AFFIDAVIT OF COMPLAINT

The UNDERSIGNED, Cipriano Mendoza , accuses Angelo Mangilit and two


other nurses (stationed nurse of the The Manila East Medical Center (Taytay). The
undersigned reposes and avers the following antecedent facts , to wit:

-That I , Cipriano Mendoza, am the son of the patient in Manila East Medical Center
Taytay who was admitted last March 31, 2014.

-That the patient’s name was Corazon Mendoza, 39 years of age and was confined and
medicated for 3-4 days in the said hospital.

-That upon recommendation of the commissioned doctor in the Emergency Department


named Dr.Tan ,the patient was referred to the ICU Department of the hospital.

-That upon referral to the ICU ,I, being the son of the patient, cancelled the referral
made by Dr.Tan since I and my sister (Conchita Mendoza) may not see regularly the
condition of the patient .

-That upon the request of transfer from the ICU to a regular room, the family doctor
(who is Dr. Rabanal) of the patient agreed through telephone that the patient may be
transferred originally from ICU to a regular room. In addition to this, we also asked the
permission of the admission office via a named Bhela if we can transfer the patient from
ICU to a regular room since she was there only for some minutes. The Admission Office
agreed in the affirmative.

-That I also talked to the doctor in charge in the ICU Department for the transfer of the
patient and the doctor in charge also agreed with our request of transfer provided I
should verify it with the Admission Office and provided further that I should seek the
approval of Dr. Rabanal(the family doctor).

-that certain nurses were commissioned in the ICU namely; Angelo Mangilit and the two
other colleagues of his ,whom I was not able to get the name from the Admitting Office,
who took care of the patient.

-That said stationed nurses’ scope of responsibility was to endorse the patient for
transfer from ICU to a regular room .

-That I made a follow up to the said nurses not twice but many times for the
endorsement of the patient but to no avail. The alibi of the said nurses was that there
were some guidelines to be followed before the patient may be transferred from their
ICU Department to a regular room. However, I found out later that the endorsement
should be made only verbally by the said nurses.

-that in my confusion of who will endorse the patient, I have asked the nurses
commissioned outside the ICU if they were the one in charge for the endorsement of the
patient and informed me that the nurses who were assigned in the ICU were the ones
accountable for the release and transfer of the patient.

-that I was amazed by the fact that Angelo Mangilit and company, the nurses stationed
inside the ICU ,were the nurses responsible for the transfer and endorsement.
-That while waiting for two and a half hours for the endorsement of the patient from
ICU to a regular room, I did another follow up from the said nurses and they told me
again that it was not easy for the patient to be transferred urgently because there were
necessary steps to be followed. I’ve asked the nurses if what was the type of
endorsement they need to do, so that the patient may be transferred urgently? They
replied that I should wait, so, I decided to wait outside for them.

-That in waiting for another 30 minutes, I made another follow up in the ICU
Department, I have told myself that this should not be happening because the life of the
patient was very important and that the waiting shall not be restrained for long hours
just for the negligence of these nurses commissioned by the ICU Department and
moreover, for the delay in the services of the patient and patient’s relatives.

-That thenceforth, I’ve finally asked Angelo Mangilit and company why there was a
delay of transfer?He answered that I should wait. I told him that he should have
endorsed the patient already because three hours had already elapsed and that, as a
customer of the hospital and patient as well, we should not be experiencing this kind of
treatment by the nurses and the hospital. I deemed that there was a clear neglect of duty
on the part of the nurses and moreover, on the part of the hospital, too.

-That I have asked again Mr.Angelo Mangilit , Why?, he only replied that they have to
finish the process for transfer and some guidelines for endorsement and this was the
main reason why the patient must not be transferred immediately from the ICU to a
regular room.So that was their reason why the patient was not transferred for 3 hours. I
told them that they should transfer the patient verbally because this was the only
requirement mentioned to me by the nurses commissioned outside the ICU.

-That I have asked Mr. Mangilit , what is his name?(because by that moment ,I don’t
know his name). He replied to me boastfully and with a high tone of voice in Tagalog,
“Ako si Angelo, bakit? (sarcastically and angry). I then again asked his surname, he
answered again in the same actuations “Mangilit, bakit?, Ikaw ba sino ka ba?(angry and
with a high tone of voice).

-That even though they were angry with me and with a high tone of voice, I did not lose
my control and answered then that I was the son of the patient. Afterwards, I asked
them again if they have a Manager whom I can talk to regarding the matter before the
situation becomes out of control.

-That after this incident, I went down and asked the Admitting Office if I can talk to a
Manager of the Hospital or someone I could talk to in order to relay my grievances or
explain the treatment I experienced from the nurses. The Admitting Office called
someone over the telephone and told me to wait to the lobby .Subsequently after about
10-15 minutes, a man approached me and told me that he was the head nurse, his name
was Mr. Alex.(the head nurse assigned that night).

-That Mr.Alex asked me about what happened and I explained the incident to him in
the Admitting Office. I was fortunate that I have talked to him to express my complaints.
After narrating to him the event that had happened in the fourth floor of the hospital,
where the ICU was located, he told me that he will make an incident report regarding
the matter and he will also asked Mr. Angelo Mangilit about the event. Unfortunately,
according to him, Mr. Angelo Mangilit already went home. I told him if what kind of
endorsement is needed in order to transfer the patient, he answered that it was only a
verbal endorsement. So, I asked him why the nurses he handled took more than 3 hours
to transfer a patient, he replied that he will have to talk to the nurses involved. I told
him that this should not happen because we are the customer , and the hospital exists
because there are patients and customers.
-That unequivocally, there was no good customer service by the hospital and that the
employees of the hospital were not doing their job. Consequently, that there was
negligence and delay in the endorsement of the patient.

-That finally, I made already a complaint affidavit to the hospital’s customer service but
it seems the hospital took no action of this matter and that I think that the hospital was
only protecting its business as well as its employees.

-That now, thenceforward, I have come into your office to submit this complaint
affidavit against the nurses involved for their neglect of duty resulting for the delay of
the patient’s release and transfer from the ICU to a regular room.

-That I also pray into your good office that these nurses be apprehended ,especially
Angelo Mangilit and company ,and be sanctioned for disciplinary measures or may be
suspension from work irregularly to vindicate the moral sufferings, mental anguish and
social humiliation we had experienced in the Manila East Medical Center Taytay.

-That said nurse must defray the necessary damages we suffered from them for socially
humiliating us inside the hospital.

-that notwithstanding the complaint affidavit I presented to the customer service of the
hospital and the formal demand to explain the actions of the above-mentioned
employees, respondent failed and refused to resolve the matter. I am therefore
executing this Complaint-affidavit to attest to the truth of the foregoing facts and for the
purpose of initiating an administrative and civil action against the respondent for
violation of their oath for conduct unbecoming of a nurse.
