Q: Nakaila ka kinsa ang tag-iya atong koral nga kawayan?

[Did you know who owned the bamboo fence?]
A: Atong panahona, wala Attorney.
[At that time, no Attorney.]

12.Q: Giunsa nila pag-guba sa koral na kawayan?

[How did they destroy the bamboo fence?]
A: Ilang gi-martilyo dayon gitanggal ang kawayan para maguba.
[They hammered it and removed the bamboo so that the
fence would be destroyed.]

13.Q: Unsa kadugaya nila giguba ang koral na kawayan?

[How long did it take for them to destroy the bamboo
fence?]
A: Dali ra man to kay mga 5 or 6 ka-metros ra to ilang giguba
para lang makaagi ang koral na gipahimo sa amoa ni Guigue.
Mga 15 minutos ra to.
[It was just fast because they only destroyed around 5 to 6
meters of the bamboo fence so that the fence that Guigue
told us to make could pass. It took around 15 minutes
only.]

14.Q: Unsa man imong gihimo katong gaguba sila sa koral na

kawayan?
[What did you do while they were destroying the bamboo
fence?]
A: Gipa-andam mi ni Guigue sa haligi sa koral nga himuon namo.
[Guigue made us prepare the post for the fence that we
would make.]

15.Q: Paghuman nila og guba sa koral na kawayan, unsa man ang

nahitabo?
[After they destroyed the bamboo fence, what
happened?]
A: Nitabang sa amo si Rogen Guigue ug katong usa ka-lalaki na
niapil ug guba sa koral na kawayan para makahimo atong koral
ni Guigue.
[Rogen Guigue and the other guy who helped destroy the
bamboo fence helped us make the fence of Guigue.]

16.Q: So upat mo kabuok naghimo sa koral?

[So there were 4 of you who made the fence?]

 A: Oo, Attorney. Ako, si Ronel Embrado, Rogen Guigue ug
katong usa ka-lalaki na wala ko kaila.
[Yes, Attorney. Me, Ronel Embrado, Rogen Guigue and
that other guy that I do not recognize.

17.Q: Unya giunsa nimo pagkabalo kung asa dapit koralan?

[And then how did you know where exactly to place the
fence?]
A: Gitudlo ni Guigue sa amoa kung asa mi mag koral.
[Guigue pointed out to us where to fence her property.]

18.Q: Asa man mo dapit nag-koral?

[Where did exactly did you put the fence?]
A: Gikan sa ilang balay, unahan pa sa giguba nga koral na
kawayan.
[From their house, the fence was made farther from
where the bamboo fence stood.]

19.Q: Unsa man kalayo-a gikan sa koral na kawayan nga giguba?

[How far was it from the destroyed bamboo fence?]
A: Mga 3 ka metro gikan didto.
[Around 3 meters from there.]

20.Q: Unsa kadugaya ninyo gihimo ang koral?

[How long did it take for you to make the fence?]
A: Mga usa ka-oras ra man to kay nahuman mi alas kwatro sa
hapon.
[It only took around one hour because we were done by 4
in the afternoon.]

21.Q: Unsa nga materyales inyong gigamit sa koral na gipahimo ni

Guigue?
[What material did you use for the fence that Guigue
asked you to make?]
A: Interlink wire.

22.Q: Pila man ang gibayad ni Guigue nimo anang trabahoa?

[How much did Guigue pay you for that job?]
A: Php 250.00 iyang gibayad apil na tong gipatrabaho niya sa
buntag kay ang adlaw man iyang gibayran.
[Php 250.00 including the work I did in the morning
because she paid for my daily rate.

23.Q: Naa pa kay dugang isulti?

[Do you have anything more to add?]
